Enclosed is a copy of the Compliance Evaluation Inspection Report for the inspection conducted at the
subject facility on April 9, 2014 by Mr. Wes Bell of this Office.
This report is being issued as a Notice of Violation (NOV) due to the facility's failures to monitor the
effluent which are all violations of the subject NPDES Permit and North Carolina General Statute (G.S.) 143-215.1,
as detailed in the Effluent Sampling section of the attached report. Pursuant to G.S. 143-215.6A, a civil penalty of
not more than twenty-five thousand dollars ($25,000.00) per violation, per day, may be assessed against any person
who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant
to G.S. 143-215.1.
It is requested that a written response be submitted to this Office by May 7, 2014, addressing the above -
noted violations in the attached report. In responding to the violations, please address your comments to the
attention of Mrs. Marcia Allocco. The Bioicide Worksheet — Form 101 should be completed (for each biocide) and
submitted to the Division (address on the application form) prior to the next discharge event.
The report should be self-explanatory; however, should you have any questions concerning this report, please

Comment: The subject permit became effective on 8/1/2012 and expires on
7/31/2015. Biocides (MG906 and MG907) are added to the air washer and cooling
tower systems; however, no records of prior approval by the Division can be found. A
Biocide Worksheet - Form 101 must be completed (for each biocide) and submitted to
the Division at the address listed on the application form. Note: A copy of the Biocide
Worksheet application form has been attached to this report and the chemical supplier
may be able to provide assistance with the Biocide Worksheet Forms.
Corrosion inhibitors (CL4550 and CL4000) are also added to these cooling systems.

Comment: The facility staff indicated that the air washer and cooling tower systems
are only operational from June through late September/early October. These cooling
systems are drained once per year following this operational time period into the
stormwater drainage system. Corrosion inhibitors (CL4550 and CL4000) and biocide
MG907 are added to the air washer and corrosion inhibitor CL4000 and biocide MG906
are added to the cooling tower. Note. The facility is also equipped with a chiller system
that will need to be repaired prior to operation. Please be advised that the discharge
may need to be dechlorinated prior to discharge to comply with the total residual
chlorine effluent limit. Dechlorination options were discussed with the General Manager
during the inspection. In addition, the chemical supplier may also be of assistance with
dechlorination options.

requirements of North Carolina General Statue 143-215.1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection agency dated May 9, 1994 [or as subsequently amended].
If any parts, measurement frequencies or sampling requirements contained in this General Permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, the certificate of coverage shall be final and binding.
Please take notice that this Certificate of Coverage is not transferable except after notice to the
Division. The Division may require modification or revocation and reissuance of the certificate of coverage.
Contact the Mooresville Regional Office prior to any sale or transfer of the permitted facility.
Regional Office staff will assist you in documenting the transfer of this CoC.
This permit does not affect the legal requirements to obtain other permits which may be required by
the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area

Pending a final review of this request by the Stormwater and General Permits Unit staff.
It is recommended that a new COC be issued.

Certificate of Coverage had an incorrect name for the receiving stream where the non -contact
cooling water is discharged. The correct name is an unnamed tributary to Frye Creek in the
Catawba River Basin. The enclosed Certificate of Coverage has the correct name, and replaces
the previously issued Certificate. Please discard the incorrect page and replace it with the
enclosed Certificate. This Certificate of Coverage is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
