Accordingly, we are forwarding the attached final NPDES discharge permit. This permit is issued pursuant to the' requirements of North Carolina General Statute- 143-215.1 and the Memorandum of Agreement -between-North -Carolina: and the U.S. Environmental Protection Agency dated May 9; 1994 (or as. subsequently amended). The following changes have been incorporated into this final permit:. ➢ Your expiration date for this permit has been changed to February. 28, 2011. ➢ A total residual chlorine TRC limit of 28 pg/L has been added to this permit. ➢ Deletion of limits/monitoring for settleable solids and turbidity based on conventional WTP permitting strategies. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699- 6714). Unless such demand is made, this permit shall be final and binding. Please take notice that this permit is not transferable. There have been only minor changes treatment process or Lagoon design from the last permit consisting of the addition of a tablet dechlorinator for the removal of chlorine especially during the winter months and the addition of a Goetube for sludge removal above the lagoon facility. Our facility has a excellent record of compliance and is operating properly. North Carolina General Statute 143-215.6 (b)(2) provides that: Any person who knowingly makes any false statement representation, or certification in any application, record, report, plan, or other document files or required to be maintained under Article 21 or regulations of the Environmental Management Commission implementing that Article, or who falsifies, tampers with, or knowingly renders inaccurate any recording or monitoring device or method required to be operated or maintained under Article 21 or regulations of the Environmental Management Commission implementing that Article, shall be guilty of a misdemeanor punishable by a fine not to exceed $25,000, or by imprisonment not to exceed six months, or by both. (18 U.S.C. Section 1001 provides a punishment by a fine of not more than $25,000 or imprisonment not more than 5 years, or both, for a similar offense.) We have a temporary permit to place the Geotube above the Lagoon and the effluent from the Geotube is carried back to the Lagoon before discharge. At such time when the Geotube is full and dry the town will haul the alum sludge to Madison County Landfill to be incorporated with the topsoil on landfill cells.
