Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please note that in 2009, the entire Big Laurel Creek Water shed has been reclassified to Outstanding Resources Waters (ORM. This ORW stream classification does not allow for any new wastewater discharges or expansions of existing wastewater discharge, in accordance with 15A NCAC 213.0225. Your February 28, 2011 letter to the DWQ requested the following changes to the draft permit: 1. After submittal of one year of sampling data, indicating no toxicity problem in the effluent, the quarterly monitoring requirement for Whole Effluent Toxicity (WET) testing is reduced to annual sampling. 2. After submittal of three years of sampling data, indicating no toxicity problem in the effluent, the quarterly sampling requirements for Turbidity, Copper, Manganese and Zinc is dropped from the permit requirements. A request to change the monitoring requirements for both WET testing and quarterly sampling requirements for Turbidity, Copper, Manganese and Zinc can be re-evaluated after the submittal of 12 sampling events. Please submit a modification request and sampling data for the parameters referenced above. However, the Permittee shall continue to record and submit all values reported by a North Carolina certified laboratory (including field certified), even if these values fall below 50 ug/l. 2) Parameter should be monitored in conjunction with toxicity test. 3) Zinc should be monitored if Permittee adds zinc orthophosphate as a corrosion inhibitor prior to backwashing. 4) Chronic Toxicity Monitoring P/F (Ceriodaphnia Dubia) @ 5.78 %, during the months of January, April, July, and October. See Part I, Condition A. (2.). Further studies will be required to determine the cause of toxicity, if any. The collection of samples shall coincide with the sampling of other parameters. There shall be no discharge of floating solids or visible foam in other than trace amounts All samples collected should be of a representative discharge. Permit NCO083712 A. (2.) CHRONIC TOXICITY MONITORING (QRTRLY) The permittee shall conduct quarterly chronic toxicity tests using test procedures outlined in the "North Carolina (Ceriodaphnia Dubia) Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions. The effluent concentration defined as treatment two in the procedure document is 5.78 %. The testing shall be performed as a Ceriodaphnia dubia 7day pass/fail test. The tests will be performed during the months of January, April, July and October. Effluent sampling for this testing shall be performed at the NPDES Permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Additionally, DWQ Form AT-1 (original) is to be sent to the following address: Attention: North Carolina Division of Water Quality Environmental Sciences Section 1621 Mail Service Center Raleigh, N.C. 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately. Upon submission of a valid test, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. If the Permittee monitors any pollutant more frequently than required by this permit, the results of such monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT Forms submitted. NCO083712 we would like to request that the Whole Effluent Toxicity testing be reduced to 1 year. We feel that this should be sufficient data to indicate if there is a toxicity problem. As you are probably aware toxicity testing is very expensive ($150.00 per test) and time consuming and we feel that passing along any more expense to our already overburdened customers is not fiscally responsible. Even with the reduction of some of our old parameters testing frequency's this would cost our customers well over $2,200 in a 3 year period. The extra metals testing at $12.00 per test should give an indication of any problem areas and is much more cost effective and reliable than the toxicity testing. Both the state and municipalities are mining on tight budgets and we. feel that this is not the time to add more cost to already strained budgets. We would also like to request that after 3 years the additional pollutants of Turbidity, Copper, Manganese, Zinc be dropped from the permit as we feel there should be sufficient data for those parameters as well. NCO083712 Town of Mars Hill Water Plant Lagoon Solids Handling Plan At the current time The Town of Mars Hill is utilizing a Geotube to dewater our Alum Sludge. We have a temporary permit to place the Geotube above the Lagoon and the effluent from the Geotube is carried back to the Lagoon before discharge. At such time when the Geotube is full and dry the town will haul the alum sludge to Madison County Landfill. The lagoon has to be emptied approximately every 5 or 6 years. Robert M.
