Subject: Pre -Construction Notification for Nationwide #29, Hawk Haven Site, Charlotte,
Mecklenburg County, NC.
Dear Ms. Higgins and Messrs. Elliott, Johnson and Hamstead,
Enclosed is a request for permits associated with the Hawk Haven site located at Bankhead Road
in Charlotte, NC. A Jurisdictional Determination Request was submitted in March 2015 to
identify and verify onsite jurisdictional features. On July 29, 2015 a Notification of Jurisdictional
Determination (SAW -2015-00416) was issued for the subject site (attached). Identified surface
waters included approximately 0.35 acres of jurisdictional wetlands and 652 linear feet of
jurisdictional streams.
Impacts for the proposed development total approximately 140 linear feet of
intermittent/seasonal stream. This impact to site surface waters are associated with the
construction of a Wet Pond for treatment of anticipated stormwater flows. Due to the location of

the wetlands and streams on the site, opportunities to avoid this area was limited. The impacted
stream bisects the western portion of the site limiting space for lot placement, roadway access
and appropriate stormwater treatment facilities locations. Plan design for the residential lots,
roadway access and stormwater treatment facilities were oriented and located to limit any
additional fill to onsite wetlands and streams while maintaining required development of lots,
site access and stormwater treatment. Only 140 linear feet of intermittent/seasonal stream will be
impacted. No impacts to onsite wetlands will occur as part of this project. No compensatory
mitigation is being proposed due to the minimal impacts on the site.
With regards to threatened/endangered species, the site is wooded with portions recently
timbered in the last several years. Based upon known occurrences for federally listed species in
Mecklenburg County and their habitat requirements, the proposed impact area is wooded and
therefore contains potential habitat for the recently listed Northern Long Eared Bat (NLEB).
However, due to its location (which is at least 45 miles away from a known occurrence) and
minimal tree clearing (less than 1 acre) within the permitted area, we believe this project is not
likely to adversely affect the Northern Long Eared Bat. The site does not contain any habitat for
other listed species to include Schweinitzii's Sunflower therefore we believe there is no effect to
any other listed species.

Due to the location of the on site streams, opportunities to avoid all impacts to surface waters were limited. One intermittent/perennial stream bisected

Storm water on the site will be handled/treated by six BMPs as shown on the attached plans. The stormwater plan has not been approved yet since

C. Basis For Determination
The site contains_ wetlands as determined by the 1987 Corps of Engineers Wetland Delineation Manual and the Interim
Regional Supplement to the Corps of Engineers Wetlands Delineation Manual: Eastern Mountain and Piedmont Region. These
wetlands are adjacent to stream channels located on the property that exhibit indicators of ordinary high water marks: The
stream channel on the property is an unnamed tributary to Four Mile Creek which flows to Lake Wylie which eventually flows
into the Santee River.
D. Remarks: Jurisdictional "Waters of the US" have been identified on. this propertyas depicted
by submitted Jurisdictional Request Package on file.

This delineation/deterniination has been conducted to identify the limits of Corps' Clean Water Act jurisdiction for the
particular site identified in this request. The delineation/determination may not valid for the wetland conservation
provisions of the Food Security Act of 1985. If you or your tenant are USDA Program participants, or anticipate participation
in USDA programs, you should request a certified wetland determination from the local office of the Natural Resources
Conservation Service, prior to starting work.
