However, I will not allow for the tree that remains to be removed. You may not begin any work until you receive this permit from DWR and approval from all other entities After a site visit by Michael Burkhard and Devynne Brown on April 30, 2024, they informed me that the pool had already been constructed and completed inside the 50' buffer. Michael also completed a site visit in February as a request from the landowner to remove two trees in the buffer. Michael gave approval to remove the tree closest to the dock, which upon their visit on April 30, 2024, the tree had been removed. Michael did not give approval for the other tree to be removed. Therefore, no other trees in the buffer shall be removed. Michael and Devynne informed me that landscaping and irrigation system work is still being done towards the lake. Please reread the Catawba Buffer Basin Rules to ensure that you are in compliance. 15A NCAC 02B .0614 (7) ZONES OF THE RIPARIAN BUFFER. The protected riparian buffer shall have two zones as follows: (a) Zone I shall consist of a vegetated area that is undisturbed except for uses provided for in Items (9) and (9) of this Rule. The location of Zane I shall be as follows: (i) For the Catawba River mainstem below Lake James, Zone I shall begin at the most landward limit of the tap of the bank and extend landward a distance of 30 feet on all sides of the river, measured horizontally on a line perpendicular to the river. (ii) For the mainstcm lakes located on the Catawba River mainstern, Zone I shall begin at the full pond level and extend landward a distance of 30 feet, measured horizontally on a line perpendicular to the lake. (b) Zone 2 shall consist of a stable, vegetated area that is undisturbed except for uses provided for in Items (8) and (9) of this Rule. Grading and revegetating Zone 2 is allowed provided that the health of the vegetation in Zone I is not compromised. Zone 2 shall begin at the outer edge of Zone 1 and extend landward 20 feet as measured horizontally on a line perpendicular to the surface water. The combined width of Zones I and 2 shall be 50 feet on all sides of the surface water along the Catawba River mainstem below Lake James and along mainstem lakes in the Catawba River Basin.
