Thank you for your email and taking the time to communicate with us. We had a few items to reply on and some more questions I will list below. Please let us know your thoughts sometime
today and we will get everything completed and back to you very soon.
1. Catawba Riparian Buffer Notification Form - Filled out and attached.
2. Agent Authorization Form - Filled out and attached.
3. The project will only have work completed on land in the buffer and not be touching the shoreline. We have not filled out or submitted the Shoreline Stabilization Application form
so do we still need to contact Sheri Montalvo? We have the Buffer Authorization Application Form already 90% completed and have additional notes below for this.
Issues with landscape design:
1. I will revise the plan so there is no sod in the 30ft or 50ft Catawba River Buffer. A few questions on this part. Can we seed this area with Zenith Zoysia? If yes, then we may
proceed with that option. If not, then will hardwood mulch be sufficient for now as it was before we began work?
2. 18" catch basin by the house. We planned to use a Flo-Well system at this location. The objective is to capture some of the surface drainage in this area to minimize erosion downhill
and collect it in the Flo-Well system to recharge and drain into the earth. (PDF sheet is attached). I will note this on the revised plan along with other revisions and get that to
you once completed.
3. The drainpipes as John mentioned were set up temporarily so there were no washouts during construction. We plan to have all drainpipes new and existing end and disperse at the
buffer naturally before making it to the lake.
A few other questions:
* You mentioned above that we only need to fill out and use the Buffer Authorization Application Form to proceed. I believe we mentioned this, but we filled most of it out already,
but missed a few items. We tried to get back into it to complete and are unable to. I believe you mentioned you may be able to help us with the completion which was page 6 and 7 Buffer
Impacts and Buffer Mitigation. (PDF Form is attached of original form) Can you help us complete this portion with information I will provide below?
* I included a scaled design of the rear yard zone 1 and zone 2 impact areas with the square footage of disturbed areas. Can you review this and let us know if this will work to
submit and if you agree with it. This would be needed for the next part on that form which is the Buffer Mitigation part. Can you confirm the total square foot of 3460 appears, correct?
This is all disturbed areas onsite now and we do not plan to go outside these areas any further. Can you also confirm if the purchase of the mitigation credits happens once the plan
is approved to proceed.
* Michael Burkhard requested the sediment fence to be installed, all disturbed areas be seeded, and the property be staked and surveyed in the rear yard to locate all setbacks. All
the requested items are completed.
* Looking at the big picture of this project scope we were planning to install some natural plantings across the rear yard also. It was discussed to have these plantings installed
later this year in the fall possibly. Is there anything that will involve you and your team with an approval for this once that time comes?
We are eager to cooperate and get everything submitted so we can get the project approved and installed for the Mr. Tucker. Please let us know your thoughts and our next steps so we

1. If this project is indeed only having impacts to the buffer and not a true shoreline stabilization application, you will need to get your shoreline application rescinded as only

Issues within the current landscape design plans:
1. The use of sod is not allowed in the Catawba River Buffer - please resubmit a plan using natural grasses.
1. The 18' catch basin by the house is illustrated, however there is no evidence detailing where the catch basin will discharge
1. The drain pipes we saw during our site visit discharging directly in the lake will need to be moved up and out of the buffer to allow for a disperse, sheet flow of water through
the buffer. Direct discharge into the lake is not allowed.
In order for DWR to complete our review, please provide the information within 30 days of receipt of this email. Please note that DWR will consider the project on hold until receipt
of the information.
