The Division of Water Resources (the Division or DWR) hereby issues the attached NPDES permit for
the subject facility. We issue this permit pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated October 15, 2007, or as subsequently amended.
Changes for Renewal. The Division understands that you have made no significant changes in treatment
process during the last permit cycle. We have therefore made only minimal changes to your permit
including updating your site map and your Whole Effluent Toxicity (WET) testing page. Please note that
electronic reporting of Discharge Monitoring Reports (DMRs) is now required.
Implementing Electronic Discharge Monitoring Reports (eDMRs). Please be advised that the Division
has implemented an electronic Discharge Monitoring Report (eDMR) program, in accord with pending
requirements by the Environmental Protection Agency (EPA). We include the details to implement the
eDMR program in this permit [see permit Section A. (3.)].
Proposed federal regulations require electronic submittal of all DMRs and specify that, if North
Carolina does not establish a program to receive such submittals, Permittees must then submit eDMRs
directly to EPA. For more information on eDMRs, registering for eDMR submittal, and obtaining an

unacceptable, you have the right to an adjudicatory hearing upon written request submitted within thirty
(30) days following receipt of this letter. This request must take the form of a written petition,

such demand is made, this decision shall be final and binding.

In compliance with the provisions of North Carolina. General Statute 143-215.1, other lawful
standards and regulations promulgated and adopted by the North Carolina Environmental
Management Commission, and the Federal Water Pollution Control Act, as amended,
Ardagh Glass, Inc.
is hereby authorized to discharge wastewater from a facility located at
Ardagh Glass, Inc.
620 Facet Road, Henderson
Vance County
to receiving waters designated as an unnamed tributary to Martin Creek in the Tar Pamlico River
Basin in accordance with effluent limitations, monitoring requirements, and other conditions set
forth in Parts I, II, III, and IV hereof.
This permit shall become effective May I, 2015.
This permit and the authorization to discharge shall expire at midnight on October 31, 2019.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are
hereby revoked, and as of this issuance, any previously issued permit bearing this number is
no longer effective. Therefore, the exclusive authority to operate and discharge from this
facility arises under the permit conditions, requirements, terms, and provisions included
herein.
Ardagh Glass, Inc.
is hereby authorized to:
1. continue to operate a wastewater treatment system consisting of a 0.500 million -gallon
holding tank (for temperature control) located at Ardagh Glass, Inc., 620 Facet Road,
Henderson, Vance County, and
2. discharge from said treatment works via Outfall 001, at the location specified on the
attached map, into an unnamed tributary to Martin Creek [stream segment 28-78-1-3], a
waterbody currently classified C; NSW+ within subbasin 03-03-02 [HUC: 03020101] of
the Tar Pamlico River Basin.

Beginning on the effective date of this permit and lasting until expiration, the Permittee is

Footnotes:
1. Beginning on February 1, 2016, 270 days from the effective date of this permit, the Permittee shall
submit discharge monitoring data electronically using the NC DWR's Electronic Discharge
Monitoring Report (eDMR) internet application [see Section A. (3.)].
2. E = Effluent; U = upstream from the outfall; D = downstream from the outfall.
3. All flow/discharging shall be monitored. Each discharge event shall not exceed the capacity of the
storage tank. Flow shall be released slowly so as to prevent receiving -stream erosion. If no discharge
occurs, that month's Discharge Monitoring Report (DMR) shall reflect "no flow."
4. Effluent shall not cause receiving -stream furbidity to exceed 50 NTU. If natural background
turbidity exceeds this level, this discharge shall not increase ambient receiving -stream turbidity.
5. Effluent temperature shall not cause receiving stream temperature to increase more than 2.8°C;
in no case shall effluent cause the ambient water temperature to exceed 32°C.
6. Whole Effluent Toxicity (WET) testing of each discharge event - Acute (Fathead Minnow), 24-
hour static test at effluent concentration of 90% [see Section A. (2)].
Condition:
The Permittee shall discharge no floating solids or foam.

