Good afternoon Paul,
DWR has reviewed the additional information submitted. Based on the proposed impacts and in
accordance with 15A NCAC 02H .0506 (c) mitigation is required for impacts to wetlands that exceed
one -tenth of an acre. It is our understanding that the USACE is coordinating and has communicated
the mitigation requirements for this specific project. DWR will continue to place the project on -hold
until the mitigation information is received, and review can continue.
Pursuant to 40 CFR Part 121.6., DWR is required to respond to a 401 application within the
established federal Reasonable Period of Time, 180 days from receipt of the application. The federal
reasonable period of time for DWR to review the application will end on August 4, 2024. Please feel

Here are the revised impact tables, Appendix 2 forms, WOTUS figure and impact plans for Forrest
Run. As we discussed, issuing a Delineation Concurrence is fine. Please let me know if you have any
questions or if anything is missing. If you don't mind, can you copy everyone here when you respond
about the permit completeness.
