REQUEST FOR MORE INFORMATION
Dear Mr. Shackeeford:
On October 15, 2007, the Division of Water Quality (DWQ) received your complete application
dated July 13, 2007, to impact 0.025 acres of wetlands and 25501inear feet of protected riparian
buffers to construct the proposed amenity lake for a residential subdivision and golf course. The
DWQ has determined that your application was incomplete and/or provided inaccurate
information as discussed below. The DWQ will require additional information in order to
process your application to impact protected wetland, streams and/or buffers on the subject
property. Therefore, unless we receive the additional information requested below, we will have
to move toward denial of your application as required by 15A NCAC 2H .0506 and 2B .0233(8)
and will place this project on hold as incomplete until we receive this additional information.
Please provide the following information so that we may continue to review your project.
Additional Information Requested:
1. Neuse Riparian Buffer Impacts
The creation of Lake Nina is allowable under the Neuse Riparian Buffer Rules (15A NCAC
2B 0.233 (6) as long as items (4) Zones of the Riparian Buffer and (5) Diffuse Flow
Requirement are met. The project is requesting that portions of the newly established
riparian buffer not meet the requirements of items (4) and (5) of the rule, which is
"Allowable with Mitigation". Utilization of this portion of the rule requires that an
approved mitigation site and plan be approved and the mitigation be implemented prior to
the construction of Lake Nina.

-Please provide a restoration plan for the riparian buffer for Lake Nina.
-Please provide a mitigation plan to be approved by the DWQ for the portion of the
riparian buffer that is eligible for the "Allowable with Mitigation" provision.
Please contact Kyle Barnes of the Washington Regional Office and Ian McMillan of the DWQ
Oversight/Express Office with your response to this letter. If we do not hear from you within
four weeks, we will assume that you no longer want to pursue this project and we will consider
the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands,
waters or protected buffers. Please be aware that any impacts requested within your application
are not authorized (at this time) by the DWQ. Please call Kyle Barnes of the Washington
