Dear Mr. Hughes:
In accordance with the application for discharge permit received on July 28, 1999. the Division is
forwarding herewith the subject NPDES permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the U.S. Environmental Protection Agency dated December 6. 1983.
The following items from the DRAFT permit have been retained in this FINAL permit:
• All numerical permit limits remain unchanged. However, the Weekly Average Limits have been
moved to Daily Maximum limits, in accordance with EPA Effluent Guidelines.
• Change toxicity test to an Acute Annual test.
• The permit expiration date has been changed to October 31, 2004.
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this letter. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings,
Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such a demand is made, this
permit shall be final and binding.
Please take notice that this permit is not transferable except after notice to the Division of Water Quality.
Part II, EA. addresses the requirements to be followed in case of change in ownership or control of this
discharge. The Division of Water Quality may require modification or revocation and reissuance of the
permit.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality, the Division of Land Resources, the Coastal Area Management Act, or any other
federal or local governmental permit.

SECTION A(1). EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
Beginning on the effective date of this permit and lasting until expiration, the Permittee is
authorized to discharge treated wastewater from Outfall 001. Such discharges shall be
limited and monitored by the Permittee as specified below:

1. Sample locations: E- Effluent, U- Upstream of outfall, D- Downstream of outfall.
2. All flow discharging from the system shall be monitored. Flow shall be released slowly so as to prevent erosion
of the receiving stream. Total flow from the outfall for one discharge event shall not exceed the capacity of the
storage tank.
3. The discharge shall not cause the turbidity of the receiving stream to exceed 50 NTU. If the turbidity exceeds
these levels as a result the natural background conditions, the discharge level cannot cause any increase in the
turbidity in the receiving stream.
4. The temperature of the effluent shall not cause an increase in the temperature of the receiving stream of more
than 2.8°C and in no case cause the ambient water temperature to exceed 32°C.
5. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units.
6. Acute Annual Toxicity (Fathead Minnow) per Special Condition A(2).
There shall be no discharge of floating solids or visible foam in other than trace amounts.

SUPPLEMENT TO EFFLUENT LIMITATIONS
AND MONITORING REQUIREMENTS
SPECIAL CONDITIONS
A(2). ACUTE TOXICITY MONITORING (ANNUAL)
The permittee shall conduct annual toxicity tests using protocols defined as definitive
in E.P.A. Document EPA/600/4-90/027 entitled "Methods for Measuring the Acute
Toxicity of Effluents to Freshwater and Marine Organisms." The monitoring shall be
performed as a Fathead Minnow (Pimephales promeias) 24 hour static test. Effluent
samples for self -monitoring purposes must be obtained below all waste treatment. The
permittee will conduct one test annually, with the annual period beginning in
January of the calendar year of the effective date of the permit. The annual test
requirement must be performed and reported by June 30. If no discharge occurs by
June 30, notification will be made to the Division by this date. Toxicity testing will be
performed on the next discharge event for the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results required as part
of this permit condition will be entered on the Effluent Discharge Form (MR-1) for the
month in which it was performed, using the appropriate parameter code. Additionally,
DWQ Form AT-1 (original) is to be sent to the following address:

Test data shall be complete and accurate and include all supporting chemical/physical
measurements performed in association with the toxicity tests, as well as all dose/response data.
Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine it
employed for disinfection of the waste stream.
Should any test data from either these monitoring requirements or tests performed by
the North Carolina Division of Water Quality indicate potential impacts to the
receiving stream, this permit may be re -opened and modified to include alternate
monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as
minimum control organism survival and appropriate environmental controls, shall
constitute an invalid test and will require immediate follow-up testing to be completed
no later than the last day of the month following the month of the initial monitoring.

Ball -Foster Glass Container Co., L.L.C. has reviewed the draft permit dated March 15,
2000 and offers the following comments for your consideration.
/l. Supplement to permit cover, item 2 states that the receiving water is in the Lumber
River Basin. We believe that is incorrect and should be changed to Tar River.
1/2. The footnote at the end of Section A (1), Effluent Limitations states that the cooling
water shall not pass through the old recycle pond. Ball -Foster would like to point out
that the pond is gone. The former pond area was previously cleaned up, filled with
clean soil, and seeded with grass. The cooling water is directed to a storm drain
located near the holding tank and is released to the ditch through a buried pipe.

