Good afternoon John and Jason, This correspondence is in reference to the monitoring report and credit release request submitted for the Wildlands Middle Cape Fear Umbrella Mitigation Bank, Daniels Creek Site, Action ID SAW-2017-00998. The purpose of this letter is to transmit comments provided by the NC Interagency Review Team (NCIRT) during the review of the monitoring report and to confirm the annual credit release. The review of the annual monitoring report followed procedures outlined in Section 332.8(o)(9) of the Mitigation Rule. The comments listed below were provided by the NCIRT during this process. While it is not necessary to provide a response to specific comments at this time, please be sure to address the issues raised in future monitoring report submittals. Emily Dunnigan, USACE 1. I appreciate the addition of wetland gauges in wetlands that are failing to meet success criteria. Please keep in mind that new gauges are to support existing gauges, and more gauges may need to be installed to further delineate any problem areas. 2. Please add an additional wetland gauge to the northeastern/left bank side of Daniels Creek R1/Daniels Creek R2. Please consider adding additional gauges in larger wetlands that are not meeting success. 3. Please include soils, veg, hydrology, and any other pertinent data for any new wetlands to be proposed for additional credit in MY4. 4. Please include callouts or labels to any new gauges on the CCPVs in the future, they are difficult to find. Based on our review of the monitoring report and the results of the NCIRT review, we confirm that you have satisfied requirements included in the approved banking instrument and mitigation plan for the stream Milestone 5 (Year 3 Monitoring) credit release. Accordingly, with this correspondence we confirm the release of stream credits as shown on the table below and on the attached credit release schedule. The District ledger on the Regulatory In-lieu Fee and Bank Information Tracking System has also been updated to reflect this transaction. However, due to concerns regarding the wetland hydrology performance, the pending 15% wetland credit release is being withheld from this annual release. It is also our understanding that you are evaluating other areas on site to determine if there are additional areas where you may be able to request wetland credit. Please note that the addition of wetland credit areas to the approved plan must be evaluated as a modification to the mitigation plan and processed according. Such a request should include appropriate justification and a proposal for additional monitoring that may extend the monitoring timeframe of the project, and credit generation would be based on pre-existing site soil conditions (e.g., requests to claim wetland credit within areas that were not formerly hydric soils would be treated as creation). We are available to conduct a site visit later this year to evaluate the wetlands on site and discuss any potential modifications.
