Please find a copy of the Pre -Construction Notification Application for the approximate
46 -acre site located at 14614 U.S. Highway 64 Alternate in Williamston, Martin County,
North Carolina. The purpose of this project is to develop the site with a solar farm. Due
to the limitations of site access, two culvert crossings and a utility line crossing are
proposed across the wetland area on the central portion of the site.
On behalf of Strata Solar Development, LLC, I am requesting that a NWP 12 be issued
to authorize the permanent and temporary impacts of 0.057 acres of jurisdictional
wetlands and 90 LF of permanent and temporary stream impacts. The crossings were
designed to allow construction, vehicle, and utility access across the wetland and stream
to the eastern and western portions of the site. We previously had three crossings over
the wetland and stream but we were able to re -design the impacts to have two crossing
impacts. The attached permit application and associated exhibits provide details
pertaining to the proposed project impacts.

application:
The site consists of agricultural fields and clear-cut wooded land. The parent parcel consists of a single-family residence,
multiple.garage, buildings, repair shops, and a small HVAC business, all located north of the site. The surrounding
properties consist of agricultural fields, wooded land, single-family residences, and an electrical substation.

3d. Explain -the purpose of the proposed project:
The site is in the preliminary stages for the development of a solar farm. A jurisdictional wetland area and stream are
located on the central portion of the site, oriented northeast to southwest. Based on the proposed array plan, the wetland
and stream are located within the development plan. In order to provide access for maintenance and construction
activities, one proposed crossing and one extension of an existing culvert are'needed.
3e. Describe the overall project in detail, including the type of equipment to be used:
Clearing, grading, earthwork, and construction activities will be utilized in the construction of the solar array farm. The
proposed -plan includes constructing one culvert crossings for transportation and a proposed utlity line crossing across the
jurisdictional wetland and stream located on the central portion of the site. The first proposed wetland impact area
consists of a culvert crossing on the southwestern portion of the site, and 0.008 acres of permanent impact and 0.004
acres of temporary impact. The proposed stream impact consists of 20 LF of permanent impact and 13 LF of temporary
impact. The second proposed wetland and stream impact area consists of 0.016 permanent wetland impacts and 0.006
temporary wetland impacts. The stream will also be impacted in this area by 42 permanent LF and 15 LF of temporary
impact. The third proposed wetland impact area consists of another culvert crossing on the central portion of the site, and
0.018 acres'of permanent impact and 0.006 acres of temporary impact. The total permanent wetland impacts are 0.024
acres and the total temporary impacts are 0.009 acres. The total permanent stream impacts are 62 LF and the total
temporary impacts are 28 LF. The proposed impact areas will include silt fences along the wetland and stream boundary
and the installation of temporary coffer dams with pump around systems to dewater the construction area. The proposed
pump around dam will not be set outside of the impact areas. The two culvert crossings will include riprap into the bed of
the wetland area to match the existing grade. The culverts will be placed 6" below the existing grade.

D. Impact Justification and Mitigation
1. Avoidance and. Minimization
1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
No avoidance possible based on the location of the jurisdictional wetland area and stream. Based on the proposed solar array
development plan, solar panels will be constructed on both the eastern and western adjacent areas of the wetland and stream.
The two culvert crossings are proposed on the central and southwestern portions of the site, creating construction and vehicle
access to the southern and northern portions of the site as well as utility lines. The proposed installation of temporary coffer
dams with pump around systems will assist with diversion and dewatering in the construction zone. The proposed wetland
impacts have been designed to limit impacts of the wetland area based on the location, grade, and topography. The first
impact is for the installation of a culvert to provide adequate construction and maintenance access between the array fields.
There is an existing crossing just south of this, however there is an existing 20' access easement for the use of others that we
cannot block or impede. As a requirement of zoning, a landscape buffer must me installed along the western border of the
project area, which must be installed outside of the existing access easement. Therefore the extension of the culvert is
needed to allow adequate access for others, to install the required landscape buffer and to provide adequate access for the
long term operation and maintenance of our project. The second impact is the installation of a culvert and electrical conduit at
the metering poles. Three utility line crossings were previously engineered but to aid in avoidance and minimization, additional
length of wire plus the combination of impact number 1, allows for just two crossings. The installation of the culvert is to allow
proper construction and maintenance access to the overhead poles, which collect all of the medium voltage output circuits that
are combined and wired directly to the interconnection with the utility. There are low voltage power lines and fiber optic
communication lines placed in these conduits, which are part of the metering equipment to measure the output of the facility.
Due -to the space constraints in this area by the large overhead transmission lines located just to the north of our poles, it is
necessary to have these poles span the JD feature to provide proper pole spacing.

