Mr. Moore,
On March 15, 2024, the Division of Water Resources (Division) received your applicaƟon requesƟng a 401 Water Quality
CerƟficaƟon from the Division for the subject project. The Division has determined that your applica Ɵon is incomplete
and cannot be processed. The applicaƟon is on-hold unƟl all of the following informaƟon is received:
1. The Division requires that work in streams be conducted so that the flowing stream does not come in contact
with the disturbed area in order to prevent turbidity within the stream. Please explain and provide plans for how
this will be accomplished for the installaƟon of the culvert within NWW-1 Boring Mill Branch, such as with a
pump around system. [15A NCAC 02H .0506(b)(2); 15A NCAC 02H .0502(a)(9)]
2. The project proposes to fill a porƟon of wetland Wet-1 for the construcƟon of a driveway, with porƟons of Wet-
1 remaining north and south of the driveway aŌer project compleƟon. Plan sheet L4.2 shows that pre-
development drainage flows from north to south within Wet-1, which would be interrupted by the proposed
driveway. No culvert is proposed beneath the proposed driveway that would maintain the exisƟng hydrologic
condiƟons. Please explain how the proposed driveway will not lead to secondary impacts by altering the
hydrology, and therefore removing the exisƟng uses, of the southern porƟon of Wet-1. If secondary impacts will
occur, please include them in the impact total and miƟgaƟon calculaƟon. [15A NCAC 02H .0502(b)(3)]

the applicaƟon. Please clarify which email address is correct. [15A NCAC 02H .0502(a)(2)]
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested informa Ɵon for the
proper consideraƟon of the applicaƟon. Please provide your response by June 7, 2024. If all of the requested
informaƟon is not received, the Division will be unable to approve the applicaƟon and it will be denied as incomplete.
The denial of this project will necessitate reapplicaƟon to the Division for approval, including a complete applicaƟon
package and appropriate fee.