PROJECT NOTES
Summary
• This is a permit renewal for a glass container manufacturer which discharges furnace drain
water. City water is used to cool molten glass. The water contacts the glass, but does not
contact oils or other substances at the plant. This one -pass quench water is then held in a
500,000 gal above ground storage tank for temp control. Discharge is intermittent,
occuring only when the furnace tank is drained. There was one discharge event reported
over the past two calendar years (98-99). Discharge is at a constant flow rate over several
days, with total discharge approx. 0.3-0.5 MGD.
• Facility discharges to an UT to Martin Creek>Sandy Creek>Swift Creek. The receiving
stream is not 303(d) listed in the Draft 2000 Listing, nor are there specific management
strategies for this stream in the Draft 1999 Basin Plan. At the last permit renewal, request
for permit denial were sent by USFWS, WRC, et al due to Federally endangered species in
Sandy Creek, and the outstanding biological diversity of Swift Creek.
Permitting Strategy
• Facility is regulated by Effluent Guidelines [40 CFR 426, Subpart H- Glass Container
Manufacturing] for O&G, TSS, and pH. Limits for O&G/TSS are production -based.
Original limits were based on production of 260 tons/day with one furnace in operation.
Facility has added a second furnace, and average production is now 414 tons/day, while
peak production is 526 tons/day. Since facility has had no problem meeting original limits,
maintain same limits based on original production numbers; however, shift Weekly Avg
Limit to a Daily Max Limit which is consistent with Effluent Guidelines. This more
stringent approach is justified based on downstream concerns.
• Although an NSW water, nutrient limits are not warranted for this non -nutrient industrial
wastewater.
DMR Data.
• There was one discharge event over the past 24 months (98-99). Discharge from the
holding tank was released at 0.01 MGD over 30 days (April 1999). DMR data shows no
compliance problems with limited parameters. Using detection limit concentrations, the
max daily TSS loading was 0.33 lbs/d (versus limit of 72.8 1bs/day) and the max daily O&G
loading was 0.42 lbs/day (versus limit of 31.2 lbs/day). Facility also performed sampling at
several downstream stations during this release, and sample data shows no downstream
impact. Between 95-99, facility has passed acute tox test (> 1 OOOA) all four times that
discharge occurred.
WLA Data.
• Last WLA was 1993.
RRO Re on Data.
• Staff' Report from 1993 states that Henderson PO'fW will not accept this WW anymore due
to the large volume. Facility performed an EAA in 1993.

Dear Mr. Weaver:
Ball -Foster Glass Container Co., L.L.C. requests renewal of NPDES permit
number NCO083038 for the discharge of furnace drain water. There have been
no facility changes since the last permit was issued on June 30, 1995. Enclosed
is the renewal package checklist and application form. One original and two
copies are enclosed as requested.
Description of Discharge
Ball -Foster operates two glass -melting furnaces at this location for the
manufacture of glass containers. Whenever the molten glass is drained from a
furnace, clean city water is used to cool the molten glass, cool the metal chute,
and direct the flow of glass down the chute. This cooling water does not come
into contact with any oils or other substances used in the plant, and there are
no treatment chemicals or other substances added. The quench water is held in
a 500,000 gallon storage tank for temperature control then is discharged to the
receiving stream at a constant flow rate over a period of several days.
Approximately 300,000 to 500,000 gallons of quench water is used during a
drain.

Application Item 7 — Explanation of Intermittent Discharge
This discharge only occurs when a furnace is drained. Primary reasons for a
furnace drain are a scheduled or emergency furnace repair. Repairs are
typically scheduled about every seven years.
Sludge Management Plan
A sludge management plan is not applicable to this wastewater treatment since
no sludge or any solids are generated. The water is used only for cooling and
the treatment is temporary storage for temperature control.
Production Data
The checklist requires three years production data for facilities that discharge
process water. By definition, this cooling water is process water since it comes
into contact with the molten glass. Glass production data is summarized below.
