This letter is in response to your permit rescission request received on April 25, 2024.
The Mooresville Regional Office has reviewed your permit rescission request and determined that
the Permittee needs to address the following items:
The Permittee shall submit a Closure Plan for the 2,000,000 gallon storage lagoon. The Closure
Plan shall include a timeline for closure activities. Attached is a Division -issued Memorandum
titled "Guidelines for the Closure of Permitted Wastewater Ponds and Lagoons" for your
reference.
2. Please provide documentation from the City of Lincolnton that they are willing to accept the
storage lagoon water into their collection system.
3. Please provide the lagoon water and residual sampling data collected in May 2021, June 2023,
and November 2023.
Accordingly, the Division has denied your permit rescission request. Pursuant to 15A NCAC 02T
.0105 , "the Permittee shall comply with all permit conditions and requirements until the waste treatment
systems authorized by the permit are properly closed or subsequently permitted by another permit issued
by the appropriate permitting authority for that activity."

completing the above items. Once the Permittee has addressed these items, you may resubmit your permit
rescission request via the Non -Discharge online portal.
