As project sponsor it is our duty to inform you of this issue and seek a resolution. The encroachment areas, shown on the included map, appear minor. It includes a single area of plow impact which constitute approximately 0.1 acres. The scalloping nature indicates that it was inadvertent. We will add additional markers to this line to make future navigation easier; however as the landowner it is your duty to make sure you and your agents abide by the easement terms. As you are aware no damage to vegetation is permitted, including spraying, mowing, plowing, cutting, grazing, burning, etc. Finally, please be aware that this project is subject to review by the North Carolina Division of Water Quality as part of a nutrient offset bank and there is zero tolerance for boundary encroachment. Please remind any lessees/agents/tenants or subcontractors who may be working on the property to respect the easement boundaries moving forward. This includes being mindful of herbicide overspray and chemical drift from adjacent fields.
