I have attached the information you requested below and answers to to questions listed. 1. We are waiting on a 401 application fee request from DEQ, per Mr. Tyler Hickman ( Asheville office). Mr. Hickman stated we should receive the fee request in the next fee days and once paid the application will begin processing and assigned a reference number. 2. 1 have attached a proposed site plan for phase 2 of the Foxcrest project. 3. No wetlands will be disturbed in the project area. As we discussed , area above the project was my only concern. 4. i have included culvert sizing and design, 100 year flow rate using the rational method, flow rate calculations, headwall design and maps. Also a letter from The Town of Beech Mountain requesting HDPE pipe. We had discussed a concrete head wall construction, but i have included a stack stone design to keep the area more natural looking. I also completed a current flow rate , using the toss method, which resulted in a 23 cubic feet per second flow rate. 5. The 8 to 10 trees have been cut down and cleared to avoid any species impacts. Based on that discussion and review of the application submitted, there will need to be additional information submitted to continue the review of your application which is summarized below. I've also attached an aerial map and photos along with the plans you sent marked up with a little more clarification as to the crossing location in case Tyler has questions. 1. The PCN you submitted is for both a 404 permit (myself) and the 401 (Tyler). We have started processing it but I don't see where it has been logged in/currently under review with the 401 folks so you may want to check with them. We will need their 401 certification if an Individual Certification is required prior to issuance of our permit. Note: the permit you are applying for is a Nationwide Permit #29. Please contact Tyler for more information related to the 401 approval process. 2. This appears to be a crossing to facilitate construction of additional phases of a previously developed parcel. Please provide more detail on future plans for this phase (location of road/lot layout) so that we can determine if any additional impacts to streams/wetlands would occur as a result of this future development. 3. Your plans show wetlands but I wasn't seeing where these could be when I was out. Do you know who/when identified these wetland areas/how they got on to the plans you provided? 4. A detailed plan will need to be submitted that shows the culvert details (cross-section, plan view) and pipe being buried at least a foot. You are proposing a 48-inch diameter pipe for 60-feet in length. I discussed with Keith my concern that pipe size may be too small and how it will be able to be buried considering the bedrock (see photos). You will need to address how you determined culvert size, if it will be able to be buried and if the culvert length/impact can be reduced. There also may be issues/concerns with using a HDPE culvert versus metal corrugated due to the slope in the stream. I am copying Andrea Leslie with the NC Wildlife Resource Commission on this since we also have to coordinate with their agency so that she can provide comments when the plans come. 5. Our permit requires coordination with USFWS relating to listed threatened/endangered species specifically bat populations in this area. It appears as though approximately 8 trees will be removed that could provide summer roosting habitat. Please provide a construction schedule so that we can determine if there will be impacts to these species as part of our required coordination. Note: typically if trees are down/cleared by March 315t (before summer roosting) then this may be acceptable to USFWS or you may potentially need to wait until after October 15 to remove trees.
