Dear Mr. Sams:
Division personnel have reviewed and approved your application for renewal of the subject
permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated May 9, 1994 (or as subsequently amended).
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this letter. This request must be in the form of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-
6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division
may require modification or revocation and reissuance of the permit. This permit does not affect
the legal requirements to obtain other permits which may be required by the Division of Water
Quality or permits required by the Division of Land Resources, the Coastal Area Management
Act or any other Federal or Local governmental permit that may be required.

to receiving waters designated as Big Laurel Creek in the French Broad River Basin
in accordance with effluent limitations, monitoring requirements, and other conditions set forth in Parts I,
II, III and IV hereof.
This permit shall become effective December 1, 2001.
This permit and authorization to discharge shall expire at midnight on November 3U, 2006.

SUPPLEMENT TO PERMIT COVER SHEET
Town of Mars Hill is hereby authorized to:
1. Continue to operate an existing drinking water treatment facility with the following
components:
♦ Sludge Holding Lagoon for Filter Backwash
The facility is located at Water Treatment Facility, on NCSR 1505, near Mars Hill,
in Madison County.
2. Discharge filter -backwash wastewater from said treatment works at the location
specified on the attached map into Big Laurel Creek which is classified Class C-
T rout waters in the French Broad River basin.

During the period beginning on the effective date of the permit and lasting until
expiration, the Permittee is authorized to discharge from outfall 001. Such discharges shall

1. The discharge shall not cause the turbidity of the receiving water to exceed 10 NTU. If the
turbidity exceeds these levels due to natural background conditions, the discharge level
cannot cause any increase in the turbidity in the receiving water.
2. Total Residual Chlorine monitoring is required only if Chlorine is present in water used to
backwash the filters.
3. Aluminum monitoring is required only if alum flocculation is utilized.
There shall be no discharge of floating solids or visible foam in other than trace amounts.

On the basis of thorough staff review
and application of NC General Statute
143.21, Public law 92-500 and other
lawful standards and regulations, the
North Carolina Environmental
Management Commission proposes to
issue a National Pollutant Discharge
Elimination System (NPDES)
wastewater discharge permit to the

Written comments regarding the
proposed permit will be accepted until
30 days after the publish date of this
notice. All comments received prior to
that date are considered in the final
determinations regarding the proposed

The Town of Mars Hill would like to request the renewal of its water treatment plant
lagoon permit (NPDES Permit NC0083712). There have been no changes in treatment
process or Lagoon design from the last permit. Our facility has an good record of

Mars Hill Water Treatment Plant- Lagoon
Madison County
The water treatment facility for the town began operation in June
1997 and there have not been enough alum sludge generated at this
time for removal from the lagoon. A 8-year estimate for removal is
possible, which would be June 2005. At that time we plan to
dispose of the alum sludge at the Madison County Landfill in the
top 2' of cover.