A. (2.) ACUTE TOXICITY MONITORING (EPISODIC)
[15A NCAC 02B .0200 et seq.]
The Permittee shall conduct toxicity tests on each [episodic] dischar a event using protocols
defined as definitive in E.P.A. Document EPA/600/4-90/027 entitled "Methods for Measuring
the Acute Toxicity of Effluents to Freshwater and Marine Organisms." Monitoring shall be
performed as a Fathead Minnow (Pimephales promelas) 24-Hour static test. The effluent concentration
at which there may be at no time significant acute mortality is 90% (defined as treatment two in the
procedure document). Effluent sampling for this testing must be obtained during representative effluent
discharge and shall be performed at the NPDES-permitted final effluent discharge below all treatment
processes.
The Permittee will conduct one test per discharge, beginning with the first discharge following
the effective date of the permit. Toxicity testing will be performed on each discharge event. The
test requirement must be performed and reported by June 30. If no discharge occurs by June 30,
notification will be made to the Division by this date.
The parameter code for this test is TAE6C. All toxicity testing results required as part of this
permit condition will be entered on the Effluent Discharge Form (MR-1) for the month in which
it was performed, using the appropriate parameter code. Additionally, DWR Form AT-1
(original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Water Sciences Section no later than 30
days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical
measurements performed in association with the toxicity tests, as well as all dose/response data.
Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine
is employed for disinfection of the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North
Carolina Division of Water Resources indicate potential impacts to the receiving stream, this
permit may be re -opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum
control organism survival and appropriate environmental controls, shall constitute an invalid test
and will require immediate follow-up testing to be completed no later than the last day of the
month following the month of the initial monitoring.

A. (3.) ELECTRONIC REPORTING - DISCHARGE MONITORING REPORTS

Proposed federal regulations require electronic submittal of all discharge monitoring reports
(DMRs) and specify that, if a state does not establish a system to receive such submittals, then
Permittees must submit DMRs electronically to the Environmental Protection Agency (EPA).

Beginning no later than 270 days from the effective date of this permit, the Permittee shall
submit discharge monitoring data electronically using the NC DWR's Electronic Discharge
Monitoring Report (eDMR) internet application.
Monitoring results obtained during the previous month(s) shall be summarized for each
month and submitted electronically using eDMR. The eDMR system allows permitted
facilities to enter monitoring data and submit DMRs electronically using the internet. Until
such time that the state's eDMR application is compliant with EPA's Cross -Media Electronic
Reporting Regulation (CROMERR), Permittees will be required to submit all discharge
monitoring data to the state electronically using eDMR and will be required to complete the
eDMR submission by printing, signing, and submitting one signed original and a copy of the
computer printed eDMR to the following address:

If a Permittee is unable to use the eDMR system due to a demonstrated hardship, or due to
the facility being physically located in an area where less than 10 percent of the households
have broadband access, then a temporary waiver from the NPDES electronic reporting
requirements may be granted and discharge monitoring data may be submitted on paper DMR
forms (MR 1, 1. 1, 2, 3) or alternative forms approved by the Director. Duplicate signed
copies shall be submitted to the mailing address above.
Requests for temporary waivers from the NPDES electronic reporting requirements must be
submitted in writing to the Division for written approval at least sixty (60) days prior to the
date the facility would be required under this permit to begin using eDMR. Temporary
waivers shall be valid for twelve (12) months and shall thereupon expire. At such time,
DMRs shall be submitted electronically to the Division unless the Permittee re -applies for
and is granted a new temporary waiver by the Division.

Regardless of the submission method, the first DMR is due on the last day of the month
following the issuance of the permit or in the case of a new facility, on the last day of the
month following the commencement of discharge.

All eDMRs submitted to the permit issuing authority shall be signed by a person described in
Part H, Section B. (I 1.)(a), or by a duly authorized representative of that person as described
in Part II, Section B. (11.)(b). A person, not an assigned position, must be delegated signatory
authority for eI)MR reporting purposes.
For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR
user account and login credentials to access the eDMR system. For more information on

Certification. Any person submitting an electronic DMR using the state's eDMR system
shall make the following certification [40 CFR 122.22]. NO OTHER STATEMENTS OF
CERTIFICATION WILL BE ACCEPTED:
"I certify, under penalty of law, that this document and all attachments were prepared under
my direction or supervision in accordance with a system designed to assure that qualified
personnel properly gather and evaluate the information submitted. Based on my inquiry of
the person or persons who manage the system, or those persons directly responsible for
gathering the information, the information submitted is, to the best of my knowledge and
belief, true, accurate, and complete. I am aware that there are significant penalties for
submitting false information, including the possibility of fines and imprisonment for knowing
violations. "

The Permittee shall retain records of all Discharge Monitoring Reports, including eDMR
submissions. These records or copies shall be maintained for a period of at least 3 years from
the date of the report. This period may be extended by request of the Director at any time [40
CFR 122.41].

