Director NORTH CAROLINA Environmental Quality April 18, 2024 Daniel Ramsay DWR Project #: 2023-0163v2 RestorEcology Neuse, LLC Wayne County (via electronic mail: dramsay&restorecolog m ) Re: Brooks Swamp Mitigation Banking Instrument (MBI) Brooks Swamp Bank Parcel Credit Release — Task 1 Dear Mr. Ramsay: On February 21, 2024, the Division of Water Resources (DWR) approved the Bank Parcel Development Package (BPDP) for the Brooks Swamp Nutrient Offset and Buffer Mitigation Bank. On March 22, 2024, the DWR received a signed and recorded conservation easement and corresponding plat for the subject site. Additionally, RestorEcology Neuse, LLC (REN) provided confirmation that the conservation easement for the subject bank has been successfully assigned to Unique Places to Save. Unique Places to Save is a 501(c)(3) non-profit corporation and has been approved by DWR as a long-term steward for this mitigation bank. Lastly, DWR received a performance bond (#GSA2401090) from REJ in the amount of $150,000 to cover performance obligations for the construction of the subject site. This bond is with The Gray Casualty & Surety Company and ends with DWR approval of the As -Built Report. In accordance with the MBI, signed on February 21, 2024, the following Project Milestones have been met and the corresponding credits shall be released: Task/Milestones Credit 1) MBI and BPDP Approved by DWR, Conservation Easement recorded 25% and assigned according to B (1) of Section X and Financial assurance Posted By copy of this correspondence, DWR confirms that you have satisfied the above requirements for the above -referenced tract and the following credits are released and available to sell: • 25% of your Neuse riparian buffer Restoration credits (0.25 x 205,602 ft2 = 51,400.500 ft2) 25% of your Neuse riparian buffer Preservation & Enhancement credits (0.25 x 8,104.236 ft2 = 2,026.059 ft2). 25% of your Nitrogen nutrient offset credits (0.25 x 9,802.942 lb-N = 2,450.736 lb-N) North Carolina Department of Environmental Quality I Division of Water Resources 512 North Salisbury Street 1 1611 Mail Service Center I Raleigh, North Carolina 27699-1611 NORTH CARCLINA 919.707.9000 DocuSign Envelope ID: 965A1E31-22F7-423F-9E24-049F3EF56AFB Brooks Swamp Site RestorEcology Neuse, LLC April 18, 2024 Please note that nutrient offset credits generated at this site must be used for impacts in HUC 03020201 of the Neuse River Basin excluding the Falls Lake Watershed pursuant to 15A NCAC 02B .0703, which became effective on April 1, 2020. Additionally, the riparian buffer credits must be used for impacts in the Neuse River Basin, excluding the Falls Lake Watershed, in accordance with guidelines in the Consolidated Buffer Mitigation Rule, 15A NCAC 02B .0295, which became effective on November 1, 2015 Please use the Credit Ledger Templates provided in the approved MBI to track and report credit availability for the Brooks Swamp Mitigation Bank. Upon receiving this correspondence, please submit three (3) credit ledgers to DWR reflecting the available credits released for each mitigation type (Buffer Restoration, Buffer Preservation w/ Enhancement, Nitrogen Nutrient Offset).
