Sullins, Director Division of Water Quality November 29, 2007 CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Robert Shank 1St American Builder 2514 Reliance Avenue Apex, NC 27539 DWQ Project # 07-1815 Wake County Subject Property: The Meadows Subdivision Ut to Richland Creek [030402, 27-21-(0.5), C, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Shank: On October 26, 2007, the Division of Water Quality (DWQ) received your application dated October 23, 2007, to fill or otherwise impact 1501inear feet of intermittent stream and 8,030 square feet of Zone 1 Neuse River basin protected riparian buffers and 4,837 square feet of Zone 2 Neuse River basin protected riparian buffers to construct the proposed residential subdivison. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Please indicate all stream impacts, including all fill slopes, dissipaters, and bank stabilization on the site plan. 2. This Office believes that flows will be directed from the road crossing directly into the downstream streambank and be forced to make a 90° turn immediately. This area will then erode. The filter strips for all four of the proposed level spreaders are too steep to allow for diffuse flow. Per the DWQ BMP Manual, the filter strip is defined as all of the land between the level spreader lip and the receiving stream or ditch. According to that definition, the filter strip slopes exceed 15 percent for all four of the proposed level spreaders. Please adhere to the guidance provided in the DWQ BMP Manual, "If the topography of the filter strip is too steep for a level spreader, a different type of BMP will be needed. If the intended filter strip is an area protected by the Riparian Buffer Rules, then the stormwater will have to be treated by a BMP that removes 30 or more percent of the nutrients rather than using a level spreader. The outfall of this BMP can then be routed directly through the buffer with written approval from the DWQ." In your resubmittal, please provide a DWQ BMP Supplement Form with all required items for each proposed BMP. BMP Supplement Forms are available on the following web site: http://h2o.enr.state.nc.us/su/bmp_forms.htm. 4. Please explain why you requested 73 feet of stream mitigation from NC EEP. Please submit this information within 30 calendar days of the date of this letter. If we do not receive this requested information within 30 calendar days of the date of this letter, your project will be withdrawn and you will need to reapply with a new application and a new fee. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
