HomeMy WebLinkAbout20151268 Ver 1_Staff Comments_20160111 (1381)Comments on Mega Park project The Division approves the stormwater management plan (SMP) for the access road proposed for a portion of the project considered as Phase I. The SWP consists of vegetative filter areas, vegetated swales, rock check dams and associated conveyances, inlet and outlet structures, and the grading and drainage patterns depicted on the "Stormwater BMP Plan —Access Road" drawing of 11/17/2015. The SWP also includes the additional drawings, engineering calculations and information also dated 11/17/2015 and received by the Division on December 08, 2015. All of these elements related to the stormwater plan for Phase I are incorporated by reference and are enforceable by the Division. In addition to these requirements, the following conditions also apply in order to meet the 401 Certification specifications set for in 15A NCAC 02H .0506(b)(5): 1. The maximum allowable impervious area for the approved Phase I road shall be 33,026 square feet. Any changes to maximum road area for Phase I shall require the applicant to submit and receive approval for a revised stormwater management plan by the Division. 2. The footprint of all stormwater management devices as well as an additional 10 -foot wide area on all sides of the devices shall be located in either: public rights-of-way; dedicated common areas; or recorded easement areas. The final plats for the project showing all such rights-of- way, common areas and easement areas shall be in accordance with the approved plans. The stormwater practices of the approved SMP shall be constructed and operational before any permanent paving is applied or any other structure is occupied at the site. 4. The SMP may not be modified without prior written authorization from the Division. 5. Maintenance activities for the stormwater practices shall be the responsibility of the owner until the road is transferred to the Department of Transportation. 6. The applicant and/or authorized agent shall provide a completed Certificate of Completion form to the Division within thirty (30) days of project completion (available at http://porta I. ncden r.org/web/wq/swp/ws/401/certsa nd perm its/apply/forms). A final, written stormwater management plan for each future phase of the project shall be submitted to the DWR 401 & Buffer Permitting Branch (1617 Mail Service Center, Raleigh, NC 27699-1617). The SMP shall be designed to treat the runoff from the entire built -upon area in each phase in accordance with the version of the 401 Stormwater Requirements and BMP Manual in effect at the time of the submittal. Each SMP shall be approved by the Division before any land disturbance associated with that phase may occur. In addition, before any permanent building is erected, the corresponding stormwater management devices shall be constructed and operational in order to meet the water quality protection requirements of 15A NCAC 02H .0506(b)(5).
