The responses are in red below. Additionally, while making the requested revisions, the engineer identified a
0.011-acre area of additional wetland impact. Instead of providing you with revised sheets and attachments to
the application, I revised the application and included the revised impact exhibits and a revised SOA from the
private mitigation bank. The revised application is attached.
Please let me know if you need additional information in order to process the NWP and WQC. Have a good

Reference is made to USACE Action ID SAW-2020-01330
This email is in reference to the Pre -Construction Notification (PCN) for the proposed Evolve at Mebane Oaks Residential
Mixed -use w/Commercial Development project received on 3/13/24.
The following information is required to complete our evaluation and confirm compliance with one or more General or
Regional Conditions to verify use of the Nationwide Permit (NWP):
Although your PCN indicates you are requesting authorization under NWP-29, that permit does not
authorize mixed -used residential developments with commercial/retail structures. Your project could be
authorized under NWP-39, attached, please review and respond to the update. We concur that the
proposed project can be authorized under NWP-39. Please use it instead.
It appears there is a discrepancy in the PCN/plans regarding your proposed stream crossing — see below
snips from sheet C3 — notes state "Arch culvert" and "Arch pipe culvert" but profile view indicates a regular
cylinder culvert. These are very different structures and methodologies with different direct and indirect
impacts. I can't complete my review until I have your updated proposed road crossing/culvert and revised
impact construction drawings with detailed plan and profile views of installation of the culvert and
crossing. The revised plans are included in the revised application that is attached.
