A Notice of Violations from Macon County regarding Sedimentation and Erosion Ordinances was issued on February 29, 2024. Impacts to waters were constructed without a Water Quality Certification. The land owners were not aware that approvals were necessary to conduct work within waters. Atlas Environmental completed a stream and wetland delineation on March 08, 2024. A meeting with USACE, DWR, occurred on April 4, 2024 to discuss the after -the -fact impacts. No federally protected species or habitat, and no state, federal, or tribal historic or cultural sites occur within the review area. This was determined from using the NC HPO buffer map, IPAC, and NHP which are included within the permit. There are two streams, one state isolated intermittent stream, five wetlands, and three jurisdictional ponds on -site. The total amount of streams onsite consists of 1,311 LF of stream, 0.054 acres of wetland, and 0.049 acres of ponds. CH 100 is 1,033 linear feet, CH 200 is 153 linear feet, and CH 2O0, a state isolated feature, is 125 linear feet. CH 100 and CH 200 are perennial with the state isolated feature being intermittent. WL 1000 (0.001 acre), WL 1200 (0.010 acre), WL 1300 (0.027 acre), WL 1400 (0.001 acre), WL 1500 (0.015 acre) are hydrologically connected to CH 100. Three impounds are located along CH 100: Pond 1 (0.013 acres), Pond 2 (0.015 acres), and Pond 3 (0.021 acres). The development will require six permanent stream impacts totaling 0.017 acres all occurring on CH 100. Impact S1 (35 LF, 0.002 acres) is for the extension of the culvert for the main road crossing. Impact S2 (31 LF, 0.002 acres) is for flooding of Pond 1. Impact S3 (37 LF, 0.003 acres) is for flooding to Pond 2. Impact S4 (10 LF, 0.001 acres) is for an existing culvert. Impact S1 for the culvert expansion is needed for the main access road. The current road was a single lane, and the expansion allows for two lanes of traffic to access the townhomes. Impact S6 has been installed with the proposal of expansion for a future house. If the road crossing for the house was shifted Northeast upstream from the current position, a wetland could possibly be impacted. Additionally, due to the grade of the slope a switchback is needed for the driveway and moving the location of the crossing would affect the possible building pad placement. The site has been designed and engineered to avoid and minimize impacts. All 0.054 acres of wetlands are being avoided and preserved. All of CH 200 is also being preserved. More than 81 % of the streams are being avoided and preserved. There is a no FEMA floodplain on site. Rip Rap has been removed from the stream decreasing impacts. There is currently a plan for maintenance of the ponds along with a plan to install low -flow orifices in each pond. If the ponds fill up with sediment within 2 feet of baseflow an excavator will be used to remove the sediment. The sediment will then be spread onto high ground on - site. To maintain base flow during the excavation, a pump around will occur. A pipe will be installed to create the low -flow orifice. A trash rack will then be placed on the upstream end. These will be placed below the dam within 60 days of issuance. Enclosed are the necessary permit application documents and additional information.
