Sullins, Director Division of Water Quality Chuck Wakild, P.E., Deputy Director Division of Water Quality DWQ Project # 07-1753 Bertie County Page 1 of 2 On October 16, 2007, the Division of Water Quality (DWQ) received your application to impact 0.69 acres of waters to construct a shoreline stabilization wall and 13 groins into the Chowan River. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Avoidance and Minimization Within your application you are requesting to construct (12) 50'long groins and (1) 100' long groin protruding into the Chowan River. The foundation of these structures is requiring a 15' wide base in Public Trust Waters. These waters have been observed to grow Submerged Aquatic Vegetation (SAV), which provides habitat for aquatic species. Please provide information stating the purpose and need to usurp such a large area of Public Trust Waters to construct these structures when there are less invasive methods. Project Plans Please provide set of project plans providing crossectional detail of the grading activities associated with the shoreline stabilization project. Please contact Kyle Barnes of this office and Ian McMillan of the DWQ Central Office in writing within four weeks of this letter with your response. If we do not hear from you within four weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
