This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6. 1983 and as subsequently amended. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding. Please take notice that this permit is not transferable except after notice to the Division of Water Quality. Part IL EA. addresses the requirements to be followed in case of change in ownership or control of this discharge. The Division of Water Quality may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. Wastewater from filter backwash is treated using two wateiwater storage/treatment lagoons and discharged into Coddle Creek. The receiving stream (Coddle Creek) is classified as C waters and is on the 303(d) list as an impaired water. The May 1998 Yadkin -Pee Dee River Basinwide Water Quality management Plan concludes that this stream is does not supports its designated uses because of nonpoint source pollution. TOXICITY TESTING: Current Requirement: None Recommended Requirement: None recommended. COMPLIANCE SUMMARY: No NOVs and plant has one noncompliance during the time period 1/1/96 — 7/1/99. The non compliance resulted from the discharge of water outside of the limit for settleable solids. INSTREAM MONITORING: This facility is required to monitor turbidity of the receiving stream both upstream and downstream from the outfall. A turbidity limit has been implemented. PROPOSED CHANGES: The flow limit has been removed from the permit. The since the wastewater treatment facility is not RO there is no need to limit flow. Excluding flow the limits and monitoring requirements outlined in the previous permit remain consistent with the minimum requirements for this type of facility. Therefore, it is recommended that this permit be renewed without changes. Coddle Creek Water Treatment Plant Fact Sheet NPDES Renewal Page I It is division policy to implement Fe monitoring for all water treatment plants and Al monitoring if alum is utilized during the treatment process. Most facilities utilize either ferric sulfate or alum but rarely both, therefore the need for monitoring of both Fe and Al should be examined. Permits should require that either Fe or AL be monitored (depending on which coagulant is used) with a footnote requiring the other be monitored only if used in the treatment process. A minimum release of 6.0 cfs is expected from the dam. The receiving stream is well defined, and has a drainage area that is generally rural both upstream and downstream. This Office is aware of no other discharges and/or water intakes within a mile downstream of this proposed facility. PART II - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS 1. a. Possible toxic impacts to surface waters: Data collected in a study by DWQ of WTP effluents has found a variety of concerns (toxicity from chlorine, aluminum, etc.), that warrant further attention. Other disposal options: N/A PART IV - EVALUATION AND RECOMMENDATIONS The applicant request renewal of the subject permit. There have been no changes to the WTP and/or the permit since the permit was last renewed. It is requested in this renewal request that consideration be given to eliminating the permit limitation for flow. Since this information provides no useful benefit, this Office has no objection and recommends that the flow limitation be removed. Pending receipt of the revised WLA, additional WWT facilities may be necessary to reduce pollutants that may be expected in discharges of this type. Box 29535 Raleigh, North Carolina 27626-0535 RE: Coddle Creek Water Treatment Plant NPDES Permit NCO083119 City of Concord, Cabarrus County Dear Mr. Weaver: Enclosed please find the NPDES permit renewal package for the City of Concord's Coddle Creek Water Treatment Plant. As you and I discussed during our recent telephone conversation, this is the first renewal of the NPDES permit. Generally, the water plant produces 6.0 million gallons per day of potable water for public consumption through our water distribution system. The plant treats raw water from the Coddle Creek Reservoir with contact clairifiers and mixed media filters. Both processes, clarification and filtration require backwashing. The filters must be backwashed with potable water. However, the clarifiers are backwashed with raw water from the reservoir. The backwash is treated onsite by two (2)-settling basins prior to discharge into Coddle Creek, downstream of the reservoir. Approximately 50 percent of discharge is raw water from the clarifiers. Charles, as we discussed, we believe that during this first renewal of the permit is the time to address the flow limit. We understand that the original DWQ/NPDES staff reports did not ask for or recommend flow limits. We also understand that several water treatment plans with settling basins similar to ours are permitted without flow limits. With this precedent, together with the compliance history of the facility, the City of Concord hereby requests that effluent flow limits be removed from our permit. We propose to sample during representative flows for all other effluent limitations and monitoring requirements as they are now. We have discussed this issue with Mr. Terry Gross, the regional water treatment plant expert for NCDENR/DEH — Public Water Supply Section. Mr. Gross indicated his support of this request. We have also discussed flow issues with Mr. Rex Gleason with the Moresville Regional Office. He stated no objections and deferred us to your office for approval. Sludge Management Plan The settling basins have not required removal of the settled solids as of yet. We do anticipate this to become a necessity within the next 1-1/2 years. Weaver, Jr. March 31, 1999 Page 2 of 2 settling basins is to contract dewater and haul the sludge. The sludge will be dewatered onsite then hauled to BFI's landfill within the City limits of Concord. The City has a contract with BFI for municipal solid waste disposal. The sludge if not landfilled by BFI will be mixed with soil and used as daily cover for the landfill. We have already spoken with several firms for the dewatering and hauling contract. We look forward to your timely review and approval.
