Please find a copy of the Pre -Construction Notification Application for the approximate
40 -acre site located at 412 Knox Farm Road in Statesville, Iredell County, North
Carolina. The purpose of this project is to develop the site with a solar farm. Due to the
limitations of site access, a culvert and utility line crossing are proposed across the
intermittent stream on the western portion of the site.
On behalf of Strata Solar Development, LLC, I am requesting that a NWP 12 be issued
to authorize the permanent and temporary impacts of 39 LF of stream. The crossing is
designed to allow construction and utility access across the stream on the western
portions of the site. The attached permit application and associated exhibits provide
details pertaining to the proposed project impacts.

3. Project Description
3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application:
The site consists of agricultural fields and wooded land. The site consists of rolling hills, indicative of the Piedmont
region. The surrounding properties consist of agricultural fields, wooded land, single -family residences, and an electrical
substation.

3d. Explain the purpose of the proposed project:
The site is in the preliminary stages for the development of a solar farm. An intermittent stream is located on the western
portion of the site. The western portion of the site consists of a thirty foot wide access area, used for a proposed utility
access. The thirty foot wide access area consists of a 15 foot temporary easement and a 15 foot permanent utility
easement according to the Deed Book 1955; Page 1546. A 14 foot temporary construction drive is proposed within the
30 foot easement. In order to gain access for construction and maintenance along the utility easement, a proposed
culvert crossing will be constructed across the intermittent stream.
3e. Describe the overall project in detail, including the type of equipment to be used:
Clearing, grading, earthwork, and construction activities will be utilized in the construction of the solar array farm. The
proposed plan includes constructing a culvert crossing for construction and maintenance activities and a proposed utility
line across the intermittent stream on the western portion of the site. The stream crossing will have 16 linear feet (LF) of
permanent impact and 23 LF of temporary impact. A concrete duct bank will be permanently placed approximately 12
inches below the channel invert for the underground utility line crossing. Following the proposed construction, portions of
the culvert and riprap apron located in the temporary easement will be removed. The proposed impact area will include
silt fence stone outlets at low points in the silt fence, and the installation of a temporary coffer dam with a pump around
system to dewater the construction area. The proposed pump around dam will not be set outside of the impact areas.
The culvert crossings will include riprap into the bed of the stream bed to match the existing grade. The culverts will be
placed 6" below the existing grade.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a. Specifically describe measures taken to avoid or -minimize the proposed impacts in designing project.
No avoidance possible based on the location of the intermittent stream, easement access, topographic relief, and engineering
for the utility line crossings. The culvert crossing is proposed on the western portion of the site, creating construction and
maintenance access along the proposed utility easement. The proposed installation of the temporary coffer dam with the
pump around system will assist with the diversion and dewatering within the construction zone. The proposed stream impacts
have been designed to limit impact of the stream area based on the location, grade, and topography. The attached exhibits
propose a total of 16 LF of permanent impact and 23 LF of temporary impact. Total impacts are 39 LF.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Disturbance of the stream shall be minimized to the extent practicable in order for proper installation of the culvert and a
concrete duct bank with a utility line below the stream bed surface. The construction techniques shall be conducted in
accordance with the NCDENR standards. Temporary and additional erosion control measures shall be maintained throughout
the construction process. Control measures include installing a silt fence in the stream bed and a riprap apron into the bed,
matching the existing grade. Following construction activities, the culvert and rip rap apron located in the temporary easement
will be removed and the stream channel and banks will be restored to their original state.

The Grantors herein do hereby reserve unto themselves, their successors and
assigns, forever, a perpetual and permanent easement fifteen (15) feet in
width for the purpose of clearing, trenching for, laying, constructing,
using, replacing, repairing, reconstructing, and maintaining utilities
within the easement granted herein; all the above-described purposes to be
performed in any part of said easement where necessary, said easement being
appurtenant to, and for the sole benefit of, the remainder of the real
property described in Iredell County Deed Book 845, page 154 owned by the
Grantors on the date of this conveyance, the metes and bounds of said
easement being more fully described as follows:
BEGINNING at a #4 rebar set in the eastern margin of the
right of way of Triplett Road, said rebar having coordinates of:

common boundary line of the property hereinabove described and
conveyed and the property of Anderson Agriculture Limited, now
or formerly (See Book 1384, Page 2491) South 53-35-26 East
2909.33 feet to a #4 rebar found, said rebar having coordinates
of N726058.7983 and E1475814.1179, the southeast corner of
Anderson Agriculture Limited; thence with a new line of Reitzel,
et al. (see Deed Book 854, page 154) South 02-34-20 West 15.0
feet to a point; thence North 53-35-26 West 2,908.96 foot,to a
point in the eastern margin of the right of way

