Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant
to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
.between North Carolina and the U.S._ Environmental Protection Agency dated -May 9 994or as .
subsequently amended).
This final permit includes no changes from the draft permit sent to you on January 31, 2007.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless
such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits
required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or
Local governmental permit that may be required.

There shall be no discharge of floating solids or'visible foam in other than trace amounts.
A. (2) CHRONIC TOXICITY TESTING REQUIREMENT
The effluent discharge shall at no time exhibit observable inhibition of reproduction or
significant mortality to Ceriodaphnia dubia at an effluent concentration of 90%.
The permit holder shall perform at a minimum, quarterly monitoring using test procedures
outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised
February 1998, or subsequent versions or "North Carolina Phase H Chronic Whole Effluent
Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be
performed during the months of February, May, August and November. Effluent sampling
for this testing shall be performed at the NPDES permitted final effluent discharge below all
treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or
ChV below the permit limit, then multiple -concentration testing shall be performed at a
minimum, in each of the two following months as described in "North Carolina Phase II
Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent
versions.

A. (2) CHRONIC TOXICITY TESTING REQUIREMENT, continued
The chronic value for multiple concentration tests will be determined using the geometric mean
of the highest concentration having no detectable impairment of reproduction or survival and the
lowest concentration that does have a detectable impairment of reproduction or survival. The
definition of "detectable impairment," collection methods, exposure regimes, and further
statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent
Toxicity Test Procedure" (Revised -February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the
parameter code TGP3B for the pass/fail results and TBP3B for the Chronic Value. Additionally,
DWQ Form AT-3 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section
no later than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemical/physical measurements
and all concentration/response data, and be certified by laboratory supervisor and ORC or
approved designate signature. Total residual chlorine of the effluent toxicity sample must be
measured and reported if chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity
monitoring is required, the permittee will complete the information located at the top of the
aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county,
and the month/year of the report with the notation of "No Flow" in the comment area of the
form. The report shall be submitted to the Environmental Sciences Section at the address cited
above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required,
monitoring will be required during the following month.
Should any test data from this monitoring requirement or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be
re -opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum
control organism survival, minimum control organism reproduction, and appropriate
environmental controls, shall constitute an invalid test and will require immediate follow-up
testing to be completed no later than the last day of the month following the month of the initial
monitoring.

Mr. Sledge:
CORR Environmental Resources Inc. (CORR) as an authorized representative of AAF-
McQuay Inc (AMI) is responding to the January 31, 2007 Draft NPDES permit renewal
application referenced above. The Draft Permit will regulate the effluent discharge
resulting from the groundwater remediation operation at the former Heatcraft property
located at 602 Sunnyvale Drive in Wilmington, New Hanover County. The Draft Permit
was received by CORR on February 3, 2007. CORR offers the following response to the
Draft Permit:
Agree to the quarterly monitoring measurement frequency and requirement of
92.4 pg/L (ppb) for trichloroethene (TCE) for the effluent discharge;
Agree to the quarterly monitoring measurement frequency requirement for
Chronic Toxicity Testing; and
Agree to the monthly average discharge flow limit of 0.36 Million Gallons per Day
(MGD) from ouffall 001.
The pH requirement of 6 to 9 Standard Units will also be tested in conjunction with the
quarterly monitoring requirement. The quarterly monitoring for TCE will be
subcontracted to a North Carolina certified laboratory and will utilize standard EPA
Method 8260 for volatile organic compounds. The Chronic Toxicity testing will also be
subcontracted to a North Carolina certified laboratory. The Chronic Toxicity testing will
use the referenced "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure,"
or the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure," both
revised February 1998.
No other comments are offered concerning the Draft Permit as received and CORR
recommends issuance of the Final Permit as stated in your cover letter to the Draft
Permit.

Regarding outfall 002, flow was redirected and now all effluent is discharged through outfall
001. I'm not sure of exactly when the change occurred. Along those same lines (no pun
intended), I don't have an explanation for the lack of EPA 624/625 monitoring. It seems when
analyses were done, they don't show much, if any, problems with those parameters. I don't
see where it would hurt to cut back on those but, that's me. Let me know what you think.

I'm finally getting around to playing with this permit and I have a question. From what I see here in
the files, the facility has been required by the permit to perform the EPA 601 and 625 analyses on its
effluent on a quarterly basis. In the DMR files I can't find any record documenting that they've been
performing the tests. The last reference I found was from some sampling in February 2003, prior to
the issuance of the current permit.
The quarterly sampling frequency for these tests in the permit sounds a bit high at first glance. Do
you know if there was any modification that occurred later that would explain why no data have
been submitted. I did notice in the application package they submitted results of these analyses from
May 16, 2006, but they weren't reported on or with the DMR.
Please tell me I'm missing something. What do you think we should do with such a testing
requirement in a new permit?
One other thing... It looks like at one time they either had or had proposed a pipe 002. It wasn't
mentioned in the current permit, but it was in the 1996 permit. We have it in BIMS, but it's noted to
be suspended. Any ideas about how I should deal with that? I'd ask up here but the guy who wrote
the last permit has left the division.

PART IV - EVALUATION AND RECOMMENDATIONS
While in operation, this facility used TCE, TCA, and Carbon Tetrachloride to
degrease refrigeration coils manufactured at the facility. Spills and subsequent
remediation occurred. Organic constituents were identified in both the deep and
shallow aquifers. This system effectively treats the contaminated groundwaterfrom
both deep and shallow wells. All treatment components function as designed and
produce a clean, clear effluent.
It is recommended the permit be reissued for the facility, in accordance with the
CFR Basinwide plan.

NPDES permit renewal application for existing permit number NC0083658. The renewal
application is in reference to the groundwater remediation water treatment system at the
former Heatcraft property located at 602 Sunnyvale Drive in Wilmington, New Hanover
County. The following items are included with the renewal application:

Former Heatcraft Remediation Site
NCO083658
Currently no sludge or solid wastes are generated during the groundwater treatment
activities. No industrial waste water is included in the influent stream and all
groundwater contaminants are volatile organic compounds, primarily trichirorethene,
trichloroethane and the constituent breakdown products. The contaminants are off -
gassed during the air stripping operation and no residuals remain after treatment. The
only solid waste generated is accumulated dirt and wind blown sand which collects in the
secondary containment area sump. These solids primarily include pine tree needles and
are removed as warranted to maintain operation of the sump. These solids are collected
in a DOT approved 55-gallon drum and stored within the secondary containment area.
The drum is properly disposed of as hazardous waste by contract to an approved vendor
to McQuay. Waste disposal transport manifests) and disposal certification documents
are filed on site when received from the vendor.
Future plans for the system may include the use of additional groundwater extraction
points at the rear of the facility former Heatcraft facility. If these additional extraction
points are required by the DNR Hazardous Waste Unit, this remedial activity could
generate petroleum hydrocarbon based sludge or solids that are commingled with
dissolved volatile organic constituents. These materials if generated will be
containerized in DOT approved 55-gallon drums or could be stored in an appropriate
storage tank for scheduled removal by a permitted vacuum truck and disposed of as a
hazardous waste or recycled as appropriate or allowed by law.
Prior to any off -site shipment of sludge or solid materials, CORR will submit a Sludge
Management Plan containing a full analytical report, handling procedures and
disposal/recycling options for agency approval.
