The purpose of this letter is to assist in the concurrence/conference request from the U.S. Fish
and Wildlife Service (USFWS) pursuant to Section 7 of the Endangered Species Act, as amended
(16 U.S.C. 1531 et seq.) (ESA) for the subject project.
As of May 5, 2024, the USFWS's Information for Planning and Consultation (IPaC) lists the

Tricolored bat
USFWS optimal survey window: May 15-August 15
On September 14, 2022, the USFWS announced a proposal to list the tricolored bat (Perimyotis
subflavus - PESU) as endangered under the Endangered Species Act. USFWS has not provided
an official effective listing date. A review of NHP records updated on January 2, 2024, indicates
no known occurrences within 1.0 mile of the study area. Habitat for the tricolored bat, consisting
of mature trees with 3" DBH or greater is present in the study area. Upon the official listing of the
species, the Town of Cary will commit to no tree clearing from April 1- October 15. No work at
night is proposed. Additionally, limited pile driving will be required for the pedestrian bridge
however no blasting or other loud/percussive construction activities are planned. Additionally, no
blasting, pile driving, or other loud/percussive construction activities is planned. Based on this
information, upon the official listing of the tricolored bat, the suggested Biological Conclusion for
the species would be May Affect, Not Likely to Adversely Affect.
Red -cockaded woodpecker
USFWS optimal survey window: November — early March
Biological Conclusion: No Effect
Habitat is not present for the red -cockaded woodpecker. Wake County is not within a red -
cockaded woodpecker (RCW) consultation area as outlined in the USACE RCW
SLOPES agreement. Following the effects determination key this project will have no
effect on red -cockaded woodpecker. A review of NHP records updated on April 1, 2024
indicates no known occurrences within 1.0 mile of the study area.
Neuse River waterdog
USFWS optimal survey window: November 15 — March 15
Biological Conclusion: No Effect
Habitat is not present for the Neuse River waterdog. A review of NHP records updated on
April 1, 2024 indicates no known occurrences within 1.0 mile of the study area. No aquatic
surveys are recommended for this species.
Carolina madtom
USFWS optimal survey window: March 1 — November 1
Biological Conclusion: No Effect
Habitat is not present for the Carolina madtom. A review of NHP records updated on April
1, 2024 indicates no known occurrences within 1.0 mile of the study area. No aquatic

Biological Conclusion: No Effect
Habitat is not present for the yellow lance. A review of NHP records updated on April 1,
2024 indicates no known occurrences within 1.0 mile of the study area. No aquatic surveys
are required for this species.
Michaux's sumac
USFWS Optimal Survey Window: May -October
Biological Conclusion: No Effect
Habitat in the form of maintained areas, roadside, and utility rights -of -way are present
within the study area. A survey was conducted on May 4, 2023 and Michaux's sumac
was not observed. A review of NHP records updated on April 1, 2024 indicates no known
occurrences within 1.0 mile of the study area
Bald and Golden Eagle Protection Act
The Bald and Golden Eagle Protection Act is enforced by the USFWS. Golden eagles do not
nest in North Carolina. Habitat for the bald eagle primarily consists of mature forests in proximity
to large bodies of open water for foraging. Large dominant trees are utilized for nesting sites,
typically within 1.0 mile of open water.
A desktop-GIS assessment of the project study area, as well as the area within a 1.0-mile radius
of the project limits, was performed on November 30, 2022, using 2019 color aerials. A
waterbody large enough or sufficiently open to be a considered potential feeding sources was
identified. Since there was foraging habitat within the review area, a survey of the project study
area and the area within 660 feet of the project limits was conducted on December 13 and 20,
2022. No eagles or eagle nests were observed during the field surveys. A review of NHP
records updated on April 1, 2024 indicates no known occurrences within 1.0 mile of the study
area. Due to the lack of nests, known occurrences, and minimal impact anticipated for this
project, it has been determined that this project will not affect this species.
The Town of Cary believes that the requirements of Section 7(a)(2) of the ESA have been
satisfied and hereby ask for your assistance with obtaining concurrence/conference from the
USFWS.

your project area, there may be nests present at some point within the timeframe specified. If "Breeds
elsewhere" is indicated, then the bird likely does not breed in your project area.
What are the levels of concern for migratory birds?
Migratory birds delivered through IPaC fall into the following distinct categories of concern:
1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their
range anywhere within the USA (including Hawaii, the Pacific Islands, Puerto Rico, and the Virgin
Islands);
2. "BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation Regions (BCRs) in
the continental USA; and
3. "Non -BCC - Vulnerable" birds are not BCC species in your project area, but appear on your list either
because of the Eagle Act requirements (for eagles) or (for non -eagles) potential susceptibilities in
offshore areas from certain types of development or activities (e.g. offshore energy development or
longline fishing).
Although it is important to try to avoid and minimize impacts to all birds, efforts should be made, In
particular, to avoid and minimize impacts to the birds on this list, especially eagles and BCC species of

point for identifying what birds of concern have the potential to be in your project area, when they might
be there, and if they might be breeding (which means nests might be present). The list helps you know
what to look for to confirm presence, and helps guide you in knowing when to implement conservation
measures to avoid or minimize potential impacts from your project activities, should presence be

Data limitations
The Service's objective of mapping wetlands and deepwater habitats is to produce reconnaissance level
information on the location, type and size of these resources. The maps are prepared from the analysis of
high altitude imagery. Wetlands are identified based on vegetation, visible hydrology and geography. A
margin of error is inherent in the use of imagery; thus, detailed on -the -ground inspection of any
particular site may result in revision of the wetland boundaries or classification established through
image analysis.
The accuracy of image interpretation depends on the quality of the imagery, the experience of the image
analysts, the amount and quality of the collateral data and the amount of ground truth verification work
conducted. Metadata should be consulted to determine the date of the source imagery used and any
mapping problems.
Wetlands or other mapped features may have changed since the date of the imagery or field work. There
may be occasional differences in polygon boundaries or classifications between the information depicted
on the map and the actual conditions on site. if
Data exclusions r4AS
Certain wetland habitats are excluded from the National mapping program because of the limitations of
aerial imagery as the primary data source used to detect wetlands. These habitats include seagrasses or
submerged aquatic vegetation that are found in the intertidal and subtidal zones of estuaries and
nearshore coastal waters. Some deepwater reef communities (coral or tuberficid worm reefs) have also
been excluded from the inventory. These habitats, because of their depth, go undetected by aerial
Imagery.
Data precautions
Federal, state, and local regulatory agencies with jurisdiction over wetlands may define and describe
wetlands in a different manner than that used in this inventory. There is no attempt, in either the design
or products of this inventory, to define the limits of proprietary jurisdiction of any Federal, state, or local
government or to establish the geographical scope of the regulatory programs of government agencies.
