The existing conditions of Lot.1 consist of graded land with grass cover, a retainingwall, chain link fencing, a 6"
sanitary sewer clean out, two storm drain inlets which outlet on the downstream side of the retaining wall into an
existing riprap level spreaders. Qn Lot 2, the existing conditions are forested with a sanitary sewer easement just
north of the buffered stream. The general land use in the vicinity includes residential development, commercial
development and some rural residential.

jurisdictional wetlands onsite, only an intermittent jurisdictional stream. This was verified in 2003 (AID#
200321370) and'the site was walked again in 201.5'to verify no additional jurisdictional watersbesidesthe stream..

I have reviewed the information submitted for the project referenced by the Raleigh Regional
Offioe as NBR 03-097. An evaluation of the stream and pond features present an the property
was performed on April ib, 2003 to determine whether or not the site would require compliance
with the Neuse Buffer Rules.
The features represented on the Wake County Soils and the Southeast Durham USGS
topographic maps were evaluated to determine their subjectivity to the Rule. It was determined
that there are two main stream features depicted within the property boundaries. As a result of
the site visit, It was determined that Feature A is subject to the Neuse Buffers throughout its
extent on the property and Feature F is nearly so. Features D, E, F, G, and H, which are tributary
to Feature F, become subject to the buffers at Hags W2, 05, 07, W4, and 11 respectively -
Feature B and C, although depicted on the maps are not present on the ground as streams and
therefore not subject to the Neuse River Basin: Nutrient Sensitive Waters Management Strategy;
Protection and Maintenance of Existing Riparian Areas, Administrative Code 1 Sk20113.0233,

You have our approval in accordance with 15A NCAC 026.0233 and any conditions listed below, to impact
approximately 3,8351? (or 0.09 sores) of Zone 1 and 3,433 fe (or 0.08 aores) of Zone 2 of the protected riparian buffers
for Cts puTwe,01 r0 nstaV" a ro&d with a bottovmlass otthrert at the subject property as described within youir
application dated August 22, 2023 including additional information received on November 28, 2003. In addition, you
should obtain or otherwise comply with any other required federal, state or focal permits before you go ahead with yogr
project inoiuding (but rlgt limited to) Erosion and Sediment Control and Non -discharge regulations.
This approval is only valid for the purpose and design that you described in your application. If you change your Pmjsct,
you must rimly us and you maybe required to send us anew application. If the property is said, the new owner must
be given a copy of this authorization and approval latter and Is thereby responsible for complying with all conditions. For
this approval to be valid, you must follow the conditions listed below.
Conditions:
1. Diffuse Flow - An additional condition is that all stonnwater shall be directed as diffuse now at non-6milvs
valocitles through the protected stream buffers and will not re -concentrate bafars discharging Into the stream as
ldentiflled within 15A NCAC 2B .0233(5).
2. Certificate of Completion - Upon completion of all work approved within this authorization, and any subsequent
modifications, the applicant is required to retum the attached Certificate of omnpletion to the 401/Wouands. Unit,
North Carolina Division of water Quality, 1650 Mail Service Center, Raleigh, NO, 27599-1650.
3, No Stream Impacts (Open Bottom & Bottomless Arch Culverts) - You've stated within your application that a
bottomless culvert will be used to cross the stream and that no impacts will occur to either wetlands or streams.
This letter does not approve any impaots to streams or watiands. The proposed project must comply with all
applicable water quality standards as listed in 15A NCAC 02B .0200. The placement of the cubm is shall not be
conducted In a manner that may result in aggradation, degradation or significant charges in hydrology of the
stream bed and bank, adjacent to or upstream and downstream of the structure. The openings must be
provided to maintain the natural hydrology of the system as well as prevent constriction of the floodway that
may result in aggradation, degradation or significant changes in hydrology of strealrma.
4. Erosion & Sediment Control Practices
Erosion and sediment control practices must be in full compliance with all specaicabons governing the proper
design, installation and operation and maintenance of such Best Management Practises in order to Protect
surtace waters standards:

a_ The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in a000rdance with the rnost recent version of the North Carolina Sedr'nrrerrt and Efflsr°r: Control
Planning and Design? Mendel.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must
be such that they equal, or exceed, the requirements specified in the most reWt version of the North
Carntina Sediment and Erosion Control Manual, The devioes shall be maintained on all construction sites,
borrow sites, and waste pile (spoil) projects, including contractor -owned or leased borrow pits associated
with the project,
5. No Impacts Beyond the Footprint Of the Impacts Depicted in the Approved PCN
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the
impacts depleted in the Preeonstruction Notice Application_ All construction activities, including the design,
installation, operation, and maintenance of sediment and erosion control Best Management Pradices, shall be
performed so that no violations of state water quality standards, statutes, or rales occur_
6. No Sediment & e=rosion Control Measures win Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable, it placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall
be removed and the natural grade restored within six months of the date that the Division of Land Reeouroes has
released the project.
Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer Impacts)
shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in
Articles 3 and 4 of G.S.150B,
This letter completes the review of the "No Practical Alternatives" determination under 15A NCAC 211 .0233. If you have
any questions or would like a copy of the buffer rules, please call (919) 733-1786. This ietter does not authorize any
impacts to eNher Waters of the United States or Waters of the State. Please contact the US Army Corps of Engineers
(USACE) or NC Division of Water Quality (DWQ) tf any impacts are proposed to either of these waters.
