Outfall 001 is downstream from the concrete water management basin located on the eastern side of the RDA facility. As stated in the Discharge Monitoring Reports (DMRs) for the December 2023 and January 2024 sampling events, the elevated turbidity and TSS concentrations are due to third-party land clearing and construction on the adjacent property, which has resulted in sediment-laden water entering the RDA facility's water management basin. Photo-documentation memorializing the change in volume and quality of stormwater run-on across the RDA subsequent to the construction activities and the steps taken by CPC to mitigate the issue are provided below. Clearing of the property adjacent to the RDA facility began in or around September 2023 in order to expand an existing parking lot for the Raleigh-Durham Internation Airport. Photo 1 shows an aerial of the RDA facility and the surrounding area from October 2022, which shows the adjacent property northeast and east of the facility is forested. Photo 2 shows an aerial from March 2024, which shows the clearing of the adjacent property northeast and east of the RDA facility. As part of the construction, a sediment basin was constructed northeast of the RDA facility. The sediment basin discharges approximately 20 feet from the RDA facility fence line and the drainage flows onto and across the eastern portion of the RDA facility and exits in the southeast corner of the facility. Photo 3 shows the sediment pond outfall taken from the RDA facility fence in the northeast corner of the facility. Photo 4 shows what that area looked like in April 2023 prior to the clearing. Photos 5 and 6 are companion photos of the northeastern side of the RDA facility. Photo 5 was taken in April 2023 prior to denuding the off-site property, and Photo 6 shows the sediment-laden stormwater run-on to the RDA facility after a September 2023 rain event. Photos 7 and 8 are before and after 411 Gallimore Dairy Road I Greensboro, North Carolina 127409 Colonial Pipeline Company photos of the southeastern side of the RDA facility near the water management basin taken in April and September of 2023, respectively. The photographs show the increase in the amount and turbidity of the stormwater. The extremely turbid run-on stormwater has continued during precipitation events after the construction of the sediment basin, as seen in Photos 9 and 10 taken in December 2024. CPC began taking steps to mitigate the potential of impacted water samples from outfall 001 in November 2023, prior to the TSS exceedances, by sealing joints in the water management basin that were a potential pathway for the accumulated, turbid stormwater to enter the basin. Additional mitigation efforts were performed in February 2024, which included the following: • Installation of two rows of silt fence along the northeastern fence line, downstream of the offsite sediment basin discharge point. • Installation of two rows of silt fence and hay bails upstream of the water management basin. • Grading activities to allow stormwater to flow around the water management basin and offsite to reduce the accumulation and ponding of water offsite. Photographs of these site improvements are shown in Photos 11 and 12. As described above and shown in the photographs included, offsite activities have resulted in increased stormwater flow onto the eastern portion of the RDA facility, with the pond discharge and run-on sheet stormwater being extremely turbid. CPC has taken steps to mitigate the increased flow and turbidity but we anticipate continued TSS exceedances as long as construction activities continue on the adjacent property and the sediment basin and sheet flow from the adjacent property continue to discharge stormwater directly across the RDA facility. CPC requests that the Division rescind the NOV and NOD and not issue civil penalties for the December 2023 and January 2024 TSS exceedances since third party, offsite activities are causing the exceedances at outfall 001. CPC also requests the Division not enforce the TSS limits of 30.0 milligrams per liter (mg/L) monthly average and the 45.0 mg/L daily maximum while third party, offsite activities continue to discharge turbid stormwater directly across the RDA facility.
