Dear Brad,
This correspondence is being submitted in response to your email dated 8 December 2015, regarding the Preconstruction
Notification submitted for activities within Oyster Landing Subdivision which is located in Sneads Ferry, between Hwy 172
and Old Folkstone Road. In order to all the USACE to continue process the PCN, SEGi is submitting the following
responses:
1. Agent Authorization is missing from the package.
The Agent Authorization has been attached to this correspondence (see Attachment 1).
2. As this is a continuation of a formerly permitted subdivision, the map needs to clearly indicate the entire
property line of the Applicant. Please provide a plat showing the property lines of the Applicant, and please
omit any privately owned property (i. e Admiral Court and Blue Pennant Ct.).
The map has been revised to clearly depict the entire property line of the Applicant, and private properties have
been excluded (see Attachment 2).
3. Please clearly label all phases you are currently seeking. The current plan shows another spur across the
access from Phase III but it is not labeled as a phase. Along this line please provide the complete development
plan you are seeking with logical termini. The Corps expects that the preliminary approved subdivision plan
from the County may be a starting point. A plan that includes future dead end roads aimed toward aquatic
resources does not constitute a complete plan.
The following is taken from the nationwide general conditions: 'A description of the proposed project; the
project's purpose; direct and indirect adverse environmental effects the project would cause, including the
anticipated amount of loss of water of the United States expected to result from the NWP activity, in acres,
linear feet, or other appropriate unit of measure; any other NWP(s), regional general permit(s), or individual
permit(s) used or intended to be used to authorize any part of the proposed project or any related activity. The
description should be sufficiently detailed to allow the district engineer to determine that the adverse effects of
the project will be minimal and to determine the need for compensatory mitigation. Sketches should be provided
when necessary to show that the activity complies with the terms of the NWP. (Sketches usually clarify the
project and when provided results in a quicker decision. Sketches should contain sufficient detail to provide an
illustrative description of the proposed activity (e.g., a conceptual plan), but do not need to be detailed
engineering plans); "
The pian has been revised to clearly label all phases currently being considered under this Nationwide Permit
request and "roads to nowhere" have been terminated into cul-de-sacs (see Attachment 2).
4. According to the Jurisdictional Determination (JD) approved by this office in August of 2011 there are
additional jurisdictional resources in Phase II which are not shown on the current plan sets. Based on the old
JD, there is a wetland in the middle of the proposed Phase II stormwater pond. Additionally, it appears the
front slope of the same stormwater pond would impact resources on Lot 92. This is difficult to see as this is a
400' scale. The Corps asks for a smaller scale when activities border wetlands so that all secondary and
cumulative impacts may be considered.
It was SEGi's intention to discuss this wetland pocket, identified as #7 on the attached Existing Soil Road
Aerial with Wetland Overlay Map (Attachment 5), during the site visit. However, the site visit had not taken
place prior to the submittal of the PCN. It is of SEGi's opinion that the feature does not meet wetland criteria.
With that being said, SEGi is requesting a site visit to evaluate the feature and have the USACE make a final
determination on jurisdiction of the wetland.
The stormwater pond has been redesigned to not encroach into the adjacent wetland (see Attachment 2). A
zoom shot of the area has been incorporated into the plan. A hard copy of this correspondence and the
accompanying attachments, with "to scale" copies of the plans will be submitted to your office.
5. Concerning the stormwater pond and its orientation to the wetland features, it's unclear as to whether or not
wetland drainage would occur from its construction. What is the discharge elevation of the stormwater pond
relative to the elevation of the wetland?
A clay liner has been incorporated into design of the retention pond (see Attachment 2). This measure should
ensure that the stormwater pond will not drain the adjacent wetland.
In addition to those concerns listed within the RFAI, SEGi would also like to address concerns discussed in a phone
conversation with yourself and Ms. Joanne Steinhuis (copied on this correspondence), which were raised as a result of a site
visit that took place on 16 December 2015. The concern was regarding mechanized clearing that may have taken place
within wetlands. To determine if mowing took place within wetlands, and if so the extent of mowing within wetlands, the
wetland boundary was staked in several locations (see attached map — Attachment 3). SEGi then evaluated the areas of
concern (see Attachment 4) It is of SEGi's opinion the work was undertaken in a manner that did not alter the area(s) in
such a way that it would no longer be a water of the United States (i.e. the activity had inconsequential effect on the area
and has not caused an identifiable individual or cumulative adverse effect). To alleviate future concerns, SEGi has urged the
Applicant to refrain from mowing/mechanized clearing within jurisdictional wetlands, until such time a permit has been
secured to do so or consultation with the USACE has taken place.
On another note, with the staking of the wetland boundary line, concern over the fill of wetlands was discovered in the area
of the existing soil road. SEGi is not convinced that fill has occurred and are placing reservation on this determination
based on questions surrounding the preparation of the original survey data, which may have caused the wetland line to
"float" somewhat. What we do know is that the wetland line was determined to be up against the existing soil road, which
has been there for many years (see Attachment 5). Some improvements to the road took place, but according to the
contractor, the work was limited to the footprint of the existing soil road. SEGi is requesting time to work with the surveyor
and confirm the accuracy of the survey staking. Should it be determined that the fill of wetlands has taken place, restoration
efforts, in the form of removing the fill and returning the area(s) to the original grade and contour, will be performed.
