Director NORTH CAROLINA Environmental Quality April 26, 2024 Jamey McEachran DWR Project #: 2018-1097v2 Environmental Banc & Exchange, LLC Catawba County (via electronic mail: jmceachrangres.us ) Re: RES Dogtown Buffer Mitigation Banking Instrument (MBI) Dogtown Bank Parcel Credit Release — Task 3 including pond footprints Dear Ms. McEachran: On August 17, 2023, the Division of Water Resources (DWR) received an As -Built Report from Environmental Banc & Exchange, LLC (EBX) for the Dogtown buffer Site. A corrected report was submitted to DWR on March 19, 2024. According to the As -Built survey and corresponding project credits table submitted with the As -Built Report, there are slight adjustments in the total amounts of Riparian Buffer credits as compared to the approved Buffer Mitigation Plan. The subject site has generated 610,773 ft2 of buffer restoration credits and 40,718.200 ft2 of buffer preservation credits for a total of 651,491.200 ft2 riparian buffer credits. DWR received a performance bond (#9442942) issued to EBX from Fidelity and Deposit Company of Maryland, in the amount of $100,000, to cover monitoring and maintenance at the subject site. The term of this bond applies beginning April 8, 2024, and ends April 8, 2025. Future credit releases will be dependent on both the renewal of this performance bond and the annual monitoring reports.
