(CEC), on behalf of Tryon Equestrian Partners, LLC represented by Mr. Jeff Brown. The permit application requested written authorization for the impacts associated with development of the Tryon International Equestrian Center. The comments provided by the DWR are listed and discussed below. DWR Comment #1: "Eliminate RC2 or explain why it is necessary in addition to RC3." As stated in the previous letter, the applicant has avoided 97.7 percent (64,669 linear feet) of streams on site; even so, RC2 (185 linear feet for two stream crossings) has been eliminated from the site plan. An updated site plan has been included for review (Figure 1). If it is determined that additional stream crossings are needed at a later date for future commercial development, the applicant will apply to modify the permit. If there is a need for a permit modification, sufficient details and justification would be provided to review the project. DWR Comment #2: "There are three fill slopes associated with the farmettes that are proposed immediately adjacent to stream channels on the site. Clearly explain how sediment will be prevented from entering streams during construction of the project." Fill slopes associated with the farmettes have been redesigned so that they are 30 - feet or greater from the adjacent stream channel (see attached map, Figure 1). Additionally, standard sediment and erosion control measures would be utilized on site. A sediment and erosion control plan would be reviewed and approved by the DEMLR, Land Quality Section. 32 Clayton Street Asheville, NC 28801 828-698-9800 Tel Ms.Higgins 01.07.16 Page 2 of 5 DWR Comment #3: "Provide details regarding how El will be constructed including whether an underdrain will be installed, and how hydrology of the stream will be maintained." Stream impacts in the location of E1 would be comprised of French drains that would discharge into the existing stream at the base of the fill slope. Treated-- stormwater would also be discharged adjacent to the stream. No water would be routed out of the watershed; therefore, stream flow should not be reduced. The applicant believes the information submitted in this package addresses all issues set forth by the DWR in their letter dated December 22, 2015. JAY ZIMMERMAN Direcaa DWR # 13-1200 V2 Polk County On October 30, 2015, the Division of Water Resources (Division) received your response to the Division's request for additional information regarding the application, dated June 23, 2015, requesting an Individual Water Quality Certification from the Division for the subject project. A Public Notice was issued by the. U.S. Army Corps of Engineers on July 7, 2015. The Division has determined that your application remains incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. Provide more details regarding avoidance and minimization of stream impacts for this project. [15A NCAC 02H .0506(f) and (g)] Proposed impacts RCI and RC2 include 3 stream crossings that all result in access to the same area. Your response indicated that two crossings are necessary to access two different sections of development. You further explained that the loop road was removed to keep commercial traffic separate from residential traffic. The roadway associated with RC3 provides a separate access to the commercial section of the development. Eliminate RC2 or explain why it is necessary in addition to RC3. 2. If all of the requested information is not received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please be aware that you have no authorization under the Section 401 of the Clean Water Act for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
