Please see below for our responses to the queries raised in your request for additional information. ■ Items A, B & D — Direct Distribution of Class A Residuals and Required Monitoring and Testing: As described in the Sludge Permit application package, the exception quality residuals generated at the Cargill facility's wastewater pre-treatment plant are not directly distributed or directly marketed to non -permitted facilities or to individuals or organizations that directl land apply the residuals as an end product. Cargill also does not directly land apply its residuals to its property. The Cargill residuals are transported to Wallace Farms in Huntersville NC, which is an active permitted composting facility. The Cargill residuals are not marked with labels or supplied in bags/containers with Cargills logo (which would indicate that the residuals are being marketed), but rather Cargill Inc Page 1 of 3 2023 Sludge Permit Renewal Application April 2024 Additional Information Request #1 transported via a roll off container. Wallace Farms processes the residuals supplied by Cargill along with residuals from other entities for further distribution. The usage of Cargills residuals in Wallace Farms processing is at the discretion of Wal_la(g Farms which is a permitted entity. Cargill has no control over the method of processing of its residuals used at Wallace Farms. Therefore, the requirements for testing and monitoring of the Cargill residuals are not warranted. This conclusion was also determined by NCDEQ during the Sludge Renewal permit process during the 2013 permit cycle. A copy of this NCDEQ correspondence is attached to this letter as Attachment 1. • Item C — Delegation of Authority and Revised Signatures: As requested, please find in Attachment 2, an updated application form for DCAR 06-16 signed by the Cargill Inc Charlotte NC Facility Leader. In addition, Attachment 3 has the required delegation of signatory authority given to Mr. Brandon Pretzch by the Cargill Vice -President in accordance with 15A NCAC 02T.0106(b). At this time, we are requesting that Cargill, Inc. Sludge Residual Permit be renewed as is (i.e. without any sampling or monitoring requirements) since Cargill does not sell residuals for direct application to land or land apply its residuals, but rather transports it to a composting facility for further processing. We would also like the option of keeping the Sludge Permit as opposed to rescinding the Permit to afford us the flexibility of managing our wastewater pre-treatment sludge in case there are changes in future operations. All of the residuals are dewatered on -site and then sent to a (permitted) composting facility for processing. If this understanding is correct, and pursuant to our conversation this morning, there are two options that Cargill has regarding the existing permit. The first option is to renew the permit without the monitoring or sampling requirements which it presently contains. One reason you might want to pursue this option is if you are planning to (soon) do any kind of "direct" processing and application to your own property or others' properties. The second option is to rescind the permit, since the action of creating the residuals, in and of itself, does not require a permit from our agency (the North Carolina Division of Water Quality). However, the party which is receiving the residuals from you is required to have your facility listed as a "source" (this is technically their responsibility). The only wastewaters received by the WWTP originates from the edible oil production processes/contaminated stormwater. No sanitary wastewaters are received by the Cargill WWTP. A portion of the clarifier return sludge is dewatered on a belt filter press and the dewatered residuals are stored in a 30 cubic yard roll —off container. These dewatered residuals are transported to a compositing facility with an active permit or corporation that specializes in horticultural development. The Cargill, Inc. facility generates the residuals, but the only on -site processing is conditioning and dewatering of these residuals on a belt filter press. The residuals are then transported to a residuals processing facility As has been historically granted, we are requesting that Cargill, Inc. not be required to comply with NCAC 2T criteria (monitoring, vector attraction or pathogen reduction), since Cargill, Inc. is primarily the generator of the residuals, and these residuals are processed in a subsequent permitted facility (Wallace Farms in Huntersville NC). How the final product will be distributed (packaging, bulk, etc.) ❑'', What nutrients or other constituents (i.e. nitrogen, phosphorous, aluminum, calcium, etc.) are used or recommended as the limiting parameter for determination of residuals loading rate to ensure that it does not overload the soil and cause contravention of surface water or groundwater standards, limit crop growth, or adversely impact soil quality. ❑ Attach a marketability statement detailing destinations and approximate amounts of the final product to be distributed. ❑ Provide either a label that shall be affixed to the bagged processed residual or an information sheet that shall be provided to the person who receives the processed residual. The label or information sheet shall contain, at a minimum, the following information: Name and address of the person who prepared the residual that is