This includes tracing the pathway of a storm sewer to its discharge point. c) If this application is being submitted by a consulting engineer (or engineering firm), include documentation from the applicant showing that the engineer (or firm) submitting the application has been designated an authorized Representative of the applicant. d) Final plans for the treatment system (if applicable). Your comments on the draft General Permit NCG500000 were very helpful during finalization of the General Permit and the Fact Sheet. A copy of the Fact Sheet is attached. A copy of the subject permit is also attached. This letter addresses your specific questions and requests for clarification in your letter of May 29,1997. Your letter contained 35 points which listed either typographical errors, techinical inconsistencies or requests for clarification. Given the length of your comments, the issues raised in your letter are not repeated here. Instead, I have listed the Division's responses to your points in the same order as you presented them: Fact Sheet htLe 1. The Permit and Fact Sheet have been corrected to delete the word "treated" when referring to discharges covered by the subject permit. I.A. Activities Covered by this General Permit 2. Exempt stormwater has been defined in the Fact Sheet (Section 1.D.). 3. The paragraph has been amended to include various waters associated with hydroelectric power facilities. 4. The tailrace is not specifically identified in the Fact Sheet as the sampling point for hydroelectric facilities. Larger facilities have multiple outfalls which will require sampling sites other than the tailrace. The tailrace should be considered the primary outfall if no other discharge points exist at the facility. 1.D. Types of Wastewater Discharged 5. Section 1.1). of the Fact Sheet has been rewritten. 2. The regulatory citation which provides the basis for the oil and grease limit is listed in the revised fact sheet. Your assumption that the limits were technology -based is correct. 13. Regardless of the technology used in sampling or analysis, the daily discharge of 20 mg/1 of oil & grease would constitute an unacceptable contamination of the receiving stream. 14. Oil and grease limits are a numerical representation of the statutory limit listed at 15A NCAC 213.0211 (3)(f) and will remain in the permit. The text in question is a standard statement present in all individual and General NPDES permits. As it pertains to your question, the Division understands that foam caused by the effluent is separate from foam present in the effluent. The natural turbulence of water flowing through the gates of a dam is not likely the product of pollutants added by the hydroelectric facility. If the permittee wishes to continue discharging, the permittee must apply for and obtain a new permit. The major points in your letter addressed the concept of "treated" wastewater, particularly that the waters discharged by facilities covered under NCG500000 should not be defined as "treated". The Division agreed with your suggestions on this topic, and revised the permit accordingly. However, your request that no limits be applied to oil and grease was denied. The language in 15A NCAC 213.0211 (3)(f) clearly prohibits any discharge which causes a visible sheen or slick. Numerical limits are necessary to reinforce what would otherwise be a subjective standard. Your concern that changes in sampling technology would cause a drastic change in sample results is not a sufficient reason to eliminate the limits for oil and grease. Discharges of these pollutants at or in excess of the daily (20 mg/1) or monthly (15 mg/1) maximums would cause a visible sheen, regardless of the methods used for sampling and/or analysis. These effluent limitations are consistent with those used in individual NPDES permits. The effluent limitations for oil and grease have not caused compliance problems for facilities operating under such limits. The effluent limitations are reasonably attainable and will remain in the permit. Please note that if you deem the requirements in the revised General Permit too stringent or unreasonable, you can always request that CP&L's facilities be covered under individual permits. The only substances that the Walters Plant may add to water are (1) trace amounts of metals from normal corrosion and erosion of the piping and equipment through which the water passes and (2) traces of oil and grease from the equipment that comes into contact with the water. Previous NPDES monitoring has indicated that the oil and grease concentrations resulting from this source are normally very low. In the unlikely event of an oil spill, the oil would be collected in the plant's sump. Should this occur, oil detectors in the sump would activate alarms and disable the discharge pump which would prevent the discharge of oil to the river. Any oil collected in the sump would be removed with an oil skimmer for proper disposal. The Walters Plant has a Spill Prevention Control and Countermeasure Plan which addresses procedures for minimizing the risk of oil spillage.
