I believe the updated map with the impact amount for the isolated stream is the last thing I need to issue the 401 WQC. As Laura
stated, one we issue the 401, the Corps can finalize the NWP.

As indicated in the provisional notification email sent January 19, 2024 (attached), the Corps cannot take final action on the
Nationwide Permit (NWP) verification request until the procedures outlined in the 40 CFR Part 121 (401 Rule) for an individual
Water Quality Certificate (WQC) have been completed. Upon completion of the Section 401 WQC, the requested NWP
verification will be finalized and provided to the applicant.

DWR has reviewed the above -noted project and requires additional information to complete the review. Please note that your
project will be considered "on hold" until a complete response is received.
1) During our site visit, the upper reach of stream "Stream SC (R4)" on the impact map was determined to be
intermittent by DWR. Although an Isolated and Other Non-404 Jurisdictional Wetlands and Waters Permit is no longer
required for isolated wetlands effective June 27, 2023, it is still required for impacts to isolated streams in North
Carolina. Can you please provide an updated drawing/exhibit that includes the impacts to the isolated stream? Assuming
the impacts are the same as those shown in the initial exhibits (184.75 LF) prior to the site visit, an Individual
Certification will be required. DWR will need to issue two separate WQC letters in conjunction with one another, but no
additional fee will be required.
Please let me know if you have any questions. This should be the only remaining outstanding item we need to finish our review. I
will be in the office tomorrow (Friday), so feel free to give me a call back to discuss if needed.
