Accordingly, the Division is forwarding the subject NPDES permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). The following changes are included in your final permit as requested in CTI's letter of December 9, 2002: • Outfall 001 — The description of the wastewater was modified to include the tank water bottoms. The description of the treatment system was modified to add the mechanical skimmer. • Outfall 003 —The description of the wastewater was modified to eliminate wash water. Outfall 003 was previously covered by permit NC0028568, formerly issued to JLM Terminals, Inc. The Point Source Compliance and Enforcement Unit will now complete the process for rescission of permit NCO028568 and will send you a letter documenting this action. If you have any questions concerning the rescission of NC0028568, contact Mr. Bob Sledge of the Compliance and Enforcement Unit at 919-733-5083, extension 547. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter ISOB of the North Carolina General Statutes, and filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. There shall be no direct discharge of tank contents following hydrostatic testing unless benzene concentration is less than 71.4 µg/L and toluene concentration is less than 11 Ag/L. ACUTE TOXICITY MONITORING (ANNUAL) The Permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pinwphales prop elan) 24-hour static test. Effluent samples for self - monitoring purposes must be obtained below all waste treatment. The permittee will conduct one test annually, with the annual period beginning in January of the calendar year of the effective date of the permit. The annual test requirement must be performed and reported by June 30. If no discharge occurs by June 30, notification will be made to the Division by this date. Toxicity testing will be performed on the next discharge event for the annual test requirement. The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed, using the appropriate parameter code. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. They recently purchased the adjacent JLM Terminal. CTI requested to incorporate into their permit the outfall from JLM Terminals as Outfall 003. Both facilities will be operated as CTI Terminals under one permit. The permit for JLM Terminals (NC0028568) will be rescinded when permit NCO082970 is issued. Permit NCO028568 was issued on October 2001. The requirements for outfall 003 will be the same as those for outfall 001 in the permit that was issued in October. Facility Description The CTI terminal stores No.2 and No.6 fuel oil. It could also store gasoline at times. The JLM terminal stores solvents (n-propanol, methanol, MIBK, acetone, MEK, ethanol, n-p acetate, n-butanol, and isopropyl alcohol). Outfall 001 — The stormwater runoff from tank dikes, boiler blowdown and runoff from the loading rack are treated in an oil/water separator before being discharged from Outfall 001. Outfall 002 — This outfall discharges treated groundwater. The groundwater treatment system consists of an oil/water separator, an air stripper, two particulate filters and activated carbon. Outfalls 001 and 002 are combined before discharging to the Cape Fear River. Fact Sheet Renewal -- NPDES Permit NCO082970 Page 1 Outfall 003 — The stormwater runoff from tank dikes and the loading racks are treated in an oil/water separator before being discharged from outfall 003. COMPLIANCE REVIEW DIVIR Data Review 001 — The average monthly flow for the period of August 2001 to August 2002 was 0.055 MGD, TSS averaged 16 mg/l, and oil & grease averaged 5.35 mg/l. The maximum concentration reported for oil and grease was 11 mg/l, for total suspended solid the maximum concentration reported was 45 mg/l. 002 — The average monthly flow for the period of August 2001 to August 2002 was 0.00869 MGD, and oil & grease averaged 5.66 mg/l. The maximum concentration reported for oil and grease was 39 mg/l. Whole Effluent Toxicity (WET) Test For outfall 001 they passed the annual toxicity test since from 1998 to 2001, in 1999 no testing was done. Outfall 002 doesn't have a toxicity test requirement. Basin Plan The Cape Fear River is rated as Partially Supporting and is listed in the 303(d) list due to low dissolved oxygen. A TMDL is being developed for this section of the river. However, since this facility does not discharge oxygen consuming wastes this TMDL has no effect on this permit. PROPOSED MODIFICATIONS • 001 — Eliminate the limit for oil and grease. The majority of the samples had concentrations of <1 mg/l. The highest value reported was 11 mg/I. • Added Outfall 003. This outfall was permitted as outfall 001 in permit NC0028568. The effluent monitoring requirements remain the same. Groundwater treatment system information is as follows: Influent flow will enter the treatment system from a recovery trench and a recovery well. The system includes a PECO 10 gpm oil/water separator, 280 gallon product tank, intermediate sump tank and 20 gpm transfer pump, Pollution Equipment Company 16 gpm (20 ft. length by 12 inch diameter) packed tower type air stripper equipped with a 214 gpm blower, intermediate sump tank and 20 gpm transfer pump, 50 gpm