Tar, Jr., and Teresa Ann Faison Hale (property owners) and Ellis Land Investment Company, LLC (applicant), please find attached a complete application and supplemental information requesting written concurrence from the US Army Corps of Engineers (USACE) that the activities associated with the proposed development of the McKinley Place subdivision (Project) may proceed under Nationwide Permits (NWPs) 14 & 29 and General Certifications 4246 & 4256 (GC 4246 & 4256). Project Purpose and Location The Project includes the construction of a residential subdivision. The +/-100.43-acre tract is located south of existing Widewaters Parkway and west of existing Southampton Drive in Knightdale, Wake County. The coordinates of 35.7517°N, 78.4348°W generally correspond to the center of the Site. Project Detail The proposed Project consists of the construction of a residential development with associated utilities and roads. The subdivision's sewer and water needs will be served by existing utilities managed by the Town of Knightdale. Access to the Site is provided by a road connection to existing Widewaters Parkway to the north and Southampton Drive to the east. Heavy equipment typically used for utility installation projects (e.g., backhoes, bulldozers, etc.) will be utilized. No federally threatened or endangered species are listed to occur on the Site according to the NC Natural Heritage Program (NCNHP) Database, (see attached report dated April 19, 2024); however, there is an element occurrence of Rhus michauxii (Michaux's Sumac) within one mile of the subject site (the known reference population on Barwell Road). Per the US Fish & Wildlife Service (USFWS) IPaC resource list, Necturus lewisi (Neuse River Waterdog), Noturus furiosus (Carolina Madtom), Fusconaia masoni (Atlantic Pigtoe), Alasmidonta heterodon (Dwarf Wedgemussel), and Rhus michauxii (Michaux's Sumac) may be the near the proposed project area. The Site is not listed as a historic property or within a historic district. No historic structures were found on the Site. There are two historic districts and two national register listings (one is gone) within a mile of the Site. Multiple surveyed properties are also within a mile of the Site. Project History The Site is comprised of six adjacent parcels. The Site is bounded to the south by a railroad. The Mingo Creek Greenway, sanitary sewer line, and a 100-ft overhead transmission easement runs east -west near the northern Site boundary. Mingo Creek and its floodplain are also located within the northern portion of the Site and mostly parallels the greenway. A large pond is present in the southeastern corner of the Site. Historical aerials depict a large agricultural area in the southcentral portion of the Site west of the pond and another large agricultural area northeast of the pond along the eastern boundary. Neither area is currently in agriculture, and both contain early successional forests with dense stands of pine. Evidence of old roads traverse the southern half of the Site. The remainder of the forested portions of the Site are hardwood dominated forests with interspersed pines. Fourteen jurisdictional streams, one jurisdictional pond, and eleven jurisdictional wetlands are located on the Site. Surrounding land use is a mix of undisturbed forested areas and residential developments. Creekview Crossing Subdivision Page 1 of 3 Avoidance and Minimization Fourteen jurisdictional streams, one jurisdictional pond, and eleven jurisdictional wetlands are located on the Site. Impacts to jurisdictional Waters of the US will result from three proposed road crossings to reach upland portions of the Site for development and to make the necessary connections to existing roadway infrastructure as required by the municipality. Additionally, a bridge crossing of Mingo Creek is proposed to connect to the existing Widewaters Parkway. Streams are not crossed multiple times. Lots were positioned to avoid additional fill and/or impact to streams and wetlands. Retaining walls are proposed to further minimize fill impacts associated with roadway infrastructure and lot grading. Stormwater devices were designed to avoid impacts to jurisdictional areas. Of the 24.72 acres of wetland the Site, only 0.345 acres of permanent impact are proposed. There are 11,303 linear feet of stream on the Site, and only 230 linear feet of permanent -loss of function stream impacts are proposed. Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts. Silt fencing will be installed to provide additional protection from stormwater runoff. Protect Impacts Impact A is a permanent road crossing and will result in 80 linear feet (0.0169 ac) of permanent stream impact, 10 linear feet (0.0013 ac) of permanent impact -no permanent loss for a countersunk riprap dissipator pad, and 37 linear feet (0.0059 ac) of temporary impact to accommodate impervious dikes for the temporary bypass pumping operation during culvert construction. Impact A also proposes 0.078 acre of permanent wetland impact (culvert and riprap dissipator pad) for the proposed road crossing and 0.013 acre of temporary impact also associated with the bypass pumping operation for culvert installation. Just upstream of this proposed road crossing there will also be 30 linear feet (0.0143 ac) of temporary stream impact necessary to install and connect the proposed sewer to an existing sewer manhole. Impact A also proposes 5,592 square feet of permanent Zone 1 buffer impact and 4,818 square of permanent Zone 2 impact for the road crossing, 18 square feet of permanent Zone 1 impact for the countersunk riprap dissipator pad, 765 square feet of temporary Zone 1 buffer impact necessary for the bypass pumping operation, 3,395 square feet of temporary Zone 1 impact and 2,254 square feet of temporary Zone 2 impact for the sewer line installation and connection, and 23 square feet of permanent Zone 1 impact and 485 square feet of permanent Zone 2 impact associated with the outfall of SCM #5. Impact B is a permanent road crossing and will result in 70 linear feet (0.0067 ac) of permanent stream impact, 12 linear feet (0.0008 ac) of permanent impact -no permanent loss for a countersunk riprap dissipator pad, and 29 linear