Division personnel have reviewed and approved your application for renewal of the subject
permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15,
2007 (or as subsequently amended).
The following changes have been incorporated into this permit renewal:
• A monitoring frequency for aluminum was reduced to Quarterly based on the Divisions Permitting
Strategy for Water Treatment Plants.
• A monitoring frequency for iron was reduced to Quarterly based on the Divisions Permitting
Strategy for Water Treatment Plants.
• A monitoring frequencies for turbidity, flow and TRC were reduced to 2/Month based on the
Divisions Permitting Strategy for Water Treatment Plants.
• Monitoring for the Settleable Solids was removed based on the Divisions Permitting Strategy for
Water Treatment Plants.
• A sample type for flow measurement was updated based on the Divisions Permitting Strategy for
Water Treatment Plants.

A Whole Effluent Toxicity Monitoring was added to the permit based on the Divisions Permitting
Strategy for Water Treatment Plants (Please refer to A. (2)).
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this letter. This request must be in the form of a written petition, confomvng. to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made,
this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division
may require modification or revocation and teissuance of the permit. This pemut does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits
required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or

are hereby revoked. As of this permit issuance, any previously issued permit bearing.
this number is no longer effective. Therefore, the exclusive authority to operate and
discharge from this facility arises under the permit conditions, requirements, terms,
and provisions included herein.
The Town of Robbinsville is hereby authorized to:
1. Continue to operate a Conventional Water Treatment Plant producing drinking.
water with a discharge of filter -backwash wastewater. This Water Treatment Plant
currently has a design potable flowrate of 0.5 MGD and a maximum, monthly
average wastewater discharge of 0.018 MGD
2. This facility is located 3.4 miles South of the Town of Robbinsville on NCSR 1110
in Graham County.
3. The Town of Robbinsville WTP consists of settling tubes and conventional filter.
4. Discharge from said treatment works at the location specified on the attached map
into the Rock Creek, classified C-Trout, HQW waters in the Little Tennessee River
Basin.

Footnotes:
1. The discharge shall not cause the turbidity of the receiving water to exceed 10 NTU. If the
turbidity exceeds these levels due to natural background conditions, the discharge level cannot
cause any increase in the turbidity in the receiving water.
2. Monitoring and limit shall only be applicable if chlorine is used for disinfection. The Division
shall consider all effluent TRC values reported below 50 Vg/L to be in compliance with the
permit. However, the Permittee shall continue to record and submit all values reported by a
North Carolina certified laboratory (including field certified), even if these values fall below 50
ug/L.
3. Duration of the discharge shall be noted in log books and a Total daily discharge reported in
the DMR.
4. Whole Effluent Toxicity shall be monitored by chronic toxicity (Ceriodaphnia) P/F at 10.0%.
Tests shall be conducted in February, May, August and November (Refer to Part A. (2.) for
details).
All samples collected should be from a representative discharge event.
There shall be no discharge of floating solids or visible foam in other than trace
amounts.

A. (2.) CHRONIC TOXICITY MONITORING (QRTRLY)
The permittee shall conduct quarterly chronic toxicity tests using test procedures outlined in the `
"North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or
subsequent versions.
The effluent concentration defined as treatment two in the procedure document is 10.0%. The testing
shall be performed as a Ceriodaphhia dubia 7day pass/fail test. The tests will be performed during the
months of February, May, August, and November. Effluent sampling for this testing shall be performed
at the NPDES permitted final effluent discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code
TGP3B. Additionally, DWQ Form AT-1 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later
than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual
chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test
form indicating the facility name, permit number, pipe number, county, and the month/year of the
report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to
the Environmental Sciences Section at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, then
monthly monitoring will begin immediately. Upon submission of a valid test, this monthly test
requirement will revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
If the Permittee monitors any pollutant more frequently then required by this permit, the results of
such monitoring shall be included in the calculation & reporting of the data submitted on the DMR &
all AT Forms submitted.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival, minimum control organism reproduction, and appropriate environmental controls,
shall constitute an invalid test and will require immediate follow-up testing to be completed no later
than the last day of the month following the month of the initial monitoring.

