RE: 401-Water Quality Certification and Neuse River Buffer Rules Compliance Request Re-submittal Park at Langston Cary, Wake County, North Carolina S&EC Project no.: 5968 DWQ Project no.: 020831 Dear Mr. Dorney, On July 16"', 2002, S&EC received correspondence from NC-DWQ stating that the 401- Water Quality Certification application and Neuse River Buffer compliance request for the Park at Langston (DWQ project no.: 020831) had been considered withdrawn by NC- DWQ. We are hereby resubmitting the 401-Water Quality Certification application and Neuse River Buffer compliance request, despite the fact that we feel that the application should have been placed on administrative hold rather than having been considered withdrawn by NC-DWQ. However, instead of debating this issue, we are resubmitting the application in order to best serve the interests of our client. Enclosed are seven copies of the original application as well as seven copies of the site stonnwater plan drafted by the project engineer. Approval from DWQ is required to disturb these areas. Please provide 7 copies of the following information and refer to the DWQ # listed above in your reply. In particular as described in 15A NCAC 2B .0502, we will require you to locate all streams and ponds on the property. Please show these on maps of suitable scale (for instance l" = 100 feet) so we can begin to determine your projects' compliance with 15A NCAC 2I-I .0500. 1. Your plans indicate stormwater discharge that will not flow in a diffuse manner through buffers. Please provide plans and calculations to show that diffuse flow shall be achieved. 2. Please provide table referenced in item # XI. Please telephone me at 919-733-1786 if you have any questions or would require copies of our rules or procedural materials. This project will remain on hold as incomplete in accordance with 15A NCAC 2H .0505(c). The processing time for this application will begin when this information is received. If we do not hear from you by writing within three (3) weeks we will assume you no longer want to pursue the project and will consider it withdrawn. Re: Park at Langston Wake County DWQ # 020831 The Division of Water Quality has reviewed your response, received June 26, 2002, to our request for additional information regarding your application fora 401 Certification and Neuse Buffer Rules Approval, received May 24, 2002, for the subject project. In previous correspondence dated June 4, 2002, this Office requested that you provide plans and calculations to show that diffuse flow of stormwater would be provided in the Neuse Riparian Buffers in compliance with 15A NCAC 2B .0233 (5). Only one plan page was provided that indicated some kind of level spreader for one of the five listed stormwater outlets. No calculations were provided to show that this level spreader is adequately sized, and no topographic information was provided to show that the slopes were adequate to accept the flow. No calculations or (readable) plans were provided for the other outlets. This information was needed by DWQ in order for us to decide whether this project is approvable. Since the requested information was not provided, we are hereby returning the subject application. As such, this application is withdrawn. Should you decide to reapply you must provide seven copies of an application and supporting documentation as well as the appropriate fee.