feet (0.0024 ac) of temporary impact to accommodate impervious dikes for the temporary bypass pumping operation during culvert construction. Impact B also proposes 0.211 acre of permanent wetland impact for the proposed road crossing (culvert and riprap dissipator pad) and 0.022 acre of temporary impact also associated with the bypass pumping operation for culvert installation. There will be 4,274 square feet of permanent Zone 1 buffer impact and 2,989 square feet of permanent Zone 2 buffer impact for the proposed road crossing, an additional 74 square feet of permanent Zone 1 impact associated with the countersunk riprap dissipator pad and 944 square feet of temporary Zone 1 impact for the concurrent dewatering activities associated with the culvert installation. Impact C consists of 4,234 square feet of grading into Zone 2 of the buffer on the pond to accommodate SCM #3. The area will be revegetated and Zone 1 of the buffer will not be compromised. Impact D consists of 861 square feet of grading into Zone 2 of the buffer on stream SH to accommodate the fill slopes of the roadway which is required to connect to existing roadway infrastructure off site. The slope will be revegetated and Zone 1 of the buffer will not be compromised. Impact E is a permanent road crossing and will result in 80 linear feet (0.0117 ac) of permanent stream impact, 24 linear feet (0.0039 ac) of permanent impact -no permanent loss for a countersunk riprap dissipator pad, and 28 linear feet (0.0042 ac) of temporary impact to accommodate impervious dikes for the temporary bypass pumping operation during culvert construction. Impact E also proposes 0.003 acre of permanent wetland impact for the proposed road crossing (culvert and riprap dissipator pad) and 0.009 acre of temporary wetland impact associated with the bypass pumping operation during culvert installation. There will be 4,858 square feet of permanent Zone 1 buffer impact and 3,042 square feet of permanent Zone 2 buffer impact for the proposed road crossing, an additional 117 square feet of permanent Zone 1 impact associated with the countersunk riprap dissipator pad and 1,055 square feet of temporary Zone 1 buffer impact for the concurrent dewatering activities associated with the culvert installation. Impact F proposes 288 square feet of grading into Zone 1 of the buffer on stream SG to accommodate SCM #1. The area will be revegetated and Zone 1 of the buffer will not be compromised. Impact G is the proposed bridge crossing over Mingo Creek. There will be 7 linear feet (0.0012 ac) of permanent stream impact associated with needed bank stabilization due to the proximity of the interior bents to Mingo Creek. The roadway approaches to the bridge result in 0.034 acre of permanent wetland fill, which is also within the FEMA 100-year floodplain and the reason we are requesting the use of a Nationwide Permit 14 for this crossing. The bridge bents under the bridge will result in a combined total of 0.010 acre of permanent fill within the wetland. There is an existing greenway north of the proposed bridge which will be required to be realigned to accommodate the crossing; this results in an additional 0.001 acre of wetland fill. An additional Creekview Crossing Subdivision Page 2 of 3 0.2896 acres of hand clearing in wetlands is proposed for the bridge construction. Historically, hand clearing impacts are not considered a permanent or a temporary impact as there is no stumping or grubbing of vegetation proposed and no soil inversion. Access for clearing machinery will be provided using crane mats or some other similar type of weight dispersing method. Permanent buffer impacts for the roadway approaches to the bridge include 177 square feet in Zone 1 and 1,682 square feet in Zone 2. Under the bridge itself, in the location of the permanent piers, there will be 399 square feet of permanent Zone 1 impact and 124 square feet of permanent Zone 2 impact. There is an additional 1,048 square feet of permanent Zone 1 buffer impact and 788 square feet of Zone 2 buffer impact needed for the greenway realignment. And the bridge will result in 6,610 square feet of temporary Zone 1 buffer impact and 1,461square feet of temporary Zone 2 buffer impact which is coincident with the proposed hand clearing under the bridge. Mitigation Permanent wetland impacts total 0.3454 acre which will require compensatory mitigation. EBX-Neuse I, LLC is providing 0.52 credits from their Blackbird Site and 0.17 credits from their Meadow Spring Site (see attached SOA letter). Permanent loss of function stream impacts total 230 linear feet (0.0353 acre) which will also require compensatory mitigation. Mitigation is being provided by NCDMS for 460 stream credits (see attached Letter of Acceptance). Per the Neuse River Buffer rules (15A NCAC 02B .0714) Table of Uses (11) (y)(ii) perpendicular road crossings which "impact greater than one -tenth of an acre but equal to or less than one-third of an acre of riparian buffer" are "allowable upon authorization." No mitigation is required for the road crossings. Greenways [(11)(j)(iii)] "when built upon area is added to the riparian buffer, equal to or less than 10 feet wide with two -foot -wide shoulders. Shall be located outside Zone 1 unless there is no practical alternative" is "allowable upon authorization." No mitigation is required for the greenway. Utility/Sewer lines (new line construction) [(11)(kk)(ii)] where the "construction corridor of less than or equal to 40 linear feet wide and a permanent maintenance corridor that is equal to or less than 30 feet wide" are "deemed allowable" and [(II)(i) and (ii)] where "Zone 2 impacts" are "deemed allowable" and "Zone 1 impacts to less than 2,500 square feet when impacts are solely the result of tying into an existing utility line and when grubbing or grading within 10 feet immediately adjacent to the surface water is avoided" are "allowable upon authorization." Bridges [(11)(c)(ii)] where "impact(s) greater than one -tenth of an acre of riparian buffer" are "allowable upon authorization." No mitigation is required for the utility connection. New stormwater devices [(9)(a)(i)] which comply with a stormwater management plan are "deemed allowable."