Hi Sergei,
I'm fine. I hope you and your family is doing well. Any trips planned to Moscow?
I don't have the Rock Creek 7/10, and we likely do not have it. I don't think Rock Creek is a source for the water system
in the Town. I've copied Mike Waresak and Mike Dowd to see if they have any information.
I'm not sure there is a tremendous benefit of the WET test for Robbinsville, but I don't know how the WTP Strategy
works. If you wouldn't mind, please send me a copy of the WTP Strategy. At a NC Water Quality Association meeting I
attended back in February, the question of WET testing for WTPs was directed to Chuck (he was invited as the "new'
director to speak and answer questions). He stated he wasn't familiar with the policy/strategy, but would look into it. Has
there been any follow-up within the agency? As I'm sure you know, the finished water for most public water supply
systems exhibit aquatic toxicity due to additives (zinc phosphate —in some applications for corrosion control and residual
chlorine for public health protection, etc.). Hopefully the discharges from the base treatment units (sedimentation basin,
filters, iron removal, etc.) do not contain these additives. The residual alum or polymer used for sedimentation could be
an issue. I know that the ecological impact of these discharges has been something the agency has been looking at for
some time.

Facility Overview
The Town of Robbinsville operates a conventional WTP designed for 0.5 MGD. The facility generates
backflow of 0.018 MGD and discharge occurs every day for 1-2 hours. Water sources are Long Creek,
Burgin Creek, and Rock Creek. The water from these creeks is stored in 2 MG reservoir before treatment
at the WTP.

During the last 4 years the facility received 2 notices of violation for exceeding the Total Residual
Chlorine limit.
PROPOSED PERMIT CHANGES
• A monthly average and a daily maximum limits for aluminum were added to the permit based
on the results of the statistical analysis of the effluent data. A monitoring frequency for
aluminum was reduced to Monthly. The limits will become effective 4 years after the effective
date of the permit. This time period is provided for the facility to determine and implement the
best strategy to comply with the new water quality limits.
• A monitoring frequency for iron was reduced to Monthly based on the review of the effluent
data.
• A monitoring frequencies for turbidity, flow and TRC were reduced to 2/Month based on the
Divisions Permitting Strategy for Water Treatment Plants.
• A monitoring for the Settleable Solids was removed based on the Divisions Permitting Strategy

In response to your inquiry about the summer (annual) 7Q10 low -flow discharge for Rock Creek near Robbinsville in
Graham County, the following information is provided:
A check of the low -flow files here at the USGS North Carolina Water Science Center does not indicate a previous low -flow
determination for your point of interest on Rock Creek. No USGS discharge records are likewise known to exist for your
point of interest.
In the absence of site -specific discharge records sufficient for a low -flow analysis, estimates of low -flow characteristics at
ungaged locations are determined by assessing a range in the low -flow yields (expressed as flow per square. mile
drainage area, of cfsm) at nearby sites where such estimates have previously been determined.
For streams in Graham County, the most recently published low -flow information is a statewide report completed in the
early 1990's. It is USGS Water -Supply Paper 2403, 'Low -flow characteristics of streams in North Carolina" (Giese and
Mason, 1993). An online version of the report is available through http:Hpubs.usgs.gov/wsp/2403/report.pdf. The report
provides the low -flow characteristics (based on data through 1988) via regional relations and at -site values for sites with
drainage basins between 1 and 400 sgmi and not considered or known to be affected by regulation and/or diversions.
Based on 2 nearby downstream USGS partial -record sites within the Long Creek basin in vicinity of your point of interest
on Rock Creek where low -flow characteristics were published in the statewide report, the 7Q10 yields range from 0.36 to
0.38 cfsm (average 0.37 cfsm).
A drainage -area delineation for this stream location completed using the online NC StreamStats application
(hftp://water.usgs.gov/osw/streamstats/north carolina.html) indicates the drainage area is 0.66 sgmi (where the channel
crosses underneath Secondary Road 1110).
Applying the range in 7Q10 yields to the drainage area for your point of interest results in an estimated 7Q10 discharge
about 0.25 cubic feet per second (cfs).
Please note the low -flow characteristics in the statewide report are based on data ending during the late 1980's and do
not reflect the occurrence of recent droughts, which have resulted in decreased low -flow statistics at some USGS gaging
stations.