Facility Summary - This facility has made no changes in its treatment system since last renewal.
According to the renewal application and Change of Ownership form (received 05May2014),
Ardagh Glass, Inc. employs 284 people to manufacture glass containers (jars) under Federal
Effluent Guidelines [40 CFR 426, Subpart H- Glass Container Manufacturing]. This facility
uses city water as a one -pass quencher for molten glass (no contact with oils or other substances),
then holds this quenching water in a 500K-gal above -ground storage tank for temperature
control. Discharge occurs only episodically when plant workers manually drain the furnace tank.
Discharges to the environment range in volume from 0.300 MG to 0.500 MG, released at a
controlled flow -rate over several days. Monitoring is required only when discharging.
DMR Data -- This facility submitted monthly Discharge Monitoring Reports (DMRs) reporting
"no discharge" over the past five (5) calendar years (Jan2010-Jan2015).
Receiving Stream - Flow discharges to an UT to Martin Creek to Sandy Creek to Swift Creek.
The receiving stream is not 303(d) listed as impaired (2014).
Permitting Guidance - Although this facility discharges to NSW waters, nutrient limits are not
warranted for this non -nutrient industrial wastewater. Federal Guidelines regulate O&G, TSS,
and pH. Limits for O&G/TSS are calculated based on production. Original limits considered 260
tons/day [furnace pull] while operating one furnace. Today, the facility operates a second
furnace, and reports 478.1 tons/day average with peak production at 599.32 tons/day over the last
three years (May 2011-May2014). Despite this production increase, this facility historically has
had no problem meeting the originally allocated permit limits (1993). Therefore, consistent with
previous renewals, this renewal will maintain permit limits based on the previous permit (2010).
Waste Load Allocation (WLA) Data -- Last WLA was 1993.
RRO Region Data --Regional Staff Report (1993) states that Henderson POTW will not accept
this W W due to the large volume. This facility performed an Engineering Alternatives Analysis
(EAA) to address discharge alternatives in 1993.

application form, map, and sludge management plan are submitted as our application package. As
requested, the original and 2 copies are enclosed. There has been no facility changes impacting the
permitted system since the permit was issued last issued November 2010.

7. Describe the treatment system List all installed waste treatment components with capacities,
describe the processes that generate wastewaters. If the space provided is not sufficient attach a

The treatment system consists of a 500,000 gallon aboveground holding tank, which is
discharged via Outfall 001 into an unnamed tributary to Martin Creek.
Whenever molten glass is drained from a glass -melting furnace, clean city water is used to cool
the glass and the metal chute, and direct the flow of glass down the chute. The quench water
is collected and held in the 500,000 gallon aboveground storage tank for temperature control
then is discharged to the receiving stream at a controlled rate, over a period of several days.
This cooling, or quench, water does not come into contact with any oils or other substances
used in the plant, and there are no treatment chemicals or other additives used.
The discharge is intermittent and only occurs as a result of a furnace drain event. The primary
reasons for a drain are a scheduled or emergency furnace repair. Repairs are typically
scheduled approximately every 7 - 10 years.

Briefly describe the manufacturing process(es):
The raw materials are combined into batches and delivered to the two glass -melting furnaces where
they are heated to molten glass. The molten glass is then directed to forehearths where it is further
conditioned before being directed to a forming machine where it is moulded into glass containers. The
containers are slowly heated and cooled in annealing lehrs. The annealed containers are inspected for
quality and then packed in cartons or on bulk pallets. The containers are stored in an on -site
warehouse until loaded in a truck for shipment to the customer.

A sludge management plan is not applicable to this wastewater treatment since no sludge or solids are
generated. The water is use only for cooling and temporary storage for temperature control is the only
treatment.
