The property in question is located in the Hiwassee Dam Community bor- dered by NCSR 294 and Upper Bear Paw Road. The property in question was purchased in 1968 by Clifford (now deceased) and Doris Stringer with a portion (approximately 19 acres) transferred to their daughter Sharon (Stringer) Rhoton. All taxes were paid for those several years. In 2013 we were notified by letter that the NCDOT was planning to improve highway 294 that borders part of the property. Over the next several months, many visits were made onto the still private prop- erty to perform surveys, geological and hydrology studies. We welcomed those crews and offered any assistance that we were able to provide and most importantly; we did not interfere or delay their work. Many of the survey stakes and air survey flags were left after their use and never recovered. We tried our best to mow the hayfield around the stakes, requiring additional time and care as to not disturb their work. In late Z014, we negotiated the sale of a small portion of property along with a small permanent ease- ment, and a small temporary easement. At that time everyone we had contact with from the NCDOT was friendly and amicable. Now the reality of the situation has become apparent. The reality has absolutely nothing to do with the negotiated sale of the property rights for a very small portion of property. Our property was flooded by the construction process, causing damage to our driveway stream crossing (road pipe), added a foot of gravel to the stream bed, reducing the flow volume of our 60" road pipe, flooded our main driveway, washing gravel into the hay field, causing untold erosion to a once productive and relatively level field. But this is not the first failure of NCDOT to our property. Some years back the NCDOT "improved" Upper Bear Paw Road (WNW border of property) and installed a new road pipe at an improper depth. The out- let end drops water Z-3 feet to the stream bed, effectively yielding Upper Bear Paw Road as an earthen dam and raising the water table at least 2 feet. This has had an adverse affect on approximately 5 acres. Where there was adequate drainage before the "improvement", now there is none. Where there were no wetlands, now there may be. All by the hand of NCDOT. As of today, the NCDOT has not begun "improvement" work on our property other than storing a materi- ' als mountain and erecting a silt fence FAR BEYOND the negotiated temporary construction easement. I shudder to think of the damages to the property when they actually start work. Their work effort to date seems careless and inferior. We took our concerns to the NCDOT without any satisfaction. They simply attributed our flood to a 50 year rain. There is no official weather reporting data station in our valley, certainly not any record for the last 50 years. The recent rains were no more than any historical rains, just ask any local resident. Let's be crystal clear here. The NCDOT proceeds to acquire property and easements with a mighty ham- mer, a threat of condemnation. The plans they present in negotiations have nothing to do with what they actually accomplish. Just ask the NCDOT how many times their plans were changed; before, during and after negotiations. With the power to condemn, the NCDOT must have the public trust that it will do so in a trustworthy manner. I can assure you that the NCDOT's practice of voodoo hydrology and use of erroneous plans will destroy any public trust. At this time, we feel regret that we were acceptable of this project. We erroneously had faith that our property would be left in as good of condition or better than prior to the NCDOT visit. I believe the NCDOT has historically misused the power of condemnation and we will never support their use of this abused power any longer. The resolution of this complaint is very simple: 1. Reimburse our expense for repairing our driveway and stream crossing. 2. Reconcile the differences between the negotiated temporary easement and the area actually encom- passed by the silt fence and soil stockpile. Pay or move. The hayfield is not presently usable on south side of creek. 3. Drain all highway runoff directly to creek with underground pipes, thus avoiding erosion to our prop- erty and avoid building the NCDOT "cesspools" that interfere with farming and are an eyesore. 4. Reset Upper Bear Paw Road Pipe to the level of the original stream bed avoiding the 2-3 foot drop, thus avoiding the creation of new "wet lands". 5. Recover the NCDOT's gravel from the creek bed to allow the creek to return to its original drainage state. 6. Insure that all original topsoil (not clay) is replaced after undercutting for any drainage fields. 7. Insure that access to all the property is still available after erecting the NCDOT guardrail, where there is none presently.
