HomeMy WebLinkAbout20240237 Ver 1_USACE Permit_20240512DEPARTMENT OF THE ARMY WILMINGTON DISTRICT, CORPS OF ENGINEERS 69 DARLINGTON AVENUE WILMINGTON, NORTH CAROLINA 28403-1343 May 8, 2024 Regulatory Division Action ID No. SAW-2024-00312 General Permit No. 197800056 Sent Via Email: ahedgepeth@ias-nc.com Mr. Alton Hedgepeth 1880 Fish Pond Road Farmville, North Carolina 27828 Dear Mr. Hedgepeth: Through coordination with the North Carolina Division of Coastal Management we have learned of your request to expand an existing docking facility by constructing a 200-foot pier extension out into Bogue Sound, for a total length of 330 feet, terminating at a 10'X20' T-head platform, in water depths measuring-3'nlw. Two new boat lifts would be installed on either side of the T-Head. An existing boat lift would be removed. According to the plans, the width of the existing access pier measures 5'; the proposed pier extension width would match the existing pier width. Standard Hog Slat 8'X5' sections would be used for the proposed pier extension. The project site is in waters of Bogue Sound, adjacent to 185 Salty Shores Point Drive, in Newport, Carteret County, North Carolina. On January 1, 2022, we renewed general permit No. 197800056, (copy enclosed), that authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and boat shelters, mooring piles, dolphins, jetties and breakwater structures in navigable waters of the United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act of 1899. Special Conditions: Lin order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein (attached). The Guidelines can be found at https://www.fws.gov/media/2017-manatee-guidelines-north-carolina. 2. The extended access pier will be no greater than 5' wide and will be elevated a minimum of 6' above the substrate through SAV and SAV habitat. -2- 3. To the extent practicable, the dock be built without using barges or other vessels likely to physically disturb the bottom during construction and when accessing the location. If this is not practicable, a marked corridor will be established for the construction vessels to traverse the least amount of seagrass possible. Your work is authorized provided it is accomplished in strict accordance with your submitted plans, the enclosed general conditions, and above special conditions. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. Your Department of the Army permit will expire on December 31, 2026. Please read the enclosed permit to prevent an unintentional violation of Federal law. As this Department of the Army regional general permit does not relieve you of the responsibility to obtain any other required approvals, you should contact appropriate State and local agencies before beginning work.
