Various arrangements and layouts of the required parking and turnaround were tried on land that is owned. Surrounding land is already developed with
industrial uses so it cannot be used. The only remainng land has two isolated wetlands that are located such that the proposed parking and turnaround
cannot be situated to avoid or minimize impacts. Reducing the size of the project or a no buld option would not satisfy the purpose and need. All
appropriate stormwater management, sediment and erosion control measures will be utilized to protect downstream water quality.

Dear Ms. Karoly:
On behalf of the Frito Lay Company, I am hereby submitting the attached PCN application for
NCDEQ-DWR Isolated Wetlands Permitting. The project is located at N 35.1160 and W 80.9360 on
the Fort Mill, NC -SC Quadrangle of the USGS. The project is located within the Catawba River Basin
HUC 03050103 and is more than 4,000 feet upstream of Steele Creek. The site has no tributaries or
streams but contains two identified isolated wetland areas that have no conveyances leading into or out
of them. They are completely surrounded by upland. The existing Frito Lay Manufacturing and
distribution facility is located southwest of the City of Charlotte on Nevada Boulevard. From 1-77
south of Charlotte, take Westinghouse Boulevard west to South Tryon Street (Hwy 49), turn left
(south) and follow to Nevada Boulevard on left. Site is on left side of Nevada Boulevard A project
Location map is attached.
This project is necessary to expand the parking and turnaround facilities for 68 semi tractor -trailer
vehicles for ongoing and continued operation of the manufacturer. Equipment to be used on this
project will include typical earthmoving and construction equipment. Loaders, dozers, trucks,
trackhoes, graders, cranes, and a variety of other large and small equipment will be used throughout
various stages of construction.
The Waters of the U.S. have been delineated, surveyed, and verified by Alan Johnson of the
NCDENR-DWR Mooresville Field Office. Mr. Johnson has coordinated with Mr. William Elliott of
the USACE Wilmington District Asheville Field Office to verify the two identified areas as Isolated
Wetlands. Maps have been attached which show the extent of delineated and surveyed wetlands on
this site. Data forms and photographs are attached for both areas.
The database of the NC State Historic Preservation office has been consulted and indicates no
features within the vicinity of the site. The database of the NC Natural Heritage Program has been
consulted and indicates no elements or occurrences within the vicinity of the site. The USFWS
Asheville Field Office has been contacted for a review of protected species. Upon advisement from the
USFWS, a qualified biologist has been contracted to review the site in more detail for the presence of
identified species or suitable habitat. A special moratorium for land clearing between the dates of May
15 and August 15th will be followed as necessary to protect any temporary roosting habitat of the Long
Eared Bat.
The stormwater management plan has been designed in accordance with the local requirements of
the designated local authority of the Charlotte Mecklenburg Stormwater Services. A final approval
letter is pending.
Mitigation for this project will be coordinated with the NC Ecosystem Enhancement Program/. Ms.
Kelly Williams has been contacted regarding the availability of credits. A letter of credit availability
from her office is attached.
A check in the amount of $240 is enclosed for payment of the NCDEQ permit processing fee.

Item B.
3a. Describe the existing conditions on the site and the general land use in the
vicinity of the project at the time of this application.
The entire site consists of 17.95 acres. Approximately 9 acres of the western side
of the site consists of an existing industrial manufacuring/shipping facility and
parking. The remaining 9 acres of the eastern portion of the site is undeveloped
and mostly forested with medium aged successional mix of trees dominated by
Eastern Red Cedar (Juniperus virginiana) on the western and northern sides and
mixed medium aged trees dominated by hardwoods on the eastern side. The
eastern half of the site has approximately 10 feet of old fill. Near the top of the old
fill is a depressed area which has collected water over many years and has
become Isolated Wetland #1 (W-1) which has been delineated and surveyed to
be 0.35 acre in size. It is expected that this depressed area is the result of
settling of the old fill material or otherwise left uneven due to mass grading. A
railroad spur construction around the eastern and northern sides of the site has
resulted in a similar Isolated Wetland #2 (W-2) which has been delineated and
surveyed to be 0.06 acre in size. This area occurs in a shallow graded ditch
running along the side of the railroad. A former U.S. Army Munitions Facility
occurred on the site prior to 1969. Since that time, the construction of a building
and surrounding parking on the western half of the site was originally used as a
tire manufacturing and distribution facility. The site is now used for snack food
manufacturing, distribution, and shipping. All surrounding land use is industrial or
commercial use.
3d. Explain the purpose of the proposed project.
The purpose of the project is to expand the existing the parking and turnaround
area for 68 parking spaces for semi tractor trailers required for the shipping and
distribution facility for the manufacturing plant on land that is already owned.
3e. Describe the overall project in detail, including the type of equipment to be
used.
This project consists of clearing and grading of a formerly filled area of forest to
create a tractor trailer storage consisting of 68 parking spaces and vehicle
turnaround area. will be constructed as a part of the site grading. Equipment to
be used will consist of loaders, graders, trucks, trackhoes, backhoes, and other
typical construction equipment.

