Dogtown Bank Parcel Credit Release — Task 3 including pond footprints
Dear Ms. McEachran:
On August 17, 2023, the Division of Water Resources (DWR) received an As -Built Report from
Environmental Banc & Exchange, LLC (EBX) for the Dogtown buffer Site. A corrected report was
submitted to DWR on March 19, 2024. According to the As -Built survey and corresponding project
credits table submitted with the As -Built Report, there are slight adjustments in the total amounts of
Riparian Buffer credits as compared to the approved Buffer Mitigation Plan. The subject site has
generated 610,773 ft2 of buffer restoration credits and 40,718.200 ft2 of buffer preservation credits
for a total of 651,491.200 ft2 riparian buffer credits.
DWR received a performance bond (#9442942) issued to EBX from Fidelity and Deposit Company
of Maryland, in the amount of $100,000, to cover monitoring and maintenance at the subject site.
The term of this bond applies beginning April 8, 2024, and ends April 8, 2025. Future credit releases
will be dependent on both the renewal of this performance bond and the annual monitoring reports.
In accordance with the MBI, signed on September 30, 2020, the following Project Milestones have
been met and the corresponding credits shall be released:

By copy of this correspondence, DWR confirms that you have satisfied the above requirements for
the above -referenced tract and therefore, the following credits are being released and are now
available to sell:

footprints = (0.10 x 570,384.200 ft2 = 57,038.420 ft2) plus 1,400.187 ft2 yields 58,438.607 ft2

Total Catawba Buffer Credits Released: 103,047.457 ft2
Please note that these riparian buffer credits can be provided to offset permitted impacts along
the Catawba River mainstem below Lake James and along mainstem lakes from and including
Lake James to the North Carolina and South Carolina border in the Catawba River Basin
03050101 HUC in accordance with guidelines in the Consolidated Buffer Mitigation Rule, 15A
NCAC 02B .0295, which became effective on November 1, 2015.