sold or given away. ❑ A statement that application of the residuals to the land shall be in accordance with the instructions on the label or information sheet. ❑ A statement that the residuals shall not be applied to any site that is flooded, frozen or snow-covered. ❑ A statement that adequate procedures shall be provided to prevent surface runoff from carrying any disposed or stored residuals into any surface waters. ❑ Information on all applicable setbacks in accordance with 15A NCAC 02T .1108(b). A statement that the residuals shall be applied at agronomic or recommended rates for intended uses. E. Detailed Plans and Specifications (Application Involving New or Changes to Treatment or Storage Units) JJ Submit detailed plans and specifications that have been signed, sealed, and dated by a NC Professional Engineer per 15A NCAC 02T .1104(a). Specifications for standard equipment may only be omitted for municipalities with approved standard specifications, but use of the standard specifications must be noted on each sheet of the plans. ❑ Plans must include the following minimum items: a general location map, a topographic map, plan and profile view of the residuals treatment and storage units as well as the proximity of the residuals treatment and storage units to other utilities and natural features within 500 feet of all treatment and storage facilities, and detail drawings of all items pertinent to the residuals treatment and storage units. Depict minimum separations required in 15A NCAC 02T .1108(a) on the plans. ❑'' Specifications must include, at a minimum, the following for all items pertinent to residuals treatment and storage units: description of materials to be used, methods of construction, quality of construction testing procedures to ensure the integrity of the final product in accordance with 15A NCAC 02T .I 104(a)(2)(B), including leakage and pressure testing as appropriate. ❑ Plans and specifications must not be labeled with preliminary phrases (e.g., FOR REVIEW ONLY, NOT FOR CONSTRUCTION, etc.) that indicate that they are anything other than final plans and specifications. Engineering Calculations (Application Involving New or Changes to Treatment or Storage Units) Submit all design calculations that have been signed, sealed, and dated by a NC Professional Engineer per 15A NCAC 02T .1 104a . G. Environmental Assessments (Maybe Required —See 15A NCAC 1C.0300) Submit a copy of the Findings of No Significant Impact (FONSI) or Environmental hmpact Statement (EIS). Also, include information on any mitigating factor(s) from the Environmental Assessment (EA) that impact the construction of the residuals treatment and storage facilities. Maintenance schedules; may include equipments calibration, maintenance of signs, etc. ❑ Safety measures; may include safety training program, manuals, signs, etc. ❑; Spill response plan; including control, containment, remediation, emergency contact information, etc. ❑ Inspection plan including the following information; ❑ Names and titles of personnel responsible for conducting the inspections. ❑ Frequency and location of inspections, including those to be conducted by the ORC, and procedures to assure that the selected location(s) and inspection frequency are representative of the residuals management program. ❑ Detailed description of inspection procedures including record keeping and actions to be taken by the inspector in the event that noncompliance is observed. ❑ Sampling and monitoring plan including the following information; ❑ Names and titles of personnel responsible for conducting the sampling and monitoring. ❑ Detailed description of monitoring procedures including parameters to be monitored. ❑ Sampling frequency and procedures to assure that representative samples are being collected. Fluctuation in temperature, flow, and other operating conditions can affect the quality of the residuals gathered during a particular sampling event. The sampling plan shall account for any foreseen fluctuations in residuals quality and indicate the most limiting times for residuals to meet pathogen and vector attraction reduction requirements (e.g. facilities that land apply multiple times per year but have an annual sampling frequency, may need to sample during winter months when pathogen reduction is most likely to be negatively affected by cold temperatures. The effluent from this pre- treatment plant is discharged to the Charlotte Water (CW) municipal/sanitary sewer system. Waste sludge (biological residuals) from the biological treatment unit is periodically sent to a sludge conditioning tank where polymer is added to condition the sludge prior to dewatering the residuals in the belt filter press. Please note that the Permittee is prohibited from directly distributing Class A residuals for marketing and land application. Accordingly, the requirements for testing and monitoring the residuals have been removed from the permit. If the Permittee wants to distribute the residuals to individuals or organizations who would apply them or to market the residuals to non-rlermitted facilities, the permit will have to be modified to reauire_testing and monitorinL, ofthe residuals for a number of parameters and characteristics in accordance with regulations. This permit shall be effective from March 1, 2019 through May 31, 2024, shall void Pertnit No. WQ0017321 issued July 25, 2013, and shall be subjeetto