I. REQUESTS FOR CORPS APPROVAL OF SURVEY PLAT
Prior to final production of a Plat, the Wilmington District recommends that the Land
Surveyor electronically submit a draft of a Survey Plat to the Corps project manager for
review.
Due to storage limitations of our administrative records, the Corps requires that all hard-
copy submittals include at least one original Plat to scale) that is no larger than 11"x17"
(the use of match lines for larger tracts acceptable). Additional copies of a plat, including
those larger than 11"xl7", may also be submitted for Corps signature as needed. The
Corps also accepts electronic submittals of plats, such as those transmitted as a Portable
Document Format (PDF) file. Upon verification, the Corps can electronically sign these
plats and return them via e-mail to the requestor.

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to accept
payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the table
below. Please note that this decision does not assure that participation in the DMS in -lieu fee mitigation program will be
approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to
contact permitting agencies to determine if payment to the DMS will be approved. You must also comply with all other

The U.S. Fish and Wildlife Service (Service) has reviewed your letter for the above -referenced
project dated and sent via email on November 20, 2015. In your letter, you requested our review
of the site for known federally protected species. We submit the following comments in
accordance with the provisions of the Fish and Wildlife Coordination Act, as amended
(16 U.S.C. 661-667e); the National Environmental Policy Act (42 U.S.C. §4321 et seq.); and
section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act).
Project Description
According to the information you provided, your client proposes to construct a parking and
distribution truck turnaround area on a partially wooded 17.95 acre lot in Charlotte, North
Carolina. You indicated that proposed project would result in permanent impacts to two
wetlands (0.35 acre and 0.06 acre) that are isolated from surface waters. Your letter did not
indicate if you are proposing any compensatory mitigation for the proposed impacts.
According to our records, the landcover within the proposed project area and surroundings
primarily consists of medium- and high-intensity development and Southern piedmont dry oak -
pine forest.
Federally Listed Endangered and Threatened Species
In your letter you state that, "the site does no exhibit suitable habitat for any of the listed species
known to occur in the area." In the interest of preventing or mitigating for impacts to federally
protected species, the Service respectfully requests that you elaborate on the basis for this
assertion given your familiarity with the site.
According to Service records, suitable roosting habitat occurs within the project area for the
federally threatened northern long-eared bat (Myotis septentrionalis). During the summer,
northern long-eared bats typically roost singly or in colonies in a wide variety of forested
habitats, underneath bark, or in cavities/crevices of both live trees and snags. Northern
long-eared bats have also been documented roosting in man-made structures (i.e., buildings,
barns, etc.) during the summer. Northern long-eared bats predominately winter in hibernacula
that include caves and abandoned mine portals. It should be noted that the general habitat types
described above may not be all-inclusive; additional habitat types may be identified as new
information is obtained.
The nearest Service record of occurrence for this species is greater than 45 miles from the project
site. Moreover, suitable habitat appears to be minimal on site. As long as the tree -cutting
moratorium (May 15 – August 15) is incorporated into development plans, the Service maintains
that the probability of "take" that could occur from this project would be insignificant and/or
discountable. Therefore, we would concur with a determination that the proposed project "may
affect", but is "not likely to adversely affect" the northern long-eared bat as long as the
moratorium is observed.
According to Service records, the periphery and eastern portion of the project site may contain
suitable habitat for the federally endangered Schweinitz's sunflower (Helianthus schweinitzii).
The Schweinitz's sunflower occurs in relatively open habitats—road, power -line, and other
maintained rights-of-way; early successional fields; forest ecotonal margins; forest clearings; etc.
It thrives in full sun but also grows in the light shade of open stands of oak -pine -hickory. This
species generally occurs on soils characterized as moist to dryish clays, clay-loams, or sandy -
clay loams that often have high gravel content. The species is known from a variety of soil types,
including Iredell (Fine, Montmorillonitic, Thermic Typic Hapluduff), Enon (Fine, Mixed,
Thermic Ultic Hapludalf), and Cecil (Clayey, Kaolinitic, Thermic Typic Hapludult). According
to our records, the nearest recent occurrence of this species exists less than 4.5 miles away in
soils similar to those that are present at the project site (Iredell fine sandy loam).
In accordance with the Act, it is the responsibility of the appropriate federal agency or its
designated representative to review its activities or programs and to identify any such activities
or programs that may affect endangered or threatened species or their habitats. If it is determined
that the proposed activity may adversely affect any species federally listed as endangered or
threatened, formal consultation with this office must be initiated.