In addition thereto a temporary construction easement is also
reserved which will automatically expire upon the completion of the
construction and installation of the utilities within the aforesaid
permanent utility easement, which said temporary construction easement
shall be fifteen (15) feet in width and shall be located adjacent and along
the entire southern margin of the above-described permanent utility
easement.
This deed of easement is reserved upon the following conditions to
which Grantors expressly agree, for themselves, their heirs, successors and
assigns, forever:
1. Land disturbed by GRANTORS or their representatives or designees,
whether within or beyond theparameters of the easements herein
described, shall be substantially restored, at their sole expense,
to its original condition as it was before the commencement of said
land disturbing activities.
2. In their uses of the easements herein reserved, GRANTORS shall not
molest, disturb, or in any manner interfere with the activities and
uses of the land upon and across which said easements lie.
3. The easements herein described shall be kept by GRANTORS in such
condition, that the GRANTEES can enter upon the same without
hindrance or obstruction.
4. GRANTEES shall not to construct or place any structure or fill on or
over the permanent easement herein granted without the prior written
consent of the GRANTORS, nor take or engage in any activity or
action which would endanger the structural integrity of the utility
easement facilities and appurtenances thereto, by any construction
activities or otherwise.
S. The easements, agreements, and conditions contained herein are
appurtenant to and run with the land, and are binding upon the
heirs, administrators, executors, successors, and assigns of the
parties hereto.
6. This deed of easement contains the entire agreement and
understanding between the GRANTORS and the GRANTEES regarding same;
there are no oral understandings, terms, or conditions, and
neither the GRANTORS nor the GRANTEES have relied upon any
representation, express or implied, not contained herein;
The property hereinabove described was acquired by Grantor by
instrument recorded in Book , Page
A map showing the above described property is recorded in Plat Book , Page .
TO HAVE AND TO HOLD the aforesaid lot or parcel of land and all privileges and
appurtenances thereto belonging to the Grantee in fee simple.
And the Grantor covenants with the Grantee, that Grantor is seized of the premises
in fee simple, has the right to convey the same in fee simple, that title is
marketable and free and clear of all encumbrances, and that Grantor will warrant and
defend the title against the lawful claims of all persons whomsoever except for the
exceptions hereinafter stated.
Title to the property hereinabove described is subject to the following exceptions:
1. ANY AND ALL EASEMENTS, RIGHTS OF WAY AND RESTRICTIONS OF RECORD.

Subject: Proposed Site Plan Changes to the Tripple State Farm Solar Site, 412 Knox Farm Road,
Statesville, Iredell County, North Carolina
We received your letter dated November 20, 2015 (received on November 23, 2015), requesting
our comments on the subject project. We previously commented on this project in a letter to you
dated August 20, 2015. The following comments are provided in accordance with the provisions
of the National Environmental Policy Act (42 U.S.C.§ 4321 et seq.); the Migratory Bird Treaty
Act, as amended (16 U.S.C. 703); and section 7 of the Endangered Species Act of 1973, as
amended (16 U.S.C. 1531-1543) (Act).
Your letter indicates a two acre addition to the project along the north side of Triplett road to the
northwest of the originally described project site. This minor addition in a highly disturbed area
does not our concurrence with your assessment that the proposed project will not affect any
federally listed species or their habitats. Therefore, we believe the requirements under section 7
of the Act are fulfilled. However, obligations under section 7 of the Act must be reconsidered if-.
(1) new information reveals impacts of these identified actions that may affect listed species or
critical habitat in a manner not previously considered, (2) these actions are subsequently
modified in a manner that was not considered in this review, or (3) a new species is listed or
critical habitat is determined that may be affected by the identified actions.
