1 have enclosed a set of plans, a PCN application for NWP #14, and a vicinity map relative to the
proposed bridge replacement project on NC 197, Yancey County, NC.
We propose to replace the existing 18' timber bridge and 12" center crutch bent with a double
barrel box culvert (2 c�i 8'x4') with silis every 9 feet within both barrels to retain streambed
materiaL Exh�as sills are being placed within the culvert due to high stream slope at the site of
7.17%. The skew, topography, and stream hydraulics at site necessitate use of both barrels for
low flow conditions. The roadway overtops during the 2.5 year storm event The stream gradient
should prevent any bar formation or accumulation of material at the culvert inlet and outlets.
Bankfull veloci[ies within the stream are 735 fUs.
Culvert installation will result in permanent impact to 76 liuear feet of Elk Fork; bank
stabilization will permanently impact an additional 105 linear feet Temporary impacts to an
additional 41 feet of the creek are due to a temporary impervious dike diversion during culvert
construction. The stream is approximately 14 feet wide with a predominately cobble and boulder
substrate. Elk Pork is classified as WS-II, Trout, HQW.
Photographs of two double-barrel pipe culvert structw es on private driveways downstream of the
existing bridge are included in the application.
Existing channel morphology will be maintained upstream and downstream of the culvert.
Riparian vegetation will be reestablished along disturbed areas associated with the project.
Stormwater will be diverted through grass-lined ditches or vegelated buffers prior to entering
streams.
This project may impact potentially suitable northern long-eared bat (Myotis septentrionalis)
(NLEB) summer roosting habitat Therefore, a may affect, not likely to adversely affect is
requested for the NLEB. Minor tree clearing will be performed for the project. The existing

bridge is constructed of timber abutments and timber beams. The crown to bed measurement
(distance fiom travel sw•face to streambed) is 5 feet. Clearance between the bottom of the bridge
and the stream surface is approximately 3 feet. A survey of the bridge did not reveal any
evidence of usage by bats. No effect on the remaining Yancey County list of federally pirotected
species (threatened or endangered) or designated critical habitat will occur. Marella Buncick of
US Fish and Wildlife Service is copied on the application for review.
As a pa�t of the 401 Certification process, the project was processed through the DOT
Programmatic Agreement for Minor Project as required by Section 106 of the National
Historic Preservation Act of 1966 and GS 121-12(a). No Historic Resources will be affected.
By copy of this letter, we request Marla Chambers, Nortli Carolina Wildlife Resources
Commission Western Region Coordinator, to commeut directly to the Corps concerning the
permit request.
By copy of this letter, we are asking the Area Roadside Field Operations Engineer, to comment
on the above project. EIk Fork is classified as WS-ll, Trout, HQW. The project will not require a
trout buffer variance.

Lynn Carpenter, NC Division of Water Resources, Transportation Permitting Unit with cc to

Replace existing 18' timber bridge with a double barrel box (2@8' x 4') culvert with 1.5' sills every 9 linear feet within the
culvert to maintain material on the steep slope. The stream will need both barrels for low flow.

A permanent impact to 76 linear feet of Elk Fork will be necessary for culvert construction with 105 of rip rap for
bank stabilization at inlet and outlet. A temporary impact to an additional 41 linear feet will be necessary for an
impervious dike to dewater the work area during construction. Equipment used will include excavator, crane, and
trucks.

Minimized length of culvert and added sills every 9 feet within the culvert barrels to retain material and maintain fish
passage. Stream gradient (7.17%) and culvert slope (6.77%) are high therefore the structure will be buried 1.5 feet with
the additional sills to retain material. Bottomless structures were not practical at the site due to lack of suitable rock within
5 feet of streambed elevation. A bridge structure would be difficult due to a horizontal curve and a transition in
superelevation at the site.

The purpose of this letter is to notify you that the Nor[h Cazolina Department of Environmental Quality -
Division of Mitigation Services (NCDEQ-DMS) will provide the compensatory stream miti�ation for the subject
project. Based on the information received from you on October 12, 20I5, the impacts are located in CU 06010108

This mitlgatlon acceptance letter replaces the midgation acceptance letter issued on October 13,
2015. This impact and associated mitigation need were under projected by the NCDOT in the 2015 impact data.
NCDEQ-DMS will commit to implement sufficient compensatory sheam mitigation credi[s to offset the impacts
associa[ed wi[h this project as de[em�ined by the regula[ory agencies using the delivery dmeline listed in Section
F3.c.iii of the In-Lieu Fee Instrument dated July 28, 2010. If the above reFerenced impact amounts are revised, then
tl�is midga[ion acceptance letter will no longer be valid and a new mitigation acceptance letter will be required from
NCDEQ-DMS.
