The proposed project involves the permanent placement of fill material into 0.048-acres of non- tidal wetlands for the purpose of constructing a single-family dwelling. X Type of Permit Applied For (check one): IP ( ) NWP () GP ( ) X Applicable law: Section 404 of the Clean Water Act (); Section 10, Rivers and Harbor Act ( ) YOUR APPLICATION/PRECONSTRUCTION NOTIFICATION IS INCOMPLETE AND CANNOT BE EVALUATED UNTIL THE FOLLOWING INFORMATION IS RECEIVED (CHECK ALL THAT APPLY): Your application/pre-construction notification form has not been completed and/or signed (see remarks). Under the conditions of Nationwide Permit # , you are required to submit an aquatic resource mitigation plan. The required plan is either insufficient or has not been included with your notification (see remarks). __ Your application/pre-construction notification did not include information describing measures you have implemented to avoid and minimize losses of Waters of the United States. X Your submitted project plans or maps were insufficient, too large, or not legible (see remarks). Your application/pre-construction notification did not include a delineation of affected special aquatic sites, including wetlands, vegetated shallows, and riffle and pool complexes as required. You must submit a copy of your application to the NC Wildlife Resources Commission (WRC) since your proposed work is in a designated trout water county (see remarks section below for the address of your WRC representative). X Other (see remarks below) REMARKS: 1.Per Nationwide Permit (NWP) General Condition No. 15 Single and Complete Project, the activity must be a single and complete project, which is defined as the total project proposed or accomplished by one owner/developer or partnership or other association of developers. A single and complete non- linear project must have independent utility, which is defined as a project that can be constructed absent the construction of other projects in the project area. Portions of a multi-phased project that depend upon other phases of the project do not have independent utility. Single and complete non-linear projects may not be “piecemealed” to avoid limits in an NWP authorization. As such, please show all previously authorized, including non-reporting pre-construction notices, and all future proposed development, in all phases, for any portion of the development owned and/or developed by Bill Clark Homes of Wilmington, LLC, including all roadways, utilities, and building sites. This calculation should include all areas of waters of the U.S., including jurisdiction wetlands, temporarily and permanently impacted. 2.Please provide ownership documentation for the project site. 3.Submitted plans show that the proposed development will abut against the wetland line with little to no back yard. Please provide assurances that the remaining wetlands will not be impacted during construction or in the future by potential home owners. 4.Please provide a cross-sectional detail of the proposed development from the street towards the preserve. 5.Please provide a copy of the Rourk Woods Homeowners Association documents that show the preserve areas, specifically the preserve area located adjacent to the proposed development. 6.The requirement for mitigation will be revisited after all of the proposed losses to waters of the US have been reviewed.