dual bag filters, and four 10 gpm Aquatec carbon filters arranged in two parallel paths with each path containing two units in series. The system also includes a Hersey turbine type flow meter/totalizer and alarms and logic circuitry to terminate influent pumping operations during high -high water conditions. Outfall 003 consists of a 50,000 gal baffled oil/water separator with mechanical skimmer, 1000 gal product tank and gravity discharge. f. Please provide a description of proposed wastewater treatment facilities: The permittee proposes to add a flow meter totalizer and effluent pumping station for Outfall 003. The writer has granted an informal approval. g. Possible toxic impacts to surface waters: Petroleum contaminated effluent may be released to a large receiving stream. h. Pretreatment Program: Not a POTW. 2. Residuals handling and utilization/disposal scheme: The spent carbon will be returned to the supplier. Connection to Regional Sewer System: The receiving stream is not considered to be an environmentally sensitive river at the proposed discharge location due to it's large flow volume and the location of many discharge outfalls. The City of Wilmington does not allow connection of such systems to the public sewer unless discharge is to an environmentally sensitive stream. Subsurface: The oil terminal/storage facility has many buried pipes on the higher elevations and high groundwater table on lower elevations. Both situations would interfere with a subsurface disposal operation. A subsurface disposal operation may move the contamination plume off site. Other disposal options: None explored. 5. Other Special Items:' None PART IV - EVALUATION AND RECONKENDATIONS This report is being prepared based on a request for permit renewal by the Permittee. CTI has recently purchased the adjacent JIM Terminal (permitted under NC0028568). I have enclosed a copy of the a name change/permit change request. Although, CTI representatives have not specifically requested rescission of Permit NC0028568, they have indicated that the JIM terminal outfall be redefined as Outfall 003 on NC0082970. Based upon the enclosed correspondence, it is recommended that the permitting staff provide this information to the compliance group for rescission of Permit NC0028568 for the JIM Terminal in New Hanover County. The CTI Terminal is equipped with a gravity oil/water separator with mechanical skimmer and product tank for receiving storm -related flows from impervious areas where train loading operations occur and from containment dike areas for fuel oil tanks and solvent tanks (two JIM tanks). Boiler blowdown is also directed into Outfall 001. Groundwater remediation is also performed on site. The groundwater remediation activity concerns pumping contaminated groundwater from a recovery trench at a rate of 2.5 gpm, and from a recovery well at an approximate rate of 7.5 gpm. The groundwater treatment system discharges into the Cape Fear River via separate outfall pipe. The activity was not suggested to be covered by general permit at the time due to semi -volatile constituent monitoring inadequacies of the general permit. The CTI Terminal's main storage materials are No.2 and No. 6 fuel oil. Although not within the current inventory, gasoline may also be stored at the facility. Chemical analyses available at the Regional Office indicate the presence of both volatile and semi -volatile petroleum constituents in the area of the recovery trench and recovery well. The PMM Terminal stores solvents and is equipped with a gravity oil/water separator with mechanical skimmer and product tank for receiving storm related flows from solvent storage tank containment areas and from the truck loading rack. A review of the past 12 months DMR data indicate that Outfall 001 had maximum oil&grease concentration of 30 mg/l, and TSS maximum concentration of 45 mg/l. Outfall 002 had a maximum naphthalene concentration of 25 ug/l. All other values including acute toxicity results were not of concern over this period. The facility's boiler is treated using boiler compounds from Rite Industries including: B210 (an aqueous polyacrylate), B40 (cyclohexylamine), B095 (sodium hydroxide), and PB82 (sulfurous acid and disodium salt). Boiler blowdown is routed to Outfall 001 which did not show acute toxicity problems. It is recommended that NPDES Permit No. NC0082970 be modified with consideration for Regional Staff comments and placed at public notice. The terminal is a bulk liquid petroleum storage terminal and has no refining or production capability. The facility operates two waste water systems that discharge into a common outfall. Outfall 001 handles storm water from various collection points and from tank field containment areas. Treatment is provided by an oil/water separator prior to discharge. Outfall 002 handles groundwater from an on -site remediation system. Treatment consists of bag filtration, carbon filtration and a stripping tower. Its discharge is pumped to the 001 outfall line downstream of the oil water separator. A common line then discharges the combined effluent to the Cape Fear River. This treatment system does not generate any sludge.
