In response to your request to renew the subject NPDES permit (received September 26, 2023), the
Division of Water Resources (DWR or the Division) hereby transmits this draft permit for your review
and comment. Please review this document carefully to assure your understanding of the permit limits and
monitoring conditions, and to correct errors, if any.
Concurrent with this notification, the Division will solicit public comment on this draft by publishing a
notice in newspapers having circulation in the general Pamlico County area, as required by the NPDES
Program. Please provide your written comments, if any, to me, Joe R. Corporon, P.G.
Doe.corporon@deq.nc.gov] no later than June 17, 2024 (approximately 30 days after receiving this
document). Your written comments are welcome, but they are not mandatory.
The NPDES standard conditions (Parts II, III, and IV) are part of this permit but are not included in this
draft document (cover, map, and Part I only). The latest version of Parts II, III, and IV are available at

DWR notes that Fulcher's Point Pride Inc. (Point Pride) has refurbished the subject facility destroyed by
fire in year 2000 and has since resumed seafood operations. We understand that seafood packing and
processing now share a common activities building, and that Point Pride discharges all treated seafood
waste(s) via a single effluent line. These facilities were first inspected and documented by the Division's
Washington Regional Office (WaRO) on July 26, 2019.
The Division understands from your application to renew (received 26Sep2023) that Point Pride has
maintained speciated outfalls as designated subparts under Federal Regulations 40CFR 408. Point Pride's
outfall designations remain unchanged from the previous permit (effective June 1, 2019) as:
• Outfall 001 continues as Non -Process -Contact Wastewater for seafood washing and
packing ONLY, identified on the renewal application (26Sep2023) as "crab washing only."
• Outfall 002 Crab Processing (Manually Processed Blue Crab, 40CFR 408, Subpart B]
• Outfall 003 Shrimp Processing (Non -Breaded Shrimp Processing [40CFR 408, Subpart L]
• Outfall 004 Fish Processing (Manually Processed Bottom Fish [40CFR 408, Subpart U]

Compliance Reporting - Lapses in Discharge Activity. DWR acknowledges Point Pride's challenge to
monitor and report separately each speciated activity considering that all treated effluents utilize a
common discharge line. It is critical for compliance that Point Pride monitor, sample, and report each
discharge separately, and that Point Pride report unused outfall activity on monthly eDMRs as "no flow"
or "no discharge." Failure to report subjects Point Pride to civil penalty assessment.
New Limits for Oil & Grease (O&G) and Total Suspended Solids (TSS) - Renewal replaces previous
Federal 40CFR technology based effluent limits (TBELs) with North Carolina water -quality based
effluent limits (WQBELS) for the parameters O&G and TSS (see Fact Sheet, Tables 00213, 00313, and
00413. Note that previous units of measure in mass (lbs/day) are hereby replaced with units in
concentrations as milligrams per liter (mg/L), see the Fact Sheet for limit calculations. We continue to
require monitoring for Total Residual Chlorine (TRC) to be sampled "only if ' chlorine or a chlorine
derivative is used to disinfect.
NOTE: Renewal permit limits no longer reflect mass (lbs/day) but require future monitoring to be
analyzed and reported in units of concentration (mg/L), see permit sections A. (L) through A. (4.).
Renewal limits reflect current guidelines to protect the receiving stream classified High Quality Waters
(HQW) as %2 the calculated limit (see Fact Sheet). For the parameters Total Nitrogen (TN) and Total
Phosphorus (TP), monitoring continues Quarterly as required by Neuse River Permitting Guidance [see
permit sections A. (L) through A. 4.)].
Estimated Production - Point Pride's renewal application (26Sep2023, pg. 4) offers estimated future
production in pounds (lbs) in accord with 40CFR as Harvestable Weight - Total Yearly [Average] and
Annual Maximum. However, DWR considers Point Pride's projected production (see Fact Sheet, Table 2)
as overly optimistic. Therefore, DWR provides renewal limits based on a 90-day catch season using
historically reported production and effluent flows [see permit sections A. (L) through A. (4.)]. Again,
note that renewal limits reflect North Carolina water -quality based effluent limits (WQBELS).
Following the mandatory 45-day public comment period, the Division will review all pertinent comments,
if any, and take appropriate action prior to issuing an NPDES permit final. If you have questions or

A. (5.) SPECIAL OPERATING CONDITIONS - BMPs

(a) Best Management Practice (BMP) Requirements:
(1) There shall be no discharge of fish parts or floating solids. Discharge shall contain
no foam visible in other than trace amounts.
(2) Permittee shall direct employees and provide resources to implement, at a
minimum, such practices that wastewater volume and wastewater constituents are
reduced, as follows:
• Dry cleanup shall be performed prior to was wn of the facility;
• Personnel shall be instructed to stop wat o thtough idle equipment;
• All process and washdown equipme s be fit ith high pressure/low
volume nozzles;
• All on -demand water delivery e shall Xfitted wi a atic shut-off
nozzles.
(b) Dry Clean-up Requirements:

A. (6.) USE OF BIOCIDES
[G.S. 143-215,143-215.1 ]
The Permittee shall obtain authorization from the Division prior to using any biocide or anti-scalant that
may be toxic to aquatic life. The Permittee shall notify the Director in writing no later than 90 days prior to
using any biocide not already approved for this facility. The Permittee shall provide such notification by
completing a Biocide Worksheet, Form 101 to include a map indicating the receiving stream and the
effluent discharge point. Concentrations of additives to as anti-scalants or biocides such as chromium,
copper, or zinc shall not exceed applicable water quality standards or action levels in the receiving stream,
as determined by calculations using the biocide Work Sheet, Form 101 and the Supplemental Analysis

Federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and program
reports. The final NPDES Electronic Reporting Rule was adopted and became effective on December 21,
2015.

Monitoring results obtained during the previous month(s) shall be summarized for each month and
reported via the eDMR system no later than the last calendar day of the month following the completed
reporting period. Regardless of the submission method, the first DMR is due on the last day of the month
following the issuance of the permit or in the case of a new facility, on the last day of the month following
the commencement of discharge.
Starting on December 21, 2025, the permittee must electronically report the following compliance
monitoring data and reports, when applicable:
Sewer Overflow/Bypass Event Reports; and
Pretreatment Program Annual Reports; and
Clean Water Act (CWA) Section 316(b) Annual Reports.
The permittee may seek an electronic reporting waiver from the Division (see "How to Request a Waiver
from Electronic Reporting" section below).

2. Electronic Submissions
In accordance with 40 CFR 122.41(1)(9), the permittee must identify the initial recipient at the time of
each electronic submission. The permittee should use the EPA's website resources to identify the initial
recipient for the electronic submission.
Initial recipient of electronic NPDES information from NPDES-regulated facilities means the entity (EPA
or the state authorized by EPA to implement the NPDES program) that is the designated entity for
receiving electronic NPDES data [see 40 CFR 127.2(b)].
EPA plans to establish a website that will also link to the appropriate electronic reporting tool for each
type of electronic submission and for each state. Instructions on how to access and use the appropriate
electronic reporting tool will be available as well. Information on EPA's ES Electronic Reporting

All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part II,
Section B. (11.)(a) or by a duly authorized representative of that person as described in Part II, Section B.
(I 1.)(b). A person, and not a position, must be delegated signatory authority for eDMR reporting
purposes.
For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR user account
and login credentials to access the eDMR system. For more information on North Carolina's eDMR

Certification. Any person submitting an electronic DMR using the state's eDMR system shall make the
