Arrington Bridge Phase II Credit Release — Task 6 (PARTIAL)
Dear Mr. Ingram:
On October 15, 2015, the Division of Water Resources (DWR) received a Year 3 Monitoring
Report for the subject site from McAdams Company on behalf of EBX Neuse 1, LLC (EBX).
On November 3, 2015, Katie Merritt, with DWR, sent comments and recommendations to Brian
Hockett with EBX regarding her review of site conditions according to the report. A few issues
were noted that needed to be addressed. A total of fifty percent (50%) of the vegetation plots
were failing to meet success criteria by five stems. These same plots also failed to meet success
criteria last year. In addition, approximately 0.81 acres of the 13.97 acres within the restoration
area had been mowed and disked with damage noted to the conservation easement boundary
markers and photo station markers.
As a result of Ms. Merritt's review of the report and site conditions, she requested the followine
be submitted to DWR prior to a credit release:
A supplemental planting plan for the entire site (including the areas that were mowed)
which shall include 1) a proposed deadline to complete the replanting, 2) a commitment
to flag all stems that will be planted, 3) a commitment to provide post -planting pictures of
the replanted areas, 4) stem count data for Plots 1 and 4 post planting
A written course of action for remediating the encroachment problems on the site with a
proposed deadline for completion
On November 20, 2015, Ms. Merritt received all of the information requested above from Mr.
Hockett. Once the DWR has been properly notified that the remediation/replanting has been
completed, DWR will issue the remaining five percent (5%) of this credit release.

According to the UMBI signed on November 10, 2008, the following Project Milestone has been
partially met, and the corresponding credits shall be released:

By copy of this correspondence DWR confirms that you have partially satisfied the above
Task/Milestones for the above -referenced tract and 5% of your Neuse riparian buffer credits
(0.05 x 194,267 ft' = 9,713.35 ft') and 5% of your nitrogen nutrient offset credits (0.05 x
17,702.28 lb -N = 885.11 lb -N) are now available for sale. Please update your credit ledgers
accordingly.
Please note that nutrient offset credits generated at this site must be used for impacts in
HUC 03020201 of the Neuse River Basin excluding the Falls Watershed. Additionally, the
riparian buffer credits must be used for impacts in the Neuse River Basin according to
guidelines in the Consolidated Buffer Mitigation Rule, 15A NCAC 02B.0295, which
became effective as of November 1, 2015.
