Dear Mr. Cagle:
In accordance with the application for discharge permit received on August 11, 1997, the Division is
forwarding herewith the subject state - NPDES permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of
this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the office of Administrative Hearings, Post Office Drawer 27447, Raleigh,
North Carolina 27611-7447. Unless such a demand is made, this permit shall be final and binding.
Please take notice that this permit is not transferable. Part II, EA. addresses the requirements to be
followed in case of change in ownership or control of this discharge. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits required by
the Division of Land Resources, Coastal Area Management Act, or any other Federal or Local governmental permits
may be required.

map into Rock Creek which is classified WS-I Trout waters in the Little
Tennessee River Basin.

There have, apparently, been no treatment system modifications since the last permit was issued. This
permit has been drafted without modifications as it was issued most recently in accordance with the
Division's guidance for water treatment plant discharges. Although this facility discharges into a
WS-I Trout stream, no TRC limit is recommended as the compliance data indicates that TRC has not
been detected for the past 24 months. An overall compliance review for this facility indicates that
consistent operation is not a problem. The recommendation is that this permit be renewed with existing
requirements.

1996 and should be added to the basin.
3) Map 4 - Darren Stewart Trout Farm permit number should
be NC0084981.

gpd.

Development Administration is providing assistance with a $500,000
Financial Assistance Award which includes an EDA grant of $300,000
and an Appalachian Regional Commission (ARC) supplementary grant
of $200,000. A remaining balance of $125,000 will be provided by
the Town of Robbinsville.

Spray Irrigation: The Town of Robbinsville does not own 4+ acres
of suitable land for spray irrigation. Adjacent land, not owned
by the Town, is not topographically suitable for spray irrigation
as well.

Connection to Regional Sewer System: This option is available and
was originally proposed; however, economic costs associated with
this project were very high compared to the discharge option,
approximately $300,000 for connection to the Robbinsville WWTP
versus approximately $4,000 for the discharge.
Subsurface: As with spray irrigation, adequate suitable land was
not available.

The Asheville Regional Office recommends issuance of the NPDES
Permit for the discharge of filter backwash water from the Town of
Robbinsville's Water Treatment Plant.