the conditions and limitations as specified therein. The Permittee shall submit a renewal application no later than December 3, 2023. Please pay particular attention to the monitoring requirements listed in Attachment A for they may differ from the previous permit issuance. Failure to establish an adequate system for collecting and maintaining the required information shall result in future compliance problems. Please note that on September 1, 2018, North Carolina Administrative Code Title 15A Subchapter 02T — Waste not Discharged to Surface Waters was readopted. Accordingly, this permit incorporates the requirements of these rules, therefore, please take the time to review this permit thoroughly. The disposal of residuals is regulated under Title 40 Code of Federal Regulations Part 257. This permit does not exempt the Permittee from complying with Federal Regulation 40 CFR Part 257. This permit shall be effective from March 1, 2019 through ylay 31, 2024, shall void Permit No. WQ0017321 issued July 25, 2013, and shall be subject to the following conditions and limitations: I. SCHEDULES 1. The Permittee is expressly prohibited from directly distributing Class A residuals for marketing and land application. The Permittee shall submit a permit application and receive a Division -approved modified permit prior to directly distributing Class A residuals. The permit modification shall be sent to the Division of Water Resources, Non -Discharge Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617, or Non-17ischar .Rel-iort ri ncdenr.eis,v. PERFQRVIANCE STANDARDS 1. The Permittee shall maintain the subject residuals management program so there is no discharge to surface waters, nor any contravention of groundwater or surface water standards. In the event the residuals management program fails to perform satisfactorily, including the creation of nuisance conditions due to improper maintenance, the Permittee shall immediately cease distributing residuals, take immediate corrective actions, and contact the Mooresville Regional Office supervisor. [15A NCAC 02T .0108(b)(1)(A)] 2. This permit shall not relieve the Permittee of their responsibility for damages to groundwater or surface water resulting from this residuals management program. The Permittee shall maintain the residuals management program as a non -discharge system. [15A NCAC 02T .1100] 2. The Permittee shall maintain a Division -approved Operation and Maintenance Plan that shall include: a. Description of the program, and associated facilities and equipment, in sufficient detail to show what operations are necessary for the program to function and by whom the functions are to be conducted; b. Description of anticipated maintenance of facilities and equipment associated with the program; c. Include provisions for safety measures, including restriction of access to sites and equipment; d. Spill control provisions: i. Response to upsets and bypasses including control, containment, and remediation; and ii. Contact information for plant personnel, emergency responders, and regulatory agencies; e. Detailed inspection procedures: i. Names or titles of personnel responsible for conducting inspections; ii. Frequency and location of inspections, and procedures to assure that the selected locations and inspection frequency are representative of the residuals management program; and iii. Description of record keeping and actions to be taken by the inspector in the event that noncompliaiitce is observed; f Detailed sampling and monitoring procedures: i. Names or titles of personnel responsible for conducting sampling and monitoring; ii. Description of monitoring procedures including parameters to be monitored; and iii. Sampling frequency and procedures to assure that representative samples are collected. Fluctuation in temperature, flow, and other operating conditions can affect the quality of the residuals gathered during a particular sampling event. The sampling plan shall account for any foreseen fluctuations in residuals quality and indicate the most limiting times for residuals to meet pathogen and vector attraction reduction requirements. [15A NCAC 02T .l 110(a)] 3. Upon the Water Pollution Control System Operators Certification Commission's (WPCSOCC) classification of the residuals management program, the Permittee shall designate and employ a certified operator in responsible charge (ORC), and one or more certified operators as back-up ORCs. The ORC or their back-up shall visit the facilities in accordance with 15A NCAC 08G 0204 and shall comply with all other requirement in 15A NCAC 08G 0204. [15A NCAC 02T .ill 17, 08G .0204] 4. Adequate measures shall be taken to prevent runoff of the untreated residual leachate or stored residuals onto adjacent properties or into surface waters. The finished product may be placed on a concrete pad, placed under shelter or physically covered until it is turned over to the composting facility. If an alternate storage site is used, approval must be obtained from the Division. [15A NCAC 02T .0108(b)(1)(A)] 5. Class A residuals shall not be stored in a manner that causes nuisance conditions. M:ON TORING AND REPORTING REQUIREMENTS 1. The Permittee shall conduct and report any Division required monitoring necessary to evaluate this program's impact on groundwater and surface water. [I 5A NCAC 02T .0108(c)] 2. Noncompliance Notification The Permittee shall report