The existing 36' long X 20' wide, timber deck with timber joists, timber caps, posts and piles at end and interior bents and concrete encased timber abutments, dual span bridge is structurally deficient and will be replaced with a new, single span 70' L X 30' W, cored slab, single span bridge at the same location. An oft=site detour will be utilized during construction. TENNYSON Secretary possible use of an impervious dike to remove the western bent) and 3,633 square feet of Jordan Lake Riparian buffer impact (2,416 sq. fr. Zone 1 and 1,217 sq. ft. Zone 2) and are listed as "allowable" per the Jordan Lake Riparian Buffer Rules Table of Uses. There are no deck drains on the bridge; instead, stormwater runoff will be captw�ed at 2 proposed drop inlets and discharged into existing roadside ditches and outlet at non-erosive velocities. Biologists from the Biological Surveys Group surveyed the project site for the Dwarf Wedgemussel (Alasmidonta heterodon) and determined that the mussel does not existing within the project vicinity and therefore issued a"no effecY' detennination (see attached letter). Habitat surveys for the Red Cockaded Woodpecker, Michaux's Sumac and Smooth Coneflower determined that there is no habitat for any of the named species, nor any specimens present, within the project area. The Bald Eagle is protected in every county in North Carolina under the Bald and Gold Eagle Protection Act; however, no suitable feeding/water source is located within one mite of the project study area to suppo�i Bald Eagle l�abitat. Also, Mr. Gary Jordan (USFWS) recently released the Programmatic Conference Opinion (PCO) for the recently listed Nortl�ern Long Eared Bat (NLEB). This opinion, states in part, that "... rt rs the Servrce's conference opinion that NCDOT activities in eastern North Carolina (Divisions 1-8), as proposed, are not likely to jeopardize the continued existence of the NLEB. Proposed 70' long by 30' wide single-span (Description of Minimization of Water bridge to replace existing 36' long by 20' wide double-span bridge. The proposed grade is about 1' above existing ground in the vicinity of the bridge and roughly matching Quality Impacts) existing by about 120' left of stream and about 105' right of stream (looking downstream). Proposed bridge to be located in same location as existing bridge. The proposed bridge will have no direct discharge into the water or buffers. Stormwater runoff on the existing bridge discharges directly into the water for the full length of the bridge. No deck drains will be installed. Stormwater runoff from the proposed bridge is to flow to two (2) proposed drop inlets at the southeast approach. Runoff will be discharged at minimum practicable slopes, yielding minimum velocities and diffused with a riprap pad at the pipe outlet(0.4 cfs in 10-year event). All proposed stormwater runoff is discharged as far away from the stream and at lowest velocities as practicable. Orange County current GIS mapping, aerial photography, and tax information indicated a mostly wooded APE (viewed 26 August 2013). The APE intersects a large parcel to the north of the existing bridge on which stands a house and outbuildings dating to the early twentieth century; located approximately 520 feet east of the bridge and 140 feet north of SR 1127 (Borland Road), the buildings are beyond likely project impact. Originally constructed in 1954 and rebuilt in 1987, Bridge No. 75 is a 36-foot-long, two-span, timber, stringer/multi-beam bridge and is not eligible for the National Register according to the NCDOT Historic Bridge Survey as it is not historically, architecturally, or technologically significant. Google Maps ��Street View" confirmed the absence of critical historic structures and landscapes in the APE (viewed 26 August 2013). No architectural survey is required for the project as currently defined. For the purposes of the archaeological review the proposed project area is 633.6 feet long (slightly more than 193.12 meters) and extends right-of-way (RO� width from 60 feet to 100 feet (30.48 meters). Thus, the aYea of potential effects (APE) is estimated at roughly 1.45 acres (nearly .59 hectares). A US Army Corps of EngineeYs permit is anticipated but the exact type was unknown at the time of the aYchaeological investigations. A rough predictive model for the distribution of archaeological resources in Orange County was generated by researchers at the Research I.aboratories of Archaeolo�T at the University of North Carolina at Chapel Hill (UNGCH) in 1994. According to that model much of New Hope Creek has a high potential for archaeological resources in differing areas. Broader alluvial areas are expected to have a higher potential for longer-term prehistoric settlements while upland areas might have a fair potential for scatters of pYehistoYic materials. These prehistoric sites may be oveYlaid with some abandoned historic-period occupations. At the current project area, the alluvial landform is narrow with longer slopes on the margins of the APE. Despite these factors, and as a result of the UNGCH study suggesting prehistoric occupation of the New Hope Creek drainage basin, an archaeological reconnaissance was recommended to assess the necessiry for further archaeological investigation. The archaeological reconnaissance of the APE was undertaken on October 16, 2013 by NCDOT archaeologists Shane Petersen and Brian Ovexton. A walkover investigation of the entire APE was completed for the proposed bridge replacement project. As expected the majority of the APE was significantly sloped and considered unlikely to contain intact significant archaeological deposits. Much of the easement along SR 1127 on the north side had been altered to accommodate a utilities easement as well. Additionally, areas immediately adjacent New Hope Creek appeared to be composed of pooxly drained hydric soils. No subsurface investigations were considered to be necessary within the current APE. No further archaeological investigations are recommended for the replacement of Bridge No. 75 as proposed. Should the project change further investigation may be necessary. The project as described should be considered to be compliant with Section 106 and NCGS121-12a. References: Daniel, I. I know you looked at some that we added in Fall of 2014, but am not sure if you looked at the ones in 2013/2014. Can you provide me with any stream forms that you have for the following bridges: 400189 — only 1 perennial stream, no forms done 400271— only have wetland forms (attached); no stream forms, only 1 perennial 670023 — only have wetland forms (attached); no stream forms, perennial 670075 - only 1 perennial stream, no forms done 670173 - only 2 perennial streams, no forms done Also, on Bridges 400189 and 400272, it was noted that small whorled pogonia surveys would need to be conducted in spring of 2015. Do you know if these surveys occurred and what the results were. (it does not appear that they were completed. Amy James had the bridges and did not complete them before she left and I think they fell through the cracks. Is it okay to complete them next spring?) Proposed Bridge Replacement Project The proposed project calls for the replacement of Bridge No. 75 on SR 1127 (Borland Road) over New Hope Creek, in Orange County. The federally endangered Dwarf Wedgemussel is listed by the U.S. Fish and Wildlife Service for Orange County. New Hope Creek is located in the Cape Fear River Basin. From the project site, New Hope Creek flows 23.8 mile before entering Jordan Lake. A map of the project site is attached. NCDOT Biologist Jared Gray from the Biological Surveys Group did a review of the North Carolina Natural Heritage Program (NHP) database on December 31, 2013, to determine if there were any records of listed mussels within the proposed project study area or receiving waters. This review indicated that there are no known occurrences of the federally protected Dwarf Wedgemussel within the project area. Furthermore, there are no known records of Dwarf Wedgemussel for the Cape Fear River Basin. Therefore the biological conclusion for the replacement of Bridge No. 75 over New Hope Creek is No Effect for Dwarf Wedgemussel.
