On behalf of Adam McCurry of Evanston-Shallotte, we are pleased to submit this
pre-construction notification for the unavoidable impacts to wetland resources
associated with the project. This letter summarizes our findings and requested
approvals.
Background:
Adam McCurry is planning to build a Walgreens Drugstore with an access road
to the south. The access road will clip the tip of the wetland boundary. The
property is adjacent to U.S.17 Business in the City limits of Shallotte in Brunswick
County, North Carolina (see Project Location Map -Figure 1).
The Brigman Company has been contracted by the applicant to review the
proposed project objectives, assess the impacts that these activities on
freshwater wetlands functions and suggest project revisions which will minimize
impacts and ensure the project is consistent with U.S. Army Corps of Engineers
and NC DENR guidelines and regulations.
404 Wetlands:
The project area was evaluated for potential wetland impacts subject to Section
404 of the Clean Water Act in November 2007 by The Brigman Company.
One contiguous freshwater wetland and brackish ecosystem totaling 0.67-acres
was found to occur within the limits of the project area. The wetland is
jurisdictional and contiguous with Woodward Branch. The eastern tip of the

wetland falls within the project footprint as illustrated on the attached
Overall/Plan/Section View (Figure 3).
Avoidance/Minimization Efforts:
Complete avoidance of impacts to freshwater wetland resources is not practical
due to the location and distribution of the wetland within the project area. The
proposed access roadway is positioned avoiding most of the wetland and
minimizing the damage to the wetland. All valuable wetland resources are to be
avoided when practical (i.e. only the portion of wetlands critical to complete the
project objectives has been impacted).
Although it was not possible to simultaneously achieve optimum conditions for
each of these design criteria the development plan was developed so that a
reasonable balance could be achieved between avoidance of wetland resources
and the various logistical, economic, and safety parameters that must be
satisfied.
Proposed Wetland Impacts:
Since the wetlands almost completely bisect the site, a minor discharge into the
wetland is required to provide critical access into the otherwise isolated upland
area to facilitate development of two houses. The construction of the linear road
crossing will require the deposition of fill material into 0.0003-acres of freshwater
wetlands.
Throughout the design process the unavoidable impacts to wetland resources
have been held beneath the 1/10 acre threshold therefore no mitigation is
proposed at this time.
Request for Validation/Nationwide Permit #18 Authorization:
Acting as agent for Mr. McCurry, we hereby request that the unavoidable impacts
to wetland resources occurring onsite resulting from a minor discharge
authorized under the current Nationwide Permit #18.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property

VI. Proposed Impacts to Waters of the United States/Waters of the State

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Access road was pushed to the northeast to avoid the majority of the wetland only impacting
a very small portion of the wetland. The overall impact to wetland resources was minimized to
only 15 square feet.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.ertr.state.ne.us/ncwetlandslstrmgide.html.