to the Mooresville Regional Office, telephone number (704) 663-1699, within 24 hours of first knowledge of the: a. Any process unit failure (e.g., mechanical, electrical, etc.) rendering the facility incapable of adequate residual treatment. b. Any failure resulting in a discharge to surface waters. a. Any time self -monitoring indicates the program has gone out of compliance with its permit limitations. d. Distribution of residuals abnormal in quantity or characteristic. e. Any discharge from a vehicle or piping system transporting residuals. Emergencies requiring reporting outside normal business hours shall call the Division's Emergency Response personnel at telephone number (800) 662-7956, (800) 858-0368, or (919) 733-3300. All noncompliance notifications shall file a written report to the Mooresville Regional Office within five days of first knowledge of the occurrence, and this report shall outline the actions proposed or taken to ensure the problem does not recur. [15A NCAC 02T .0108(b)(1)(A)] V. INSPECTIONS 1. The Permittee shall perform inspections and maintenance to ensure proper operation of the storage facilities. [15A NCAC 02T .1110(f)] 2. The Permittee shall inspect the residuals storage, and transport facilities to prevent malfunctions, facility deterioration, and operator errors that may result in discharges of wastes to the environment, threats to human health, or public nuisances. The Permittee shall maintain an inspection log that includes the date and time of inspection, observations made, and maintenance, repairs, or corrective actions taken. The Permittee shall maintain this inspection log for a period of five years from the date of inspection, and this log shall be made available to the Division upon request. Division authorized representatives may, upon presentation of credentials, enter and inspect any property, premises, or place related to the distribution sites or facilities permitted herein at any reasonable time for determining compliance with this permit. Division authorized representatives may inspect or copy records maintained under the terms and conditions of this permit, and may collect groundwater, surface water, or leachate samples. Failure to comply with the conditions and limitations contained herein may subject the Permittee to a Division enforcement action. [G.S. 143-215.6A, 143-215.6B, 143-215.6C] 2. This permit is effective only with respect to the nature and volume of wastes described in the permit application, and Division -approved plans and specifications. [G.S. 143-215.1(d)] 3. Unless specifically requested and approved in this perrnit, there are no variances to administrative codes or general statutes governing the construction or operation of the facilities permitted herein. [15A NCAC 02T .0105(n)] 4. The issuance of this permit does not exempt the Permittee from complying with all statutes, rules, regulations, or ordinances that other jurisdictional government agencies (e.g., local, state, and federal) may require. [15A NCAC 023` .0105(c)(6)] 5. if the permitted residuals program change ownership, or the Permittee changes their name, the Permittee shall submit a permit modification request on Division -approved forms. The Permittee shall comply with all terms and conditions of this permit until the permit is transferred to the successor - owner. [G.S. 143-215.1(d3)] 6. Yhis permit is subject to revocation or modification upon 60-day notice from the Dik ision Director, in whole or part for: a. violation of any terms or conditions of this permit or Administrative Code "Title 15A Subchapter 02T; b. obtaining a permit by misrepresentation or failure to disclose all relevant facts; c. the Permittee's refusal to allow authorized Department employees upon presentation of credentials: i. to enter the Permittee's premises where a system is located or where any records are required to be Dept; ii. to have access to any permit required documents and records; iii. to inspect any monitoring equipment or method as required in this permit; or iv. to sample any pollutants; d. the Permittee's failure to pay the annual fee for administering and compliance monitoring; or e. a Division determination that the conditions of this permit are in conflict with North Carolina Administrative Code or General Statutes. Unless the Division Director grants a variance, expansion of the facilities permitted herein shall not occur if any of the following apply: a. The Perntittee or any parent, subsidiary, or other affiliate of the Permittee has been convicted of environmental crimes under G.S. 143-215.613, or under Federal law that would otherwise be prosecuted under G.S. 143-215.613, and all appeals of this conviction have been abandoned or exhausted. b. The Permittee or any parent, subsidiary, or other affiliate of the Pennittee has previously abandoned a wastewater treatment facility without properly closing the facility. c. The Permittee or any parent, subsidiary, or other affiliate of the Permittee has not paid a civil penalty, and all appeals of this penatt3 have been abandoned or exhausted. d. The Permittee or any parent, subsidiary, or other affiliate of the Permittee is currently not compliant with any compliance schedule in a permit, settlement agreement, or order. e. The Permittee or any parent, subsidiary, or other affiliate of the Pennittee has not paid an annual fee. [15A NCAC 02T .0120(b), 02T .0120(d)] 8.