Disturbance of the jurisdictional wetland and stream shall be minimized to the extent practicable in order for proper installation
of the two crossings and utility lines. The construction techniques shall be conducted in accordance with the NCDENR
standards. Temporary and additional erosion control measures shall be maintained throughout the construction process.
Control measures include installing a silt fence along the wetland boundary and a riprap apron into the bed matching the
existing grade.

Dear. Mr. Stephens:
This letter is to inform you that a list of all federally -protected endangered and threatened species
with known occurrences in North Carolina is now available on the U.S. Fish and Wildlife
Service's (Service) web page at http//www.fws:gov/raleigh. Therefore, if you have projects that
occur within the Raleigh Field Office's area of responsibility (see attached county list), you no
longer need to contact the Raleigh Field Office for a list of federally -protected species. °
Our web page contains a complete and frequently updated list of all endangered and threatened
species protected by the provisions of the Endangered Species Act of 1973, as amended (16
U.S.C. 1531 et seq.)(Act), and a list of federal species of concern' that are known to occur in
each county in North Carolina.
Section 7 of the Act requires that all federal agencies (or their designated non-federal
representative), in consultation with the Service, insure that any action federally authorized,
funded, or carried out by such agencies is not likely to jeopardize the continued existence of any
federally -listed endangered or threatened species. A biological assessment or evaluation may be
prepared to fulfill that requirement and in determining whether additional consultation with the
Service is necessary. In addition to the federally -protected species list, information on the
species' life histories and habitats and information on completing a biological assessment or
evaluation and can be found on our web page at http://www.fws.gov/raleigh. Please check the
web site often for updated information or changes.
' The term "federal species of concern" refers to those species which the Service believes might be in need of
concentrated conservation actions. Federal species of concern receive no legal protection and their designation does
not necessarily imply that the species will eventually be proposed for listing as a federally endangered or threatened
species.. However, we recommend that all practicable measures be taken to avoid or minimize adverse impacts to
federal species of concern.
If your project contains suitable habitat for any of federally -listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely -affect those species. As such, we,recommend that'surveys be conducted to determine
the species' presence or absence within the project area The -use of North Carolina Natural
Heritage program-data.should not be subWtuted.foractual field surveys:
If you determine - that the proposed action may affect (i.e., likely to adversely affect or'not`likely .
to adversely affect) a federally,protected,species, you should notify this office with your .
determination; the results"of your surveys; survey, methodologies, and an analysis of the effects
of the action on listed species, including,consideration of direct, indirect, and -cumulative effects,
before conducting any activities that might affect the species. If. you determine that the proposed
action will have no effect (i.e., no beneficial or adverse; direct or indirect effect) on federally
listed species; then you are.not required to contact our officeffor concurrence (unless an
Environmental Impact Statement ii, prepared)., However, you should maintain a complete record
-of the assessment,. including steps leading to. your determination of effect; -the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
Withregard, to. the above -referenced project, we offer the following remarks...Our comments are
submitted pursuant to, and in accordance with, provisions of the Endangered Species Act.
Based on the information provided -and other information available, .it appears that the, proposed
action is not likelyto adversely affect.any federally -listed' endangered;or threatened species, their
formally designated critical habitat; or 'species currently proposed -for listing udder the Act at -
these, sites. We believe'tt t the.. requirements of section 7(a)(2)_ -of the Act have been satisfied for
y_ourproject. -Please remember. that,obligations under. section consultation must be
reconsidered -if. (1') new information reveals impacts of this'identified action that may affect
listed species -or criticaltabitatin a manner not previously'considered;, (2) -this action is
subsequently modified in a manner that was .not considered in. this review; or, (3) a new species
is listed or critical habitat determined- that may be affected by the identified action.
However,. the Service is concerned, about the potential impacts'the proposed action might have
on aquatic species. Aquatic resources are highly susceptible to -'sedimentation. Therefore, we
recommend -that all practicable measures be taken to avoid adverse impacts to aquatic species,
including implementing directional boring methods and stringent sediment and erosion control
measures. An erosion and sedimentation control plan should be submitted to and approved by
the North Carolina Division of Land Resources, Land Quality Section prior to construction.
Erosion and sedimentation controls should be installed and maintained between the construction
site and any nearby down -gradient surface waters. In addition, we recommend maintaining
natural, vegetated buffers on all streams and creeks adjacent -to the. project site.
In general, the Service recommends that'solar facilities be sited in areas that are previously
disturbed, or sites that do not impact mature forest, wetlands, or streams. The North Carolina
Wildlife Resources Commission has developed a Guidance Memorandum (a copy can be found
