Good afternoon All,
DWR has received complaints regarding sedimentation and erosion control issues that are affecting
the wetlands and streams on and off site. DWR supports the USACE request to conduct a meeting to
discuss corrective action to remedy the issues onsite and to ensure the application is complete for
review. The ePCN application for DWR Project #20240542 received on April 10, 2024 is incomplete
in accordance with 15A NCAC 02H .0502. DWR has placed the project on -hold pending submission
of a complete application.
DWR understands the USACE has withdrawn the application. Pursuant to 40 CFR Part 121.6., DWR
is required to respond to a 401 application within the established federal Reasonable Period of Time,
180 days from receipt of the application. The federal reasonable period of time for DWR to review the
application will end on October 7, 2024. Please feel free to call or email me if you have any additional

Good Afternoon
Upon reviewing your permit application, I have run across a few issues. Your application is
incomplete since not all direct and indirect impacts have been taken into consideration.
Upon review of google earth there appears that work is underway. Specifically, non -stream 4 and 5
have already been filled. This action would require a permit and has cut off the connection to
adjacent wetlands. These activities appear to be unauthorized, therefore we will be withdrawing
your application until these issues can be resolved. I would advise you stop work in and around all
wetlands and jurisdictional features.
I would like to set up a conference call/ teams meeting regarding this permit application and the
unauthorized activity. Please let me know when you would all be able to meet.